- The U.S. Army Contracting Command-New Jersey, on behalf of PM Soldier Weapons, intends to solicit, negotiate, and award a sole source contract to Saab Dynamics pursuant to the authority of 10 U.S.C. 2304(c)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This contemplated sole source contract will include the procurement of Lightweight 84mm Carl Gustaf rifles in support of the M3E1 Multi-Role Anti-Armor Anti-Personnel Weapon System (MAAWS) program. The contemplated effort will be a Firm Fixed Priced (FFP) contract. The Carl Gustaf rifle is a shoulder-mounted recoilless rifle that fires a family of 84mm anti-personnel, anti-tank, anti-structure, smoke, and illumination rounds. The Lightweight Carl Gustaf rifle is a variant of the Carl Gustaf rifle, to be procured in support of the M3E1 MAAWS program. The Lightweight Carl Gustaf weapon is 28% lighter than the Carl Gustaf rifle previously procured for the M3 MAAWS program. It also features improved ergonomics and an electronic round counter to reduce lifecycle cost. The acquisition of production from sources other than Saab Dynamics will not meet schedule requirements for the MAAWS program. A Headquarters, Department of the Army (HQDA) Directed Requirement was approved on 19 January 2017 for approximately 1,111 MAAWS. MAAWS is a non-developmental item for which the Government does not own data rights. The Government did not choose to purchase technical data rights at the program's inception due to the anticipated cost of the rights on a potentially short lived program supported only by operational needs statements. Saab Dynamics developed, owns, and claims the data rights. The MAAWS cannot be procured competitively utilizing a technical data package. Until a TDP is made available, it is likely that award to any other source would result in unacceptable delays in meeting current requirements as a result of unacceptable lead times from contract award to the delivery of the rifles. Failure to meet these timelines will result in fielding delays and a break in the supply of spare parts negatively impacting ongoing operations and be detrimental to mission readiness and Warfighters safety. Saab Dynamics is the only source able to meet the Government's MAAWS program requirements within the necessary timelines. Please note this notice DOES NOT constitute a Request for Proposal (RFP). A determination by the Government not to compete this proposed contract action based upon the responses to this notice is solely within the discretion of the Government. The anticipated award date for this action is planned for 1QFY18.
