- Under Statutory Authority 40 U.S.C. 501 and 41 U.S.C. 251 the VA Great Lakes Acquisition Center (GLAC) intends to negotiate a sole source contract with CareFusion replace end-of-life infusion equipment; specifically, a quantity of 1,009 Alaris PC Unit 8105s. The Alaris PC Unit 8015s are compatible with the VISN s other Alaris owned devices (Alaris EtC02 Module 8300, Alaris PCA module 8120, Alaris Syringe Module 8110, Alaris Pump Module 8100 and some newer Alaris PC Unit 8015s) This acquisition is conducted under the authority of 40 U.S.C. 501 and 41 U.S.C. 251 implemented in FAR 8.405-6, only one responsible source and no other supplies or services will satisfy agency requirements. This will be a firm fixed price delivery order for a one-time purchase using VA FSS Contract V797D-30183. The NAICS Code is 339112. The Small Business Act and SBA's regulations impose performance requirements (limitations on subcontracting) on firms that are awarded set-aside contracts. In accordance with regulations: 15 USC § § 637(a)(14), 644(o);13 CFR § 125.6; Federal Acquisition Regulation (FAR) § § 52.219-14, 52.219-27. On a supply contract, a firm must perform at least 50% of the cost of manufacturing the supplies (not including the cost of materials). For this purchase, small businesses cannot meet the VA Rule of Two because of the nonmanufacturing rule pursuant to the requirements of VAAR 819.7003 and FAR 19.102(f) and there is no class waiver for NAICS 339112. This Notice of Intent is not a request for competitive quotes. No solicitation documents are available and telephone requests will not be honored. However, if a firm believes it can meet the requirements (and comply with the limitations on subcontracting) it must furnish information to the Contracting Officer by 9:00AM (CST) 09/26/2017. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirements. Responses received will be evaluated however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Contracting Officer will proceed with the sole source negotiation with the CareFusion.
