- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: The Department of Veterans Affairs Network Contracting Office 6 plans to contract by means other than full and open competition in support of procurement request numbers 659-17-3-930- 0047 and 659-17-3-931-0086. 2. Nature and/or Description of the Action Being Processed: The objective of this request is to procure for PICIS brand Anesthesia Manager (ARK) and PICIS PACU hardware and software by means Other than Full and Open Competition for delivery to the VA's Health Care Centers in Charlotte, North Carolina and Kernersville, North Carolina; both locations are affiliated sites of care within the Salisbury Health Care System. This action will be awarded as a new firm-fixed-price contract. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Surgical Service Line at the Salisbury V AMC requires the PICIS ARK and PACU hardware and software to open the Ambulatory Surgical Centers at both the Charlotte and Kernersville Health Care Centers as this system is standardized throughout the Salisbury Health Care System. This procurement will be awarded to Four Points Technology, a Service-Disabled Veteran-Owned Small Business (SDVOSB). 4. Statutory Authority Permitting Other than Full and Open Competition (Brand Name Descriptions): (X) (1) Only One Responsible Source and No Other Supplies or Services Will SatisfyAgency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7. The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented for restricting competition on this procurement via FAR 12.1506-1 (b )(2). 5. Demonstration that the Contractor's Brand Name is required for the procurement (FAR 6.302-l{c): PICIS ARK and PACU system is being requested for this procurement as this equipment will be an extension of the system currently in use. Continuity across the board for the Salisbury, Charlotte, and Kernersville locations is paramount to safety. The same staff will use the system at all facilities and familiarity with the system is critical. Standardization for maintenance, parts and accessories is also in the best interest from a cost standpoint. Only one system should be used for record keeping within the medical center system. This system is used throughout VISN 6, and remaining with the same brand name system is in the best interest of the Government. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The procurement is limited by brand name standardization and a competitive procurement is not sustainable. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price to the Government is $249, 158.82 for the system for ARK and PACU systems supporting both Health Care Centers. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted which concluded that insufficient sources are available to support a competitive procurement. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: There are no other facts other than those already stated. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: As market research efforts were sufficient to determine sources, no sources expressed interest in writing. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There are no known barriers to competition at this time. 12. Requirements Certification: i certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cogniwnce, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
