J&A under FAR Subpart 6.3- Justification for Other than Full and Open Competition AVANCE NEO 600-MHz Fourier Transfmm Nuclear Magnetic Resonance (FT-NMR) system from Bnlker Biospin with a trade in of existing 600-MHz NMR system for credit. 1. Nature and/or description of the action being approved. a. Acquisition purpose and objectives:Purchase an AVANCE NEO 600- MHz Fourier Transfmm Nuclear Magnetic Resonance (FT-NMR) system from Bmker Biospin with a trade in of existing 600-MHz NMR system for credit. 3. Project background.:Th e 600-MHz NMR is a powerful and sensitive spectrometer to detect a vety low concentration of chemicals and the most powerful equipment of all analytical tools, especially to detetmine the physical stmcture of most organic and some inorganic molecules, essentially by identifying and locating different atoms within a molecule and elucidating their spatial relationships. An NMR system would significantly augment the analytical capability of WDTC; and it is a system Dugway must have to meet the · - customers for testing related to projects · ofboth liquid ru1d solid organic chemicals. This capability will augment the Chemic:r' mstmments as well as creating new business opportunities such as Analysis work. Combined Chemical Test Facility currently has a 10-year old out-of-date Bruker 600-MHz NMR. We plan to trade it in for a new Bruker 600-MHz NMR. The magnet of the new NMR provides a carefree maintenance of cryogenic liquid (nitrogen and helium). Also the new NMR will be upgraded to have a capability of analyzing solid samples. Alternatives: Currently, there is no other alternative source in the market that provides the 600-MHz NMR with dimensions to fit into the existing facility. No other source is capable of providing NMR that can analyze samples in low concentrations to nanogram levels. No other source can give a trade-in value of the current out-of-date system 4. This acquisition is using this justification format, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 or the authority of 41 U.S.C. 1903. 6. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited. Efforts were made to obtain competition through literature searches, technical conferences, internet searches, requests for product information, and technical journal searches. There is only another vendor, Varian, manufacturing NMR; however, recently Varian was sold to Agilent and was closed down. A sources sought was sent out by Department of Health and Human Services Program Support Center, Contract Specialist on FBO.gov. No responses have been received. At this time, Bruker is the only commercial supplier that provides the 600-MHz NMR that meets our requirements. Name and address of the proposed contractor(s). As describe above, within the last two years, Dugway has been performing the market research on the possibility of purchasing the new NMR, and there were two sources Varian and Bruker in the market. Varian was a possible source but after it was sold to Agilent, the NMR department was closed down. The only source that is able to offer the fixtures along with a lower price for trading in our current 600-MHz NMR is: Bruker BioSpin Corporation Tel 720-296-9730 richard.shoemaker@bruker.com Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited. This is an upgrade and replacement of the older system, NMR 600MHz, being also purchased from Bruker in the fiscal year 2006. Bruker Biospin is the only manufactmer of the NMR (600MHz) system that provides following unique features met Dugway requirements: a) Dugway laboratmy has many types of instruments causing the electromagnetic fields interferences with NMR. Bmker has the Ascend EDS (Extemal Disturbance Suppression) technology which efficiently suppresses extemal extemal electromagnetic field disturbances b) Analyze chemicals at ve1y low concentrations: Bruker can provide the c1yoprobe NMR which analyzes samples as low as nanograms. Because the size of the Dugway NMR laboratmy is small, the laboratmy cannot house the entire NMR system with the chilled-water service for the cryoprobe. Bruker is the only company that provide the air-cooled helium compressor located outside of the building. c) Bnlker provide an extra cooling power of the c1yogenic refrigerator system mitigates the liquid nitrogen boiloff; this will reduce a number of liquid nitrogen filling or reduce intenuptions of sample analysis. d) Conventionally when analyzing solid samples, the probe was needed to be removed. Bnlker provides the top-loading capability of the probe/MAS transfer system combination which eliminate the need for removing probe when analyzing solid samples. e) Bnlker's NMR thermometer technology allows samples to be analyzed at the sample temperature throughout an NMR experiment. In addition to those unique qualifications, Dugway laboratmy personnel have been well trained with the Bnlker system; therefore, the upgrade system is necessary to continuous support testing within the chemical test division with minimal downtime, maintenance, and operating expense 7. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies: a FedBizOpps notice was posted on July 30, 2017 to find other companies that sell the NMR. No responses have be make. 8. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable. Infmmation shall be provided by Bnlker Biospin that shall prove fair and reasonable from historical quotes being provided. Base on this infmmation the fair and reasonable shall be dete1mined. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted. MARKET RESEARCH: As describe in section #6. Dugway has historically purchased the following type of instrument fi:om Bmker Biospin and they are still the only company that offers this type of instrument. fu addition, Dugway scientists have attended technical conferences in past years and fotmd no other sources of vendors that can provide 600 MHz NMR with the described unique qualifications in section 6. After looking through the websites on the intemet for NMR 's, FPDS website came up with all items dealing with NMR 's for Bnlker Biospin were sole source. The NMR is a very specialized piece of equipment with only one source which is Bruker BioSpin. The only company that can tr·ade and give the govemment credit for the existing NMR is Burker Biospin. 9. Any other facts supporting the use of other than full and open competition. a. Procurement Histoty: (1). 2006-2007 Purchased 600-MHz NMR, Contract# W9 11S6-07-P- 0335 (2). 2003-2004 Purchased 300 MHz NMR. b. Acquisition data availability: N/A c. Unusual and compelling mgency:N/A 10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition: No sources have come forward to fhlflll this requirement except for Bruker Biospin. FBO.gov posting was posted on July 30, 2017. 11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services.: At this time, Bmker is the only commercial supplier that provides the 600-MHz NMR that meets om requirements. 12.
