Description
**THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT FOR COMMERCIAL LEGAL SERVICES** The Overseas Private Investment Corporation (OPIC) is the U.S. Government's Development Finance Institution. OPIC's mission is to provide loans, guaranties, political risk insurance, and investment funds to assist American businesses expand into emerging markets. This is a notice issued as required by FAR 5.203. Because this procurement will have a not-to-exceed value of below the Simplified Acquisition Threshold, OPIC intends to award this sole source contract under the authority of FAR 13.501(a)(1). OPIC requires a fund manager to assist OPIC in providing administrative services for the holding companies and the Africa Telecoms Media and Technology Fund, over which OPIC has exercised its rights to remove the fund manager and assume power of attorney. As a result of the exercise of these rights, OPIC is now directing the Mauritius administrator in the day to day operations of two holding companies. In order to perform this work, the administrator must have experience performing international investment fund administration services. In order to properly safeguard OPIC's interests and minimize cost and transition risk to the agency, this administrator must be able to commence work immediately following contract award. In order to do this, the administrator must be already familiar with the transactional parties, documents, and issues related to the Africa Telecoms Media and Technology Fund. OPIC is only aware of one firm that has these capabilities. The North American Industry Classification System (NAICS) code for this requirement is 541611 with the size standard of $15 million. This notice of intent is not a request for proposals or quotes; however, all responsible and capable sources may submit statements of capabilities, which, if received within seven calendar days of publication of this notice, shall be considered by OPIC. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
