Page 2 of 2 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA248-17-AP-2983 Contracting Activity: Department of Veterans Affairs, NCO-8/SAO-East Veterans Affairs Medical Center, Station 36C548, West Palm Beach, Florida. Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the purchase of a new 5-year contract for maintenance and repair services to five (5) Getinge sterilizers/washers/disinfectors at the West Palm Beach VA Medical Center in West Palm Beach, Florida. The principal NAICS Code for this action is 811219 Other Electronic and Precision Equipment Repair and Maintenance --with a size standard of $20.5M. The Product/Service Code is J065 Maint/Repair/Rebuild of Equipment Medical, Dental, and Veterinary Equipment and Supplies. Description of Supplies/Services Required to Meet the A gency s Needs : The contractor will supply one (1) Preventive Maintenance (PM) Major Labor/PM and four (4) quarterly Preventive Maintenance Inspections ( Minor) as well as all parts and labor for any/all unscheduled corrective maintenance on the equipment identified in the Statement of Work. The contractor will return the equipment to full factory specifications after PM or unscheduled corrective maintenance. The total estimated price for the 5-year contract is $160,902.00. Statutory Authority Permitting Other than Full and Open Competition: ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contr ac tor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): In accordance with FAR 6.302-1, Getinge is the only vendor that is capable of repairing and maintaining the VA-owned Getinge equipment described in the statement of work since the system software in the equipment is proprietary to Getinge. The sterilizers are covered by or for use with U.S. Patent Number 9,039,990. 60155859, 60156887, and 60237894. The 88-Series Washer-Disinfector are covered by or for use with U.S. Patent Number 8,790,588. 9100-Series Washer-Disinfector are covered by or for use with U.S. Patent Numbers 7,754,166, 7,886,753, and 7,959,871 Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Previously, this requirement was and awarded to a WOSB, who was unable to perform all requirements due to the proprietary nature of the electronics system boards and software. Only a fully-trained Getinge employee has access to all OEM parts and is able to perform work on the proprietary medical equipment. As a result, the WOSB could not perform as required and this resulted in degraded operation and higher risk of system failure. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The cost of the Getinge equipment contract is fair and reasonable based on prevailing market rates. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in Section #6 above, market research, in accordance with FAR Part 10, was conducted, further demonstrating that there are no other businesses capable of making full repairs to the VA- owned Getinge equipment. Getinge currently does not partner with any other vendors to work on their proprietary medical equipment. Any Other Facts Supporting the Use of Other than Full and Open Competition: There are no other methods of competing this equipment because of the proprietary nature of the VA-owned Getinge equipment. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Getinge USA, Inc. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Due to the proprietary nature of this equipment, it is not possible to compete specific equipment without the parts and software being readily available to third party vendors. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. Approvals in accordance with the VHAPM, Volume 6, Chapter VI: OFOC SOP.
