Page 2 of 4 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: Planning UID:  VA-17-119266 Contracting UID:  VA244-17-AP-7255 Contracting Activity: Department of Veterans Affairs, VISN 04, Pittsburgh VA Medical Center 646-17-3-233-0108. Nature and/or Description of the Action Being Processed: Otolaryngology endoscopes, for the purpose of this procurement, are defined as fiber optic or video endoscopic instruments. The diagnostic/therapeutic system requires both video/image capture equipment along with image acquisitions and storage components beyond that of the endoscope. The peripheral equipment shall be defined as, but not limited to: a camera processor, video monitor, light source, connecting cables, image processor/printer, and water pump, locking, and powered accessory tower/cabinet with grounded power source. The VISERA ELITE platform is the newest video processor and light source for endoscopic procedures across all surgical specialties, including General Surgery, Urology, Otolaryngology, Arthroscopy, and Gynecology. The VISERA ELITE is much more than a camera system. It is the world s only video system that supports HD flexible video scopes and HD camera heads from a single connection. With more than 30 combinations of video scopes and camera heads, it provides unprecedented flexibility, full HD image quality, and surgeon-specific solutions to meet the needs of all surgical departments. VISERA ELITE is comprised of the OTV-S190 video processor and the CLV-S190 Xenon light source. The Olympus ENF-VH video rhino laryngoscope delivers high-definition imaging in a flexible endoscope with a small outside diameter. With exceptional luminosity, a wide 110 ° field of view, and Narrow Band Imaging (NBI) for enhanced observation of blood vessels and mucosal morphology, the ENF-VH sets a new standard in rhino laryngoscopy. Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority) At this time, Alliant Healthcare is the sole Service-Disabled Veteran-Owned Small Business (and only small business) working with/ for Government opportunities. This was verified and confirmed with the Government sales team of Olympus America Inc. on August 4, 2017 in accordance with the Olympus Distribution Policy of February 2017. The Olympus scope is the highest quality scope on the market. It offers a distal tip and narrow band imaging. This particular imaging is of immense importance to Radiation Oncology due to its ability to penetrate deep into the mucosa to view vascular structures. The Olympus scope has a high quality recording ability which satisfies the Radiation Oncology national directive. Furthermore, this particular scope allows our Radiation Oncology department to remain American College of Radiology (ACR) certified with its ability for us to document flex laryngoscopy findings; this aides the Radiation Oncologist in appropriately targeting tumor volume during treatment planning. Furthermore, The Olympus scope was awarded the sole source Blanket Purchase (BPA) with the Department of Veterans Affairs for all video equipment leasing. This is a specific service provider requirement under the authority as stated in FAR 8.405-6 (a)(B), Only one responsible source and no other supplies or services will satisfy the agency s requirements. Also, stated in the same document (VA797T-13-A-0003-019BPA), Market research was conducted by canvassing several vendors in respect to their repair capabilities, reviewing and assessing FSS, and Olympus America Inc. s online published literature, industry information, government databases and customer s satisfaction of contractor s (i.e., Olympus America Inc.) performance. Consistent with our market research findings, it was determined due to the unique nature of Olympus America Inc. s flexible endoscope repairs, and proprietary elements of its maintenance services and repairs; at this time, there is a bona fide need to conduct a liming sources acquisition for the maintenance services and repairs of Olympus America Inc. s flexible endoscopes. The equipment in this requirement is being purchased versus leased, therefore the BPA will not be utilized but to remain consistent with equipment throughout the different VA Healthcare Systems, the Government has determined that the purchase of the desired Olympus equipment is in the best interest of VA patients and the Government. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought was posted to FedBizOpps on 8/7/2017, seeking Service Disabled Veteran Owned Small Businesses and Veteran Owned Small Businesses (SDVOSB and VOSB) capable of providing this equipment. At this time, Alliant Healthcare is the sole Service-Disabled Veteran-Owned Small Business (and only small business) working with/ for government opportunities as an exclusive authorized partner to purchase medical products manufactured by Olympus and distributing to the Government. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer has determined that the anticipated costs are fair and reasonable. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted and only one SDVOSB is capable of providing the Olympus equipment to the Government. In addition, a private party physician review of the Olympus scope versus a comparable scopes, proved favorable for the Olympus. The Olympus provides outstanding high-resolution images because of its 1080i output. Its 3.9 mm diameter allows for an easy and comfortable examination in almost any adult patient. Olympus has decades of endoscope expertise and combined it with OLYMPUS proprietary optics technology. They offer two new solutions: ENF-VH, with high definition (HDTV), and ENF-V3, which maintains high image quality while reducing the distal end outer diameter to a mere 2.6 mm. with these two new products, OLYMPUS offers a new examination environment for rhino-laryngo video scopes. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: L1 Enterprise, a SDVOSB distributor of Karl Storz equipment, responded to the sources sought on FBO that they could provide an equal brand. The Government has determined that an equal brand will not meet the requirement of the VA Medical Center.
