Description
THIS NOTICE OF INTENT IS NOT A REQUEST FOR QUOTES. A DETERMINATION NOT TO COMPETE THE PROPOSED PROCUREMENT BASED UPON RESPONSES TO THIS NOTICE IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT. Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS&IMF)contracting office (code 440), hereby provides notice of its intent to award a sole source, Firm Fixed Price single award contract (FFP) Contract to Curtis Wright EMD (CW-EMD, 1000 Wright Way, Cheswick, PA, 15024). The contract is expected to be awarded under Sole Source procedures. The Government intends to issue a solicitation on this action after October 20th, 2017. A Justification and Approval for Other Than Full and Open Competition has been prepared. The contract is for refurbishing, calibrating, and adjusting two Advanced Secondary Propulsion Unit (ASPU) systems. This is a proprietary work patented for Curtiss Wright EMD. NAICS code: 541330 Engineering services, marine engineering and Naval Architecture (SBA Size Standard $38.5 Million). THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. However, interested parties may identify their interest and capability to respond to this requirement no later than October 10, 2017 12 PM, PST. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS) Contracting Office (Code 440) will NOT be responsible for any costs incurred by interested parties in responding to this notice of intent. Only written responses will be considered. All responses from responsible sources will be fully considered. As a result of analyzing responses to this notice of intent, the Government shall determine if a solicitation will be issued. Any prospective contractor must be registered in the System for Award Management (SAM) in order to be eligible for award. Interested parties are encouraged to furnish information by email only with RESPONSE TO INTENT TO SOLE SOURCE ADVANCED SECONDARY PROPULSION UNIT in the subject line. All documents submitted will not be returned. All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy the requirements to Nickson Hatungimana by email at nickson.hatungimana@navy.mil. The capability documentation should include general information and technical background describing in detail the prospective contractor's capabilities and experience that will demonstrate the ability to support these requirements. JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION SOLE‐SOURCE JUSTIFICATION 1. Contracting Activity. The Naval Sea Systems Command Field Procurement Office (FPO) Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS&IMF). 2. Description of Action Being Approved. Award of a firm fixed price contract using commercial procedures to Curtis‐Wright Electo‐Mechanical Division (EMD) for services to refurbish the Advanced Secondary Propulsion Unit (ASPU) Systems in support of USS JIMMY CARTER, SSN 23. The action being submitted for approval is the request for approval to contract under the conditions of having only one responsible source and no other supplies or services will satisfy agency requirements. Curtis‐ Wright Electro‐Mechanical Division is the only firm capable of meeting the ASPU Technical requirements. (FAR 6.302‐1(b)(1)(i) and FAR 6.302‐1(b)(2)) 3. Description of Supplies/Services. This procurement is for services to refurbish, calibrate, and adjust two of the four ASPU systems. The requirements shall include all manufacturing/production, technical support, engineering, and troubleshooting services. The services shall include analyzing and determining root cause(s) of electrical and mechanical faults experienced by the ASPU systems, corrosion analysis, and identifying and making corrective actions needed to resolve the faults. Optional tasks will be built in to Performance Work Statement (PWS) and Solicitation and exercised dependent upon the results of the root cause analysis found during the testing of ASPU systems. Due to the sensitivity of the system, the resulting contract will also require EMD to provide and store replacement parts for the repair for ASPU systems in accordance with the refurbishment cycle. The repair schedule shall consist of the refurbishment and procurement of system replacement parts. (FAR 6.302‐1(a)) The estimated cost, based on Independent Government Estimate, is expected to be $6,527,295.15, including options. Fiscal year 2018 RDT&E funds will be obligated prior to contract award. Funding will be received prior to exercising any option line items via modification to the contract. Period of Performance is expected to be 16 October, 2017 through 15 June, 2019. 4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C. 2304(c)(1), Only one responsible source. 5. Rationale Justifying Use of Cited Statutory Authority. EMD specifically designed four APSU systems for the USS JIMMY CARTER, SSN 23. The ASPU design is complex n and they are an integral part of the NAVSEA approved system configuration for the boat. As the Original Equipment Manufacturer (OEM), EMD designed, patented, and built the ASPU to meet the Navy's technical requirements. The components for the ASPU are proprietary. Other manufacturers cannot produce similar products or perform similar services because the OEM interface designs are patented and protected from all third parties by EMD. The services to be performed are utilizing proprietary drawings. No alternative products or systems exist that can fulfill the services required for the ASPU system. The estimated cost to PSNS&IMF for duplication of the ASPU effort to allow competitive procedures to be used is upwards of $11.9 million; Based upon original IDIQ Development Contract with EMD (N4523A‐15‐D‐0001), Delivery Orders 0001 (Design), 0002 (First Article Test) and 0003 (Production). (FAR 6.303‐2(9)(iii)). Upon completion of the refurbishment, the ASPU must meet and ensure no deviation from design, in order to ensure it interfaces satisfactorily with other system components. This can be met only if components manufactured by EMD are used and if EMD performs the required services. Expenditure of the time and money to develop a second source for this one of a kind system would be neither economical nor cost efficient; Based on this rationale, proceeding with procurement of this requirement on a sole source basis to EMD is in the best interest of the Government. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. (a) Sources Expressing Interest. A Notice of Intent to Sole Source was posted to Government Point of Entry (FBO) on 29 August closing 13 September, 2017. No responses were received by PSNS&IMF from posting. No additional sources have been identified since the OEM/PSNS&IMF holds all proprietary rights to all technical data and knowledge of systems operations. (DFARS PGI 206.303‐ 2(b)(i)(A)) (b) Synopsis/Solicitation. Synopsis and solicitation will be posted to the Government Point of Entry (FBO) for the current requirement. Solicitation contains information that requires additional controls to monitor access and distribution (e.g., technical data, specifications, maps, building designs, schedules, etc.), the information shall be made available through the enhanced controls of the GPE. (FAR 5.102(a)(4)) (c) Market Research. Market research consisted of reviewing historical contracts, interactions with industry participants, and input from government subject matter experts. Further market research is not practicable for the reasons discussed in paragraph 5 above. No additional market research has been conducted. 7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by this J&A will be fair and reasonable based on previous contracts. The Government will require certified cost or pricing data and will use historical prices, published price lists, quotes received in market research, and any other information to determine fair and reasonable pricing. 8. Actions to Remove Barriers to Future Competition. For the reasons set forth in paragraph 5 above, PSNS&IMF has no expectation that future attempts at competition will be successful. At the point of time when the Government will require new ASPU systems, the contracting office will work to assist the technical requiring office to conduct actions (evaluation factors or PWS for a modular design) that will push for a system which allows for open competition, if allowable.
