Description
J & A SSGC-17-0001.1 JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION JUSTIFICATION 1. Contracting Activity Supervisor of Shipbuilding, Conversion and Repair, USN, Gulf Coast, Pascagoula, Mississippi (SUPSHIPGC), Contracts Department (Code 400). 2. Description of the Action Being Approved The proposed solicitation and subsequent contract award will provide the installation of unclassified Navy Marine Corps Intranet (NMCI) infrastructure (passive equipment) in four administrative buildings and throughout the shipyard to support SUPSHIPGC's conversion from the current legacy network to the NMCI network at Huntington Ingalls Industries-Pascagoula Shipyard (Ingalls) without providing full and open competition. 3. Description of Supplies/Services The Government intends to solicit with Ingalls to provide spaces in accordance with the statement of work and install unclassified NMCI infrastructure to Administrative Building 1 and 4, Krebs Building, COSAL Warehouse, Multipurpose Warehouse, and Government trailers located within the shipyard on Ingalls property in support of SUPSHIPGC's conversion to NMCI. The requirements will include: providing access and escort to vendors, providing space in accordance with the requirements, installing passive hardware for access switches, and ensuring that the HVAC/Cooling (Environmental) are consistent with modem IT standard requirements for all NMCI networks. The Government has added additional scope to the requirement as a result of Bidder's Questions from Ingalls. The Government currently has an obsolete phone system; the additional scope to include an NMCI compatible network is necessary to ensure a seamless transition. This additional scope was added by solicitation amendment N6931617R0001-0002 DATED 23 August 2017. The estimated dollar value for this requirement is increased from O&MN $350,000 in FYl7 to O&MN $850,000 in FY17. The Government's minimum needs have been verified by the certifying technical and requirements personnel. 4. Statutory Authority Permitting Other Than Full and Open Competition The statutory authority permitting other than full and open competition is contained in 10 U.S.C. 2304 (c)(l) as implemented in FAR 6.302-1, "Only one or a limited number of responsible sources and no other type of supplies or services will satisfy agency requirements," (48 C.F.R 6-302-1). 5. Rationale Justifying Use of Cited Statutory Authority SUPSHIPGC is located in and operates from non-government spaces owned by Ingalls, a private company. Because of this, Ingalls is the only source capable of installing the unclassified NMCI infrastructure on its property. The installation of the unclassified NMCI infrastructure is a modification to real property owned by Ingalls. As a result, it must meet Ingalls specifications. To ensure that it meets their specifications, Ingalls must perform the installation. Ingalls will install the unclassified NMCI infrastructure requirements to facilitate SUPSHIPGC transition to NMCI. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable The proposed sole source solicitation was synopsized on the Federal Business Opportunities website on 19 June 2017 as required and in accordance with FAR 5.2. Additionally any company requesting a solicitation copy will be provided one. 7. Determination of Fair and Reasonable Costs Thorough price analysis will be conducted using available information and approved pricing techniques that may include: informal cost data, similar item data and/or market research to determine a fair and reasonable price. The Contracting Officer will determine that the cost to the Government for the supplies covered by this J&A will be fair and reasonable. 8. Actions to Remove Barriers to Competition If the competitive environment changes in the future, this will be addressed as needed for subsequent procurements. However, it is not anticipated that SUPSHIPGC will have similar requirements in the future, as the conversion to NMCI is a one-time Department of the Navy requirement.
