Description
This is a COMBINED SYNOPSIS/SOLICITATION for a non-commercial item using Simplified Acquisition Procedures under FAR Part 13, which will be posted on both FEDBIZOPPS and NECO (https://www.neco.navy.mil/). The reason for this Synopsis is to allow the Solicitation to flow to FBO. Per FBO requirements, a Synopsis is required per FAR5.203 prior to issuance of any solicitation; however, since the exception in FAR 13.106-1(b) is being utilized and NOT FAR 6.302, a Synopsis need not be utilized. Also, per FAR 5.202 (a)(13), The contracting officer need not submit the notice required by 5.201 when(a) The contracting officer determines that (13) The proposed contract action (i) Is for an amount not expected to exceed the simplified acquisition threshold; (ii) Will be made through a means that provides access to the notice of proposed contract action through the GPE; and (iii) Permits the public to respond to the solicitation electronically This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on both FEDBIZOPPS (https://www.fbo.gov/) and NECO (http://www.neco.navy.mil/). The Request for Quote (RFQ) number is N00604-17-R-3007. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-89 and DFARS Change Notice 20160802. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at this address: http://farsite.hill.af.mil/. The applicable NAICS code is 541511. The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source to WV COMMUNICATIONS under the authority of FAR 13.106-1(b). Interested parties may identify their interest and capability to respond to the requirement or submit a quote. This notice of intent is not a request for competitive quotes. However, all quotes received by the closing date of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The NAVSUP Fleet Logistics Center Pearl Harbor requests responses from qualified sources capable of providing the following: Flight Termination System Firmware FFP -Flight Termination Firmware/Software: Includes upgrade to support mission configuration to provide additional capability for dual UDP single frequency two vehicle configuration in the test plan. -Yearly Firmware/Software support that includes access to WV Communications œRedmine  Project Management Application; access to new firmware/software releases; notifications via service bulletins; and technical support. -On-site Certification Delivery shall be to the Pacific Missile Range Facility on the Island of Kauai, Hawaii 96752 0128. Method of Payment shall be Government Purchase Card (credit card). The required delivery date is Thursday, September 26, 2018. If the required delivery date cannot be met, an alternate schedule may be considered. Location shall be to PMRF on the Island of Kauai, Hawaii 96752 0128. The Government must exercise its postacceptance rights-- (1) Within a reasonable period of time after the defect was discovered or should have been discovered; and (2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item. (e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence. (f) Termination for the Governments convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractors records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided. (g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience. (h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
