Description
Question Due Date and Time Notice: Questions pertaining to this solicitation are due no later 12:00 p.m. on September 25, 2017. All questions must be emailed to Earl Johnson at : EarlCi.Johnson@va.gov and received no later than the question due date and time. Response Date Correction All quotes must be received by 12:00 p.m. on September 27, 2017 Questions and Answers Question 1: Line item (iv) of the instructions regarding the subject solicitation indicate interested offerors who are not the manufacturer of the items  must include a copy of the SBA waiver under the Non-Manufacturer Rule.   Is a copy of that waiver available?  As I understand the FAR, your office makes this available to interested offerors. Answer 1: The above statement is not exactly accurate. The exact words that are in the solicitation, (iv) states Non-manufacture rule applies to this acquisition. Respondents who are not the manufacturer of the product must have a completed waiver from the Small Business Administration (SBA) to be considered. A Contracting Officer is the only one who can request an individual waiver for a specific solicitation. However, a Contracting Officer is not required to request a waiver. No individual waivers will be requested by the Contracting Officer for this procurement, as it is not in the best interest of the Government to do so. Anyone can request a class waiver. The requester should supply SBA with the relevant NAICS code and other identifying information concerning the item. The requester should also supply SBA with market research and other data to support a determination that no small business manufacturer is participating in the Federal procurement market.
