- Performance Work Statement Performance Work Statement for servicing of Montana Army National Guard First Aid Kits 1. DESCRIPTION OF REQUIREMENT: The Montana Army National Guard requests the servicing of all their first aid kits semi annually for all shops and annually for all other first aid kits. The contractor shall provide all, labor, personnel, tools, supervision, and items necessary to inspect, and restock kits as defined in this Performance Work Statement (PWS).This requirement must meet Occupational Safety & Health Administration (OSHA) standards when having kits filled. The proposal will include delivery of the items to each physical location and all costs associated with delivering and stock replenishment. This contract will have one base year with four option years. Yearly quality assurance assessments will be preformed by the Contract Officer Represntitve (COR). 2. SOLICITATION AND BUSINESS REQUIREMENTS 2.1 Services to be Perfomed a. Services shall be performed at the locations listed in 2.1 4. These services include performance of the following tasks in accordance with the specific OSHA standards. b. The contractor must set up a regular schedule with each of the facility managers (POC) for regular maintenance within 30 calendar days of contract award. c. Contractor must contact POC a minimum of 7 working days before arriving on site for regular service to make sure someone will be at the facility on the actual schedule service day. Regular maintenance will not be schedule on the Federal Holidays listed in paragraph 3.1 of this PWS. All work shall be performed between the hours of 0800 hours to 1630 hours, Monday through Friday, excluding recognized federal holidays d. Work Schedule: The contractor shall submit its planned work schedule to the COR within 14 calendar days upon award of contract. This schedule must specify the day of the week that the services are to be performed. The schedule is subject to approval by the COR. Changes to the work schedule will be coordinated with and approved by the facility POC. The contractor is advised that events such as exercises, state active duty, or other activities may require the contractor to change its schedule. Although the government will make reasonable efforts to provide advance notice, in some circumstances, adequate notice may not occur. Such schedule changes shall not be grounds for a claim against the government. e. EMERGENCY OUT OF CYCLE SERVICE CALLS: Contractor must respond to emergency service calls within 4 business days of the call. f. Only new products are used to fill kits. Used or gray market items are not authorized g. The contractor shall provide the government with a primary and an alternate point of contact to receive service requests and make arrangements for them to receive this requirement via telephone and email. 2.2 Federal Holidays: The contractor is not required to provide service on federal holidays: a. New Year's Day - 1 January b. Martin Luther King Day - 3rd Monday in January c. Washington's Birthday - 3rd Monday in February d. Memorial Day - last Monday in May e. Independence Day - 4 July f. Labor Day - 1st Monday in September g. Columbus Day - 2nd Monday in October h. Veteran's Day - 11 November i. Thanksgiving Day - 4th Thursday in November j. Christmas Day - 25 December 2.3 If these holidays fall on Saturday, the preceding Friday shall be observed. If these holidays fall on Sunday, the following Monday shall be observed. If a holiday falls on a scheduled service day, the contractor shall be responsible for rescheduling services for the first day post holiday observance, per arrangement with the COR. 2.4 Contractor Sign-In. When performing work at any of the locations, the contractor must report to the facility POC and sign in. This is to ensure the POC and COR is aware of the contractor's presence and to provide documentation of work being performed. Below are the addresses for each facility location: Armory's a. FMS#6 - 5043 Neibauer Road, Billings, MT 59106 The list of POC's for the above locations will be provided upon award of the contract. 2.5 Security Requirements for Unclassified Contracts and access to post. 2.6 The contractor shall comply with all Federal and State security and base access requirements. Contractor personnel shall be required to display identification badges. Anticipate delays in getting commercial vehicles on base and allow time for commercial vehicles to reach their destination by driving designated routes at posted speed limits throughout the base. Procedures for commercial vehicle access to the base are subject to change without prior notice. 2.7 Traffic Laws. The contractor shall comply with the installation traffic code as specified in Montana State Law and Ft Harrison command policies. 2.8 Weapons, Firearms, and Ammunition. Contractor personnel are prohibited from possessing weapons, firearms, or ammunition, on themselves or within their contractor-owned vehicle or privately-owned vehicle while on any Government Facility. 2.9 Physical Security. The contractor shall safeguard all government property, including controlled forms provided for contractor use. At the close of each work period, government equipment, facilities, assets and materials shall be secured. 2.10 Smoking in Government Facilities. Smoking is prohibited in all Federal and State facilities. Contractor personnel and visitors are subject to the same restrictions as government personnel. Smoking is permitted only in designated smoking areas. 2.11 Contractor Identification Badge. Contractor personnel shall display a contractor badge at all times and in plain view. 2.12 Contractor Furnished Items and Services. The contractor shall furnish everything required to perform this contract in accordance with (IAW) all of its terms. It is the contractor's responsibility to ensure their contractor personnel are familiar with and understand the contents of this PWS. 2.13 Appearance. Contractor personnel shall present a professional, conservative, and neat appearance. Contractor personnel shall report for duty in a professional manner, in appropriate attire and having complied with socially acceptable standards of personal hygiene. 2.14 Communication: Contractor personnel shall maintain open and professional communication with all military members and DOD civilians. Complaints will be reported in writing to the (Contract Officer) KO and the contractor for action. Failure of the contractor to correct validated complaints by the POC or COR will be considered a failure to perform. 2.15 Conflict of Interest. The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest. The contractor shall not employ any person who is an employee of the Montana Army or Air National Guard, either military or civilian, unless such person seeks and receives approval in accordance with (IAW) Department of Defense (DoD or DD) Directive 5500.7. If prior military, must have been discharged under honorable conditions with no administrative discharge actions taken against them. 3. Submitting a Quote a. Quote shall be submitted in the following clin structure. 0001. Kits filled annually 0002. Kits filled semi-annually 0003. Emergency out of cycle fills 0004. Contract Manpower Reporting 0005. Travels. This amount must comply with the Joint Federal Travel Regulations (JFTR) and the GSA scale for Helena, Montana. b. Service Requirements: 01. All shops (CSMS, UTES, FMS's, AASF) will have their kits serviced semi annually to ensure they meet OSHA standards. 02. All other kits will be serviced annually. 03. If a unit or shop need serviced an additional time during the year, the vender will work with the shop or unit to get the proper items to them within 4 business days. Vendor may choose to deliver or ship items. 3.1 Basis for Award and Contract Type a. The Government will award Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government. The following factors shall be used to evaluate offers: Price and technical acceptability. If quotes from offerors are found to be within the specifications, price will be the determining factor. Prior to Contract award the business must be registered and active in System for Award Management (SAM). Registration is free and assistance can be provided by the Montana PTAC. http://www.montanaptac.org/. If registration is not in progress or sufficient progress is not made in a timely manner the business will be deemed technically not acceptable for contract award. b. Contractor shall have completed SAM registration no later than five days after receipt of the quote or the contractor shall be deemed non-responsive. 3.4 Invoicing and Payment a. Invoicing must be done through Wide Area Work Flow at https://wawf.eb.mil/index.xhtml b. Payment must be electronic transfer of funds via Defense Finance and Accounting Service (DFAS). If your System for Award Management (SAM) account has other than electronic funds selected, your payment may be severely delayed. 3.5 Provisions and Cluses a. Complete descriptions of the provisions and clauses referenced in this synopsis/solicitation may be viewed on the internet at http://farsite.hill.af.mil/ b. Contractor shall conform to 52.222-55 Minimum Wages Under Executive Order 13658. c. See Apendix 1 for a list of all provisions and cluases 4. SERVICES SUMMARY (SS). The contract service requirements are summarized in performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The SS and the contractor's Quality Control Plan (QCP) provide information on contract requirements, the expected level of the contractor's performance and the expected method of government surveillance and confirmation of services provided. These thresholds are critical to mission success. Procedures as set forth in the Federal Acquisition Regulation (FAR) 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies. The absence of any contract requirements from the SS shall not detract from its enforceability nor limit the rights or remedies of the government under any other provision of the contract, including the clauses entitled "Inspection of Services" and "Default." The government has the right to inspect all services required in the contract Objective: (a) Provide annual and bi-annual refills of First Aid kits owned by the Montana Army National Guard. Performance Evaluation. The purpose of the Services Summary is to define performance evaluation. The Performance Objective (column 1) describes what the government will survey. Performance of a service will be evaluated to determine whether or not it meets the Performance Threshold (PT) of the contract. When the PT is exceeded, the COR will document the file with a Corrective Action Report (CAR) or a Performance Assessment Report (PAR) and forward these documents to the Contracting Officer for his determination if further action is necessary. 4.1.1. The government will conduct surveillance of contractor quality through the use of a Quality Assurance Surveillance Plan (QASP). Quality Assurance Plan: The onsite Government POC will monitor Contractor performance and complete the Quality Assurance Worksheet provided, semi annually, at a minimum. The Quality Assurance Worksheet will be submitted directly to the Contracting Officer with a copy to the Contractor and the COR following the first month of performance, not later than the 7 business days following the service. All quality performance ratings other than "Green" will be addressed and circumstances surrounding the rating will be documented for the contract file. The Contacting Officer will assume a quality performance rating of "Green" on all measured deliverables unless otherwise notified. The quality rating may change from "Green" to "Red" without notice. We anticipate the Government POC utilizing the "Yellow" quality rating to alert the contracting office and the COR of quality issues that have the potential for a "Red" quality rating if corrective action is not taken. The Government POC may submit a Quality Assurance Worksheet at any time and as often as necessary to document quality levels. If Contractor response to an identified quality deficiency is unsatisfactory, the Contracting Officer or COR will contact the appropriate Contractor representative to implement a plan of action to remedy the identified deficiency. COR must be formally trained which requires 2 courses (proof of training certificates are required). New certificates required every 2 years. The COR referred to in this QAP is SSG April Bretz Rating Description Green Yes, performance and technical specifications are being met at AQL. Yellow Yes, performance and technical specifications are currently being met at the minimum AQL, but the following service / deliverable needs contractor attention. The Customer must identify what component of the deliverable and/or service requires attention. Red No, performance and technical specifications are not being met at AQL and the following service / deliverable needs immediate contractor resolution. The Customer must identify what component of the deliverable and/or service is below the minimum AQL. 4.1.2. If any of the services do not conform to contract requirements, the government may require the contractor to perform the services again in conformity with contract requirements at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the government may: 4.1.2.1. Require the contractor to take necessary action to ensure that future performance conforms to contract requirements; 4.1.3. Government Remedies. The government may exercise its rights under FAR 52.212-4, Contract Terms and Conditions -- Commercial Items (July 2013), for contractor's failure to correct nonconforming services. 4.4. Quality Assurance. The government shall inspect and evaluate the contractor's performance to ensure services are received IAW requirements set forth in this contract. The COR or POC shall inspect by watching actual task performance, physically checking an attribute of the completed task, checking a management information report, investigating customer complaints, or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained in this PWS. Only one (1) method will be used at a time to evaluate a listed service during an inspection period for payment computation purposes. The COR will record surveillance results. Results of the surveillance then become the official Montana Army National Guard record of the contractor's performance. When a performance threshold has not been met or contractor performance has not been accomplished, the COR will initiate and provide the contractor with a Contract Discrepancy Report (CDR). The contractor shall respond to the report IAW instructions provided and return it to the COR within the suspense date on the form or ten (10) calendar days of receipt. 4.4.1. Failing to meet the performance threshold as outlined in the SS for any of these performance objectives in any one (1) month period shall result in an immediate progress meeting with the KO and other government personnel. 4.4.2. Failing to meet the performance threshold as outlined in the SS of these performance objectives in any combination for any two (2), or more consecutive or non-consecutive months during a contract period shall result in a warning or letter of concern from the KO. 4.4.3. All remedies shall be in accordance with the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance. 4.5. Surveillance Methods. 4.5.1. 100 Percent Inspection. This method requires the COR to inspect the service each time it occurs. The COR will use the Quality Assurance Surveillance Checklist (QASC) during inspection. The COR's inspection will be on items identified in the Services Summary as 100% Inspection as the Method of Surveillance and the results of the inspection will be documented on the checklist. Any deficiency shall be documented and the contractor shall re-perform service immediately, if appropriate, or within the criteria described in the SS at no increase in contract amount. Any unsatisfactory inspection identified but re-performed acceptably shall still be counted as an unsatisfactory inspection for trending purposes. 4.5.2. Periodic Surveillances. This method requires the COR to employ a "spot check" style of evaluation based on the contractor's schedule. Periodic surveillances will be conducted annually and may be adjusted, based on quality trends. Any unsatisfactory inspection (defect) result shall be recorded, and the contractor shall re-perform the service within the time frame listed in the Service Summary contained in this PWS, after notification by the COR. 4.5.3. Customer Complaint. This method requires the customer to fill out a Customer Compliant Record (CCR) or a locally generated form provided by the COR or KO. The COR will validate the complaint and notify the contractor of valid complaint(s). The contractor shall acknowledge the complaint within two (2) working days and inform the COR of its recommendation. Any deficiency shall be documented and the contractor shall re-perform service immediately, if appropriate, or within the time frame listed in the Service Summary contained in this PWS at no increase in contract amount. The contractor shall respond to the Customer Complaint in accordance with the instructions provided and return it to the COR within five (5) calendar days of receipt. Any unsatisfactory inspection identified but re-performed acceptably shall still be counted as an unsatisfactory inspection. 4.6. Performance Evaluation/Periodic Progress Meetings. The KO, Contract Administrator, COR, other government personnel as appropriate, and the contractor may requite periotic meetings to discuss the contractor's performance. The contractor may request a meeting with the KO when deemed necessary. Meetings will be documented in the contract file with written minutes signed by the KO, the contractor and any other signatures as deemed appropriate. The signed minutes will be distributed to the functional area and the contractor. 4.6.1. The following issues shall be discussed: opportunities to improve the contract; any modifications required of the contract; unsatisfactory inspections and trends against each performance objective; observed positive performance; and steps taken by the contractor to prevent unsatisfactory occurrences in the future. The contractor shall provide a summation of unsatisfactory inspections and customer complaints and provide insight into any identified trends. 4.6.2. Should the contractor not concur with the minutes, the contractor shall provide a written response to the KO within ten (10) calendar days of receipt of the minutes identifying areas of non-concurrence for resolution. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision. (a) Definitions. As used in this provision-- "Administrative merits determination" means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance. "Arbitral award or decision" means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. To determine whether a particular award or decision is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance. "Civil judgment" means-- (1) In paragraph (h) of this provision: A judgment or finding of a civil offense by any court of competent jurisdiction. (2) In paragraph (s) of this provision: Any judgment or order entered by any Federal or State court in which the court determined that a labor law violation occurred, or enjoined or restrained a violation of labor law. It includes a judgment or order that is not final or is subject to appeal. To determine whether a particular judgment or order is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance. "DOL Guidance" means the Department of Labor (DOL) Guidance entitled: ``Guidance for Executive Order 13673, `Fair Pay and Safe Workplaces' ''. The DOL Guidance, dated August 25, 2016, can be obtained from www.dol.gov/fairpayandsafeworkplaces. "Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program. "Enforcement agency" means any agency granted authority to enforce the Federal labor laws. It includes the enforcement components of DOL (Wage and Hour Division, Office of Federal Contract Compliance Programs, and Occupational Safety and Health Administration), the Equal Employment Opportunity Commission, the occupational Safety and Health Review Commission, and the National Labor Relations Board. "Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner. "Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees. "Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except- (1) PSC 5510, Lumber and Related Basic Wood Materials; (2) Product or Service Group (PSG) 87, Agricultural Supplies; (3) PSG 88, Live Animals; (4) PSG 89, Subsistence; (5) PSC 9410, Crude Grades of Plant Materials; (6) PSC 9430, Miscellaneous Crude Animal Products, Inedible; (7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products; (8) PSC 9610, Ores; (9) PSC 9620, Minerals, Natural and Synthetic; and (10) PSC 9630, Additive Metal Materials. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General). (End of provision) 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS-COMMERCIAL ITEMS (DEVIATION 2013-O0019) (JAN 2017) (a) Comptroller General Examination of Record. As used in this clause- Automatic identification device means a device, such as a reader or interrogator, used to retrieve data encoded on machine-readable media. Data qualifier means a specified character (or string of characters) that immediately precedes a data field that defines the general category or intended use of the data that follows. Issuing agency code means a code that designates the registration (or controlling) authority for the enterprise identifier. Item means a single hardware article or a single unit formed by a grouping of subassemblies, components, or constituent parts. Lot or batch number means an identifying number assigned by the enterprise to a designated group of items, usually referred to as either a lot or a batch, all of which were manufactured under identical conditions. Machine-readable means an automatic identification technology media, such as bar codes, contact memory buttons, radio frequency identification, or optical memory cards. Original part number means a combination of numbers or letters assigned by the enterprise at item creation to a class of items with the same form, fit, function, and interface. Parent item means the item assembly, intermediate component, or subassembly that has an embedded item with a unique item identifier or DoD recognized unique identification equivalent. Serial number within the enterprise identifier means a combination of numbers, letters, or symbols assigned by the enterprise to an item that provides for the differentiation of that item from any other like and unlike item and is never used again within the enterprise. Serial number within the part, lot, or batch number means a combination of numbers or letters assigned by the enterprise to an item that provides for the differentiation of that item from any other like item within a part, lot, or batch number assignment. Serialization within the enterprise identifier means each item produced is assigned a serial number that is unique among all the tangible items produced by the enterprise and is never used again. The enterprise is responsible for ensuring unique serialization within the enterprise identifier. Serialization within the part, lot, or batch number means each item of a particular part, lot, or batch number is assigned a unique serial number within that part, lot, or batch number assignment. The enterprise is responsible for ensuring unique serialization within the part, lot, or batch number within the enterprise identifier. Type designation means a combination of letters and numerals assigned by the Government to a major end item, assembly or subassembly, as appropriate, to provide a convenient means of differentiating between items having the same basic name and to indicate modifications and changes thereto. Unique item identifier means a set of data elements marked on items that is globally unique and unambiguous. The term includes a concatenated unique item identifier or a DoD recognized unique identification equivalent. Unique item identifier type means a designator to indicate which method of uniquely identifying a part has been used. (3) The unique item identifier component data elements shall be marked on an item using two dimensional data matrix symbology that complies with ISO/IEC International Standard 16022, Information technology--International symbology specification--Data matrix; ECC200 data matrix specification. (4) Data syntax and semantics of unique item identifiers. The Contractor shall ensure that-- (i) The data elements (except issuing agency code) of the unique item identifier are encoded within the data matrix symbol that is marked on the item using one of the following three types of data qualifiers, as determined by the Contractor: (A) Application Identifiers (AIs) (Format Indicator 05 of ISO/IEC International Standard 15434), in accordance with ISO/IEC International Standard 15418, Information Technology--EAN/UCC Application Identifiers and Fact Data Identifiers and Maintenance and ANSI MH 10.8.2 Data Identifier and Application Identifier Standard. (B) Data Identifiers (DIs) (Format Indicator 06 of ISO/IEC International Standard 15434), in accordance with ISO/IEC International Standard 15418, Information Technology--EAN/UCC Application Identifiers and Fact Data Identifiers and Maintenance and ANSI MH 10.8.2 Data Identifier and Application Identifier Standard. The contractor shall use an automatic identification technology device for this verification that has been programmed to the requirements of Appendix A, MIL-STD-130, latest version. (ii) The issuing agency code-- (A) Shall not be placed on the item; and (B) Shall be derived from the data qualifier for the enterprise identifier. (d) For each item that requires item unique identification under paragraph (c)(1)(i), (ii), or (iv) of this clause or when item unique identification is provided under paragraph (c)(1)(v), in addition to the information provided as part of the Material Inspection and Receiving Report specified elsewhere in this contract, the Contractor shall report at the time of delivery, as part of the Material Inspection and Receiving Report, the following information: (1) Unique item identifier.
