Description
A.1 The Army Contracting Command - New jersey (ACC-NJ), on behalf of Precision Fires Rocket and Missiles Systems (PFRMS) Project Office, has a requirement for the Production of M270A1 Improved Armored Cab (IAC) for the Multiple Launch Rocket System (MLRS) Kits (hereafter referred to as IAC Modification Kit) for the Army. The MLRS requires system updates to remain viable and supportable after thirty years of being in service. Recent developmental efforts to accomplish this objective are concluding, leading to this acquisition plan for production of a major update to the system - the IAC Modification Kits. The IAC Modification Kits provide the Department of Defense (DoD) with an increased level of crew protection by replacing the armor surrounding the crew to meet ballistic protection requirements, provide blast protection seating, enhances the transparent armor and reduces training requirements for the crews by providing more commonality between the MLRS and High Mobility Artillery Rocket System (HIMARS). A.2 The United States Government (USG) intends to award a Firm Fixed Price (FFP) Base Year plus Four (4) one (1) Year Option Periods contract to cover FY17-FY21 Army IAC Modification Kits First Article Testing and production of IAC Modification Kits and Associated Spare Parts Kits. The contract will have a Period of Performance of five (5) years with a potential of $970.3 M for IAC Modification Kits and Associated Spare Parts. A.3 As part of the solicitation process the Government will make available the Technical Data package (TDP) for the IAC Modification Kits and Associated Spares Parts in Adobe Portable Document Format. This TDP (Attachment 0001 to the solicitation) is categorized as Distribution D and contains technical data whose export is restricted by the Arms Export Control Act (Title 22,U.S.C.,Sec 2751, et seq.) or Export Administration Act of 1979 (Title 50, U.S.C., App 2401, et seq.), as amended. Violations of these exports laws are subject to severe criminal penalties. These restrictions also apply to distribution of the TDP to all Subcontractors, Vendors, etc., at every level. Pursuant to limitation of Distribution D, the IAC Modification Kits TDP is restricted to the Department of Defense and contractors based in the United States of America (USA). A.4 Only interested parties who have completed and signed (by an authorized representative of the interested parties' firm, organization, etc.) the following solicitation Section J attachments will be able to receive a copy of the TDP (Attachment 0001): 1) AMSTA-AR Form 1350 Technical Data Request Questionnaire (Attachment 0002); 2) Militarily Critical Technical Data Agreement Form DD 2345 (Attachment 0003); 3) USG Non-Use and Non- Disclosure Agreement (NDA)(Attachment 0004); and 4) IAC Modification Kits Safe Site Limited Distribution Document Request Form (Attachment 0006) will be granted access to the IAC Modification Kits TDP. These completed and signed attachment forms MUST be returned via email to: catherine.e.johnangle.civ@mail.mil; john.w.hynes2.civ@mail.mil; gherin.fracasso.civ@mail.mil. Interested parties should also note the complete IAC Modification Kits TDP should be reviewed and used in proposal preparation when responding to solicitation W15QKN-17-R-0214. A.5 At the conclusion of the solicitation process, interested parties in receipt of data covered under the NDA will be required to complete the Certificate of Destruction (COD)(Attachment 0005 of the solicitation) notifying the USG that all licensed date covered by the NDA and received by the interested parties have been destroyed. The COD must be emailed to the email addresses referenced in paragraph A.4 no later than fourteen (14) calendar days after receipt from the USG of an unsuccessful offeror letter or no later than fourteen (14) calendar days after the solicitation closes and the interested parties did not submit a proposal in response to the solicitation. Copies of CDs, Digital Copies to Hard Drives/Thumb Drives/Server Drives/etc., and Paper Copies must be destroyed by the interested parties and or their subcontractors/vendors/etc. at any sublevel to the interested parties within the fourteen (14) calendar days period referenced in this paragraph. A.6 For purposes of expediting the IAC Modification Kits TDP release process once solicitation W15QKN-17-R-0214 has been released, the USG has uploaded the solicitation W15QKN-17-R-0214 attachments 0002, 0003, 0004 and 0006 with this pre-solicitation notice.
