Final J&A - redacted JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION In Accordance with 10 U.S.C. 2304(c)(1) Vendor: Okinawa Medix K.K. 1. The Defense Logistics Agency (DLA) Troop Support Pacific is the Contracting Activity. 2. The action being approved is the ability to solicit for DLA Troop Support Pacific requirements on an Other Than Full and Open Competition basis. 3. DLA Troop Support Pacific has a requirement for the procurement and delivery of a Microbiology Analyzer for the United States Naval Hospital (USNH), located in Okinawa, Japan. Supply Requirements. •a) The USNH-Okinawa requires a Microbiology Analyzer capable of delivering fast, accurate microbial identification, and antibiotic susceptibility testing capabilities to their laboratory department. The microbial identification system shall include an expanded identification database and an automated platform that provides rapid and reliable testing results. •b) The USNH-Okinawa requires a Microbiology Analyzer capable of providing microbial identification for both bacteria and yeast with antibiotic susceptibility testing and resistance detection. The testing capabilities and results acquired shall provide a definitive diagnosis and a reliable treatment plan that the USNH-Okinawa can rely upon in their patient care. •c) The USNH-Okinawa requires a Microbiology Analyzer capable of determining specific phenotypes, as applicable for diagnostic treatment, and capable of determining specific types of bacterial resistance to assist with diagnosis of Methicillin Resistant Staph Aureus (MRSA) and Vancomycin Intermediate Staphylococcus (VISA) organisms. •d) The Microbiology Analyzer shall use the same testing cards and data management software and Advanced Expert System TM (AES) as the existing Government equipment, so as to not interrupt the level of patient care demand at the USNH-Okinawa. •e) The Microbiology Analyzer shall be compatible with the current consumables being procured by the USNH-Okinawa. •f) The Microbiology Analyzer shall come with on-call support, an on-island technician for warrantied repairs, and ensure the longest availability of long dated consumables, which is critical to the geographic location of the hospital. Untimely delivery of supplies, long lead times and shipping delays from outside of Okinawa have presented issues in the past and jeopardized the USNH Mission and patient care. •g) The Microbiology Analyzer shall be compatible with the current Pharmacy formulary. •h) The procurement of the Microbiology Analyzer shall come with a one (1) year manufacturer warranty and cover all manufacturer recommended preventative maintenance and/or software updates during the warranty period. 3.1 The USNH-Okinawa currently owns one (1) VITEK 2 Microbiology Analyzer, which is government-owned equipment and relied upon under current Contract Number SPE8EQ-17-D-0001. Contract Number SPE8EQ-17-D-0001 provides for the procurement and delivery of SYSMEX Reagents and Microbiology Media Plates consumable medical supplies. The existing VITEK 2 Microbiology Analyzer is in failing condition and in need of immediate replacement, as it has well exceeded its shelf life expectancy. In order for the USNH-Okinawa to continue ordering the required consumables under the stated contract, the hospital must have operational and compatible equipment. 3.2 The VITEK 2 Microbiology Analyzer allows the USNH-Okinawa to identify infections in patients and provide treatment options to providers for patient safety. The VITEK 2 Microbiology Analyzer is the only supported Analyzer with on-call support, an on-island technician for warrantied repairs, and ensures the longest availability of long dated Reagents, which is critical to the geographic location of the hospital. Changing equipment requires the changing of supplies required to meet the USNH-Okinawa Mission. Any other equipment would involve extensive validation and changing the pharmacy supply for antibiotics thus changing how the command treats infections across all departments and branch clinics of the USNH. If the Government ceased ordering these required consumables, the USNH-Okinawa would be unable to provide medical care and/or treat patients for bacterial infections. The USNH-Okinawa does not have the additional manpower or resources to change all current standard operating procedures, protocols and Navy Hospital (NAVHOSP) instructions, which would all have to be rewritten in order to accommodate a change in medical equipment. Newly trained personnel would be required in order to implement relative and associated training for laboratory staff prior to use. All existing USNH-Okinawa medical practicing staff on Okinawa would have to change how they provide patient care. Pharmacy formulary would require revision, which would inevitably lead to delays in patient care and increase the risk of misdiagnosis. 3.3 The VITEK 2 Microbiology Analyzer's inherent software and equipment is capable of assisting with epidemiological trending and reporting with rapid identification of organisms susceptibility, which is required by the USNH-Okinawa in order to provide patients treatment options. The VITEK 2 Microbiology Analyzer is capable of determining specific phenotypes, as applicable for diagnostic treatment and is able to determine specific types of bacterial resistance to assist with diagnosis of Methicillin Resistant Staph Aureus (MRSA) and Vancomycin Intermediate Staphylococcus (VISA) organisms. 3.4 The USNH-Okinawa estimates it would take approximately six (6) to 12 months to procure and implement another model of Microbiological Analyzer if the VITEK 2 Microbiology Analyzer is not approved for replacement. The USNH-Okinawa would incur increased costs for the procurement of Reagents, which would require a different validation, correlation and installation process if another Analyzer were procured. Additionally, the USNH-Okinawa would spend time, resources and additional manpower expenses to retrain employees. The USNH-Okinawa has already reported a shortage of staff and limited personnel capable of administering the training or migration to a new system-thus limiting all USNH-Okinawa bacteriology studies and testing capabilities. The USNH-Okinawa does not have an additional 12 months to replace the existing government-owned property, which is currently relied upon by the laboratory in the USNH-Okinawa. 3.5 The estimated value of this procurement falls below the Simplified Acquisition Threshold. The USNH customer has estimated the total value of the acquisition at $89,389.24. The estimate was based upon the USNH customer's market research efforts to identify local sources, wherein the suggested sole source was identified. 4. The applicable statutory authority permitting other than full and open competition is established in 10 United States Code (U.S.C.) Section 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the cited authority follow: The use of this authority is necessary due to Okinawa Medix K.K. being the only certified and authorized dealer/distributor in Okinawa capable of supplying the required medical supply equipment. Okinawa Medix K.K. is the only known responsible source and no other supplies or services will satisfy Agency requirements. Therefore, the circumstances permitting other than full and open competition, described in FAR 6.302-1, authorize contracting without providing for full and open competition given the requirements for justifications support the use of this authority. Therefore, Okinawa Medix K.K. DBA is the only supplier capable of meeting the medical supply needs of the USNH, located in Okinawa, Japan. 6. To determine capabilities of local vendors, DLA Troop Support Pacific published a Sources Sought Notice (DLATSP-17-SS-0010) to the Federal Business Opportunities (FBO) website on July 25, 2017. The same notice was emailed to the locally identified vendors on July 26, 2017. Only one (1) response was received from Vendor, Okinawa Medix K.K. 6.1 This office does not intend to synopsize this requirement based on the exception provided at FAR 5.202 (a)(12), as the proposed contract action is by a Defense agency and the proposed contract action will be made and performed outside the United States and its outlying areas, and only local sources will be solicited However, this justification will be made available for public inspection, after award, in accordance with FAR 6.305 (a). 7. As the Contracting Officer, I hereby determine that t he anticipated price will be fair and reasonable, based on a n evaluation of local prices previously paid for similar contract actions. Any negotiations that may become necessary will be held in order to obtain a fair and reasonable price. Additionally, the price will be compared to the published prices found in the local Okinawa community and the Original Equipment Manufacturer. 8. Market Research efforts in the SAM Database was conducted in an effort to identify local vendors. Approximately 26 vendors were identified from mainland Japan and Okinawa using under North American Industry Classification System (NAICS) Code 423450; Medical, Dental, and Hospital Equipment and Supplies Merchant Wholesalers (see Attached SAM Results). Full Market Research Report is attached. 9. There are no additional facts supporting the use of this authority. 10. Sources expressing an interest in the acquisition include: Okinawa Medix K.K. No other sources expressed interest in this acquisition. 11. DLA Troop Support Pacific will continue to publicize Sources Sought Notices and Acquisition Agency Announcements with the intent of locating additional sources. 12.
