- Justification for Other Than Full and Open Competition 10 U.S.C. 2304 (c)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Solicitation Number: HSCG44-17-R-170060 Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.303-1- "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" the following facts and rationale support this sole source justification: (1) Agency and Contracting Activity. The Department of Homeland Security (DHS), United States Coast Guard Command, Control, & Communications Engineering Center (C3CEN), Portsmouth, VA proposes to enter into a contract on a sole source basis under the simplified procedures for certain commercial items. (2) Nature and/or description of the action being approved. The USCG has a requirement to procure, on a sole source basis, adaptive maintenance and support services for Coast Guard owned Buffalo Computer Graphics (BCG) simulators. The contract will be awarded to: Buffalo Computer Graphics 4185 Bayview Road Blasdell, NY 14219 (3) Description of Supplies/Services. The proposed acquisition consists of the following Adaptive Maintenance and Support including Information Assurance on twenty-two (22) Coast Guard owned BCG maritime simulators to maintain functionality of the following: • EAIS (STEDS & BFT) interface • NavNetIMO (CG-ECDIS & CG-ECS) software • COMRIC (SeaWatch) interface • Raymarine (SINS2) Interface • AN/SPS-50, AN/SPS-78 and AN/SPS-79 Radar Interface • NMEA-2000, OneNet, IEC 61162-450 and ASTERIX LAN-Based Radar Distribution capabilities (4) Identification of Statutory Authority. This sole source acquisition is being conducted under the simplified procedures for certain commercial items under the authority of 41 U.S.C. 1901 as implemented by the Federal Acquisition Regulation (FAR) FAR 6.302-1- "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." (5) Demonstration that the nature of the acquisition requires use of the authority cited. Adaptive maintenance and support described in paragraph 3 (above) is to be performed on existing Coast Guard owned BCG simulators, running software licensed to the Coast Guard by BCG. BCG's formal license agreement grants Limited Data Rights to the Coast Guard for use of their simulator software. BCG owns and has exclusive access to data necessary for adaptive maintenance and does not license or sell such data making BCG the sole source to perform adaptive maintenance support services. The adaptive maintenance cost, estimated at $290,000.00 is a fraction of the cost to replace all BCG simulators in use throughout the Coast Guard. It is estimated to cost approximately $2.2M and take 2 years to reach fully operational capabilities that the Coast Guard has today if all 22 and associated equipment simulators were replaced and integrated into baselines. This would be in addition to the approximately $1.2M the Coast Guard has invested over the last decade on Coast Guard-specific modifications to BCG software. This is an extremely conservative estimate. Once sunk costs (CG mgmt, contracting, testing, deployment, etc.) are factored, the real cost of having CG specific modifications implemented will be closer to $2M. (6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable. Market research was conducted June 2017 to determine if any other commercial off-the-shelf systems and engineering services could be used to perform the required adaptive maintenance and support on BCG simulators. Due to the proprietary nature of Buffalo Computer Graphic Inc's maritime simulator software and the fact that Buffalo Computer Graphic Inc is the sole owner of data rights to Buffalo Computer Graphic Inc's maritime simulator software running on Coast Guard owned simulators, no other source was identified as having the capability to meet or requirement or could be deemed suitable to perform adaptive maintenance and support of CG owned simulators running licensed copies of Buffalo Computer Graphic Inc's maritime simulator software. Buffalo Computer Graphics has stated they will not unlimited data rights to their software. (7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable. Price reasonableness will determined through comparison of proposed engineering labor rates, analysis of professional engineering services listed in the GSA 871 PES Schedule, and the Independent Government Estimate. (8) Description of market research. Market research was conducted in Jun 2017 to determine if any other commercial off-the-shelf systems and engineering services could be used to perform the required adaptive maintenance and support on BCG simulators. Due to the product specific nature of required simulator adaptive maintenance and support, no other source was identified that could support BCG simulators. A notice of the intent to sole-source was posted on September 11, 2017. (9) Any other facts supporting the use of other than full and open competition. There are no other facts to provide. (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. No other sources have expressed interest in this acquisition. (11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services. As long as no other vendors produces maritime simulators that meet the Coast Guard's specific EAIS and Radar Interface requirements, Buffalo Computer Graphics will be allowed to provide the required adaptive maintenance and support. (12) Contracting Officer's Certification.
