Description
Sole Source Justification The Federal Communications Commission intends to award a Firm-Fixed-Price Purchase Order on a sole source basis in accordance with 41 U.S.C. 3304 (a)(1), when non-competitive procedures may be used, as implemented by FAR 6.302-1(b)(1)(i), unique supplies or services available from only one source or only one supplier with unique capabilities. The objective of this requirement is to procure for a total of 42 K&L Microwave tunable bandpass filters. The Enforcement Bureau (EB) Field Division maintains a variety of technical equipment that is used to locate sources of Radio Frequency (RF) interference. Tunable bandpass filters work in conjunction with spectrum analyzers and allow the agents to eliminate unwanted emissions, thus increasing the overall performance of the analyzers during the course of RF interference investigations. The EB Field Division requires the field offices to have various filters available at short notice. This acquisition will fill this need by providing each of the three regions with 2 high performance bandpass filters covering the frequency range from 63 MHz to 3000 MHz. The FCC has identified that there are no other capable sources, and the FCC will issue a Firm-Fixed Price Purchase Order to K&L Microwave 2300 Northwood Drive, Salisbury, MD 21801. This is not a request for competitive proposals or quotes and no solicitation is available. However, all responsible sources may submit a capability statement, which the government will consider. The response must be in writing with clear and convincing evidence to support the respondent's ability to provide timely and effective supplies or services that would be advantageous to the government. A determination by the government not to compete this action based on responses received is solely within the discretion of the government. The government will not be responsible for any costs incurred by responding to this notice. The Contracting Officer is William Levenson and the Contract Specialist is Nereyda Dunn. A solicitation will not be posted. Submissions are due by September 4, 2017, at 11:00 AM Eastern Daylight Time, via email ONLY at nereyda.dunn@fcc.gov. Questions submitted by phone will not be considered.
