Description The National Cancer Institute (NCI), Center for Cancer Research (CCR) Genomics Core plans to procure Brand Name or Equal Bayer Healthcare BPX30 Disposable Endorectal Coils for 3.0T MRI Scanner. This is a combined synopsis/solicitation notice for commercial items, prepared in accordance with format in FAR 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a separate written solicitation will not be issued. This solicitation includes all applicable provisions and clauses in effect through FAC 2005-94, 2005-95 (January 19, 2017) simplified procedures for commercial items. This will be awarded as a Indefinite Delivery/Indefinite Quantity (IDIQ) contract; firm fixed price. The North American Industry Classification System code is 339112 and the employee size standard is 1,000. It has been determined there are no opportunities to acquire green products or services for this procurement. Only one award will be made as a result of this solicitation. 2.0 BACKGROUND The Molecular Imaging Program (MIP), Center for Cancer Research (CCR), National Cancer Institute (NCI), National Institutes of Health (NIH) is focused on the development of advanced imaging tools to further the detection and treatment of cancer in humans. As part of the lab's clinical effort, the Molecular Imaging Clinic performs MRI studies on various research patients on a 3.0T scanner. A majority of the scans involve a prostate endorectal coil in human patients. The Molecular Imaging Clinic performs MRI studies on various research patients on a 3.0T scanner. A majority of the scans involve a prostate endorectal coil in human patients. Prostate cancer is the most common malignant tumor in men and the second most common cause of cancer death in men. Improving detection and identification of the cancer with MRI is a significant step in improving the techniques of managing the patient. Thus, MIP has the need to procure disposable prostate endorectal coils. The coils are an essential and important part of the lab's research in the Molecular Imaging Clinic. MIP has been using these coils since the clinic opened in 2009. MIP must continue to purchase these coils in order to avoid the introduction of new variables into the experimental results and to avoid long delays resulting from the retesting of other coils from other potential vendors. Changing variables at this time would result in possibly an incorrect interpretation of the research in progress. 3.0 TYPE OF CONTRACT The contract type awarded is Indefinite Delivery/Indefinite Quantity (IDIQ); firm fixed price. 4.0 TYPE OF ORDERS (IDIQ) Task or delivery orders issued under this IDIQ contract shall be firm fixed price. 5.0 MINIMUM AND MAXIMUM QUANTITIES (IDIQ) During the contract period, the Government shall place orders totaling a minimum of $11,967.00. This reflects the contract minimum for the entire period of performance. The contract maximum for the entire period of performance shall be for the placement of orders totaling a maximum of $1,300,000.00. 6.0 SPECIAL ORDER REQUIREMENTS 6.1 PRODUCT FEATURES/SALIENT CHARACTERISTICS The following product features/characteristics are required for this purchase: 6.1.1 Coils must be compatible with existing Philips 3.0T MRI 6.1.2 Coils must be commercially available and FDA-approved 6.1.3 Coils must pass the Philips endorectal imaging quality test on the Philps 3.0T MRI 6.1.4 Contractor shall have in stock a minimum of 5 boxes per month of disposable prostate endorectal coils 6.1.5 Coils must offer a significantly higher signal to noise ratio than surface coils and the sensitivity required for spectroscopy 6.1.6 All offers must include shipping costs, if applicable, otherwise, NCI will not be responsible for its payment 7.0 DELIVERY NIH/NCI 9000 Rockville Pike Bethesda, MD 20011 QUOTATIONS ARE DUE: SEPTEMBER 8, 2017 1:00 PM, EST. 8.0 CONSIDERATION AND PAYMENT INVOICE AND PAYMENT PROVISIONS (FEB 2014) The following clause is applicable to all Purchase Orders, Task or Delivery Orders, and Blanket Purchase Agreement (BPA) Calls: Prompt Payment (Jul 2017) FAR 52.232-25. Highlights of this clause and NIH implementation requirements follow: I Invoice Requirements A. An invoice is the Contractor's bill or written request for payment under the contract for supplies delivered or services performed. A proper invoice is an "Original" which must include the items listed in subdivisions 1 through 12, below, in addition to the requirements of FAR 32.9. If the invoice does not comply with these requirements, the Contractor will be notified of the defect within 7 days after the date the designated billing office received the invoice (3 days for meat, meat food products, or fish, and 5 days for perishable agricultural commodities, dairy products, edible fats or oils) with a statement of the reasons why it is not a proper invoice. (See exceptions under II., below.) Untimely notification will be taken into account in the computation of any interest penalty owed the Contractor. 1. Data Universal Numbering System (DUNS) or DUNS + 4 as registered in the Central Contractor Registration (CCR). 8. Federal Taxpayer Identification Number (TIN). In those exceptional cases where a contractor does not have a DUNS number or TIN, a Vendor Identification Number (VIN) must be referenced on the invoice. The VIN is the number that appears after the contractor's name on the face page of the award document. 9. Identify that payment is to be made using a three-way match. 10. Description of supplies/services that match the description on the award, by line billed. * 11. Freight or delivery charge must be billed as shown on the award. If it is included in the item price do not bill it separately. If identified in the award as a separate line item, it must be billed separately. 12. Quantity, Unit of Measure, Unit Price, Extended Price of supplies delivered or services performed, as applicable, and that match the line items specified in the award. * * NOTE: If your invoice must differ from the line items on the award, please contact the Contracting Officer before submitting the invoice. A modification to the order or contract may be needed before the invoice can be submitted and paid. B. Shipping costs will be reimbursed only if authorized by the Contract/Purchase Order. II. Invoice Payment A. Except as indicated in paragraph B., below, the due date for making invoice payments by the designated payment office shall be the later of the following two events: 1. The 30th day after the designated billing office has received a proper invoice. 2. The 30th day after Government acceptance of supplies delivered or services performed. B. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. Evaluation Evaluation and award shall be conducted in accordance with the requirements of FAR Subpart 12.6 in conjunction with Lowest Price-Technically Acceptable (LPTA). A technically acceptable offer is one in which the Offeror complies with the requirements/technical specifications stated above, and does not take exception, nor object to any of the terms contained in this request. Offers that are not technically acceptable will not be considered further. The technical evaluation will be a determination based on information furnished by the Contractor. The Government is not responsible for locating or securing any information which is not identified in the quotation. The Government reserves the right to make an award without discussions. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may not be requesting revisions to quotations, so Offerors should provide their best solution and price in response to the solicitation. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received. If you are providing an "equal" product, you must submit additional documentation that highlights and describes how your offering is equal, in accordance with FAR 52.211-6. Price Quotation The Offeror shall prepare a price quotation that contains all information necessary to allow for a comprehensive evaluation of the prices quoted. Specifically, your quotation must include the following: - Federal Tax Identification Number (TIN); - Data Universal Numbering System (DUNS) Number; - Business Size (e.g., small or large) The business quotation will be evaluated for reasonableness. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay when consideration is given to prices in the market. Normally, price reasonableness is established through adequate price competition, but may also be determined through cost and price analysis techniques as described in FAR 15.404.
