- OFOC SOP Revision 03 Page 1 of 1 Revision 03 Date: 10/27/2014 JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. PURCHASE REQUEST OR REQUISITION NUMBER: 636-17-1-2301-0061 1A. PROJECT/TASK NUMBER 1B. ESTIMATED AMOUNT: $49,977.92 2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The contractor will furnish all labor, transportation, parts, test equipment, tools, and expertise necessary to maintain the 2 BioFire FilmArray model number FLM2-ASY-0001, serial numbers 2FA00732 and 2FA00734 located at the Omaha VA Medical Center. The vendor shall provide the following coverages on the system. Corrective Maintenance: provide diagnostics, labor, and repair of the system should the product fail to function within BioFire (the manufacturer of the system) published specifications. The vendor shall provide, at no cost to the government, all replacement parts necessary to return the covered unit to good working order. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: BioFire Diagnostics is the only one responsible source available due to proprietary software keys and proprietary OEM parts for the BioFire FilmArray model number FLM2-ASY-0001. Additionally, only BioFire has certified manufacturer trained personnel to provide the required services for the equipment. There is no other contractor available that can provide the supplies and services as it requires only factory trained and certified technicians from the original manufacturer to perform maintenance on equipment. 4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: Any other company would not have access to the software keys for this equipment, as they are proprietary. Additionally, they will not sell Original Equipment Manufacturer parts to a third party service company. We cannot allow reverse engineered or refurbished parts to be used in medical equipment. Third party service providers would also not be able to obtain certification of training from the manufacturer, as it is not available. Only certified manufacturer trained personnel are allowed to work on this equipment. 5. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: I searched GSA and the open market to find no one offering service contacts and only found BioFire. I reached out to BioFire and they stated that software troubleshooting keys and OEM parts are proprietary to BioFire and not available to third party organizations. He also stated that training courses are not available to 3rd party service organizations.
