- The attached document provides the applicable federal provisions and clauses that are identified under 52.212-5. (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) Solicitation number 17-245-SOL-00018 applies and is issued as a Request for Quote (RFQ). (iii) This solicitation document and incorporated provisions and clauses are those in effect thorugh the Federal Acquisition System Circular No. 2005-95. (iv) No set asides. (v) See attached CLINS listing that provides the description, salient characteristics and part numbers. All proposed equipment must meet the salient characteristics identified on the attached CLINS listing. This is a brand name of equal requirement. (vi) See attached CLINS listing for descriptions and related salient characteristics. (vii) Delivery and acceptance terms for this order FOB Destination. Delvieries will be made to Gallup Indian Medical Center in Gallup, NM 87301, 30 days After Award. (viii) The provision at 52.212-1, Instructions to Offerors - Commercial Items (Jan 2017) shall apply. (ix) 52.212-2 Evaluation - The award will be made to the lowest price technically acceptable offeror. To be considered for award, the offeror shall provide evidence that their proposed product meets all listed salient characteristic identified. Only new equipment shall be quoted, no grey marketed or refurbished equipment should be quoted; all proposed equipment must meet the salient characteristics identied on the attached CLIN document. The total price derived by with the quantities all items listed in the attached CLINS listing will be used to determine the lowest price offeror. (x) Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items with its offer. (xi) FAR 52.212-4 Contract Terms and Conditions - Commercial Items (Jan 2017) shall apply. (xii) FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (Jan 2017) - See attached document titled "52.212-5 Applicable Required Regulations" (xiii) (a) 52.252-1 Soicitation Provisions Incorporated by Reference (Feb 1998) & 52.252.2 - Clauses Incorporated by Reference (Feb 1998) applies to the RFQ. This solicitation incorporates solicitation provisions and clauses by reference, wht the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. Also, the full text of a solicitation provision may be accessed electronically at this address: www.acquisition.gov/far/. (b) The following HHSAR Clauses are incorporated to this RFQ: (1) 352.215-70 Late Proposals and Revisions (Dec 2015) (2) 352.223-71 Instructions to Offerors - Sustainable Acquisition (Dec 2015) (xiv) Not Applicable.
