Chapter VI: Other Than Full and Open Competition (OFOC) SOP Attachment 3: Request for Sole Source Justification Format >$150K OFOC SOP Revision 05 Original Date: 03/22/11 Revision 05 Date: 05/02/2016 Page 1 of 3 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: _VA244 17 AP 7632 Contracting Activity: Department of Veterans Affairs, VISN 4, Lebanon VA Medical Center PO Number: 595 17 3 480 0175 Nature and/or Description of the Action Being Processed: The Lebanon VA Medical Center requires a fixed firm commodities contract to purchase 102 Mindray Accutorr 7 vital signs monitors to be used in various departments throughout the facility. FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for commodities in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303 2. Description of Supplies/Services Required to Meet the Agency s Needs: The objective of the acquisition is for the procurement of vital signs monitors to meet the clinical needs as identified by the Lebanon VA s nursing leadership. The Lebanon VA Medical Center needs to procure an additional 102 Accutorr 7 vital signs monitors to be used throughout the facility. The Government intends to award a contract for the purchase of 102 Accutor 7 vital sign monitors. The purchase will help to meet the facility needs for vital sign monitors. The purchase of the vital sign monitors will include the additional monitors needed to support new clinical spaces. Estimated total value is $343,578.62. Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302 1 (b)(4); ( ) (2) Unusual and Compelling Urgency per FAR 6.302 2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302 3; ( ) (4) International Agreement per FAR 6.302 4 ( ) (5) Authorized or Required by Statute FAR 6.302 5; ( ) (6) National Security per FAR 6.302 6; ( ) (7) Public Interest per FAR 6.302 7; FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106 1(b)(2). Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Accutorr 7 Mindray vital sign monitor is currently being used throughout the hospital. Brand name is required for hospital standardization, training, and existing maintenance purposes in accordance with FAR 6.302-1 (b)(4). These items are part of the hospitals approved standardization program in order to provide consistent efficiencies for clinical, logistics, and biomedical staff. This standardization allows the clinical and maintenance staff to be trained on one product creating efficiencies and provider confidence. Additionally, this standardization allows for all batteries, maintenance repair parts, and services to be uniform. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: These products are distributed by several different vendors. An SDVOSB set aside will be posted to FBO in order to allow multiple vendors to compete for this requirement. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Price analysis will be used to determine price reasonableness. Catalogue prices, recent and similar contract prices, competition, historical data, and comparison to the IGCE will all be used in this analysis. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted using search In VIP, Sam, FPDS, and SBA database search engine. Several Veteran owned businesses were found that could distributed this product meeting the current requirement for a service disabled Veteran owned business set aside. Any Other Facts Supporting the Use of Other than Full and Open Competition: Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: 1st American Medical Distributors (SDVOSB Mindray DS USA Inc,(Large Business) The Janz Corp(SDVOSB) Glomax, Inc (SDVOSB) A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Even though this is a name brand request the government is encouraging competition by offering this to other companies besides the manufacturer. However, because of hospital standardization no other attempts to overcome these barriers at this time.
