REDACTED J&A LIMITED SOURCE JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE ORDER 1. Identification of agency and contracting activity, and specific identification of the document as a "Limited Source Justification (LSJ)." This is a Limited Source Justification. The requiring activity is the Naval Medical Center, Portsmouth, VA; the contracting activity is the Naval Medical Logistics Command, Ft. Detrick, MD. 2. Nature and/or description of contract action being approved... • :... • The proposed action is conducted under the authority of the Multiple Award Schedule Program (Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.).and Title 40. U.S.C. 501, Services for Executive Agencies). This is a limited source action to be awarded as a hew Federal Supply Schedule (FSS) order and/or modification of an existing order to the contractor identified in paragraph 3 below. The placement of a Firm, Fixed-Price order is anticipated. 3. Description of the supplies or services required to meet the agency's needs (including the· estimated value). The Naval Medical Logistics Command has a requirement for two (2) microscopes, light, operating [12'- 539] for Naval Medical Center Po1tsmouth. The microscopes shall be functional for use in neuro-spine, : mtho-spine, craniotomy, vascular, and plastic surgery procedures. The microscopes shall have: three'. dimensional (3D) high definition (HD) video recording. The microscopes shall be mobile and have an auto-balance function. The microscopes shall be covered with sterile, self-secured draping:. The· microscopes shall have a 400 watt xenon light beam, adequate for use in deep tissue dissection. The· microscopes shall be capable of various modes of surgical fluorescence, including blue 400, yellow 560, and infrared 800. The microscopes shall provide a working distance of at least 470 mm. The power requirement for the microscopes is 100 V, 60 Hz. Vendor shall be an Original Equipment Manufacturer (OEM) authorized dealer, authorized distribtitor,'or. authorized reseller for the proposed equipment/system, such that OEM warranty and service are provide.ct and maintained by the OEM. All software licensing, warranty, and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. The system, including claims made for the product, shall be compliant with Food and Drug Administration (FDA) regulations, with respect to marketing and delivering medical products for use in the United States of America. These requirements shall apply even if delivery is requested outside of the United States of America. The system shall be installed in compliance with OSHA requirements. The proposed source is Leica Microsystems, Inc. (1700 Leider Lane, Buffalo Grove, IL 60089-6622) for an estimated cost of�� from Navy Other Procurements (OP) Fiscal Year 17 funds. 4. The authority and supporting rational (see 8.405-6(a)(l)(i) and (b)(l)) and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-1 or 8.405-2 is 41 U.S.C. 251, as implemented by FAR 8.405-6. Only Leica Microsystems, Inc. is capable of meeting the minimum requirements of the Government. Leica Microsystems, Inc. is the only vendor that can provide a 3D HD video recording surgical microscope capable of yellow 560 fluorescence-based visualization with a working distance of at least 470 mm that is offered on the Federal Supply Schedule, and that meets all the needs of Naval Medical Center Portsmouth. Yellow 560 fluorescence-based visualization is a capability that will be used to perform fluorescence-based guided surgery. To maintain capabilities of the systems being replaced at NMC Portsmouth, a working distance of at least 470 mm is required. The microscope offered by Leica Microsystems, Inc. has a maximum working distance of 600 mm. This capability allows surgeons to maneuver and pass large instruments below the microscope during surgeries. In addition, a greater working distance reduces strain on the surgeons' backs, especially during long-standing surgeries such as spine surgeries. Leica Microsystems, Inc. is the only vendor that can meet the minimum requirements of the Government and is available on Federal Supply Schedule. 5. A determination by the ordering activity contracting officer that the order represents the best ·. value consistent with 8A04(d). GSA has. determined tl1e.prices of supplies and the schedule contracts to be fair and reasonable for the purpose ·of establishing the. schedule. contract. Therefore, ordering activities are responsible to make a separate determination of fair and reasonable pricing for. individual orders. The Naval Medical Logistics Command Contracting Officer will determin,e, using the procedures in FAR 15.404-1, that the prices are fair and reasonable and will document such determination with a level of detail commensurate with the. complexity and circumstances of each order.. 6. A description of the market research conducted• 11mong. schedule holders and the results. or a statement of the reason\market research was not conducted. · · · Market research was condμcted in December 2016. It included a search of the Internet using Google, GSA· Advantage,· ·and ·the· ECRI Sourcebook. Vendors· offering-JD HD video recording surgical microscopes,. include· Carl. Zeiss· Microscopy, LLC,.Haag-Streit. V.S,A., Inc., Lei ca Microsystems,· Inc.,· Mitaka.U8.A., Inc., and Sometech Co, Ltd. Mitaka U.S.A., Inc. and Sometech Co, Ltd. do not offefa 30 HD video recording surgical microscope on the Federal Supply Schedule, Carl Zeiss Microscopy offers a JD.HD video. recording.surgical microscope with yellow 560 fluore��cence-based visualization, but the microscope does not have a working distance of at least 470 mm and is not available on the Federal Supply Schedule. HaagcStreit U.S.A., Inc, offers a 30 HD video recording surgical microscope on the Federal Supply· Schedule but tl1e microscope is not capable of performing yellow 560 fluorescence-based visualization and only has a maximum working distance of 190 mm. Leica Microsystems, Inc. is the only vendor that can provide yellow fluorescence capabilities and a working distance of at least 470 111111. Leica Microsystems, Inc. is the only vendor that can provide a 30 HD video recording surgical microscope with all required surgical fluorescence capabilities, can meet the required working distance, and is available on the Federal Supply Schedule. Thus, only Leica Microsystems, Inc. can meet the minimum requirements of the Government. 7. Any other facts supporting the justification. This procurement uses a GSA Schedule and will be solicited and awarded 111 accordance with FAR Subpart 8.4. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. All future requirements will be handled on a case-by-case basis. Technical and requirements certification I ce1iify that the facts and representations under my cognizance which are included in this LSJ and which form a basis for this justification are complete and accurate. CONTRACTING OFFICER CERTIFICATION I certify that this justification is accurate and complete to the best of my knowledge.
