Jonas Courthouse Alteration BUDGET: $119 to $129 million This notice is a synopsis of an anticipated solicitation to provide Construction Manager as Constructor (CMc) services for the New U.S. Courthouse Annex and Alteration of the Charles R. Jonas United States Courthouse located in Charlotte, North Carolina. The General Services Administration (GSA) anticipates releasing the solicitation on or about October 16th, 2017, with a proposal due date on or about 11/15/2017. The solicitation will be available electronically on www.fbo.gov under this solicitation number. GSA anticipates holding a pre-proposal conference and walk through in Charlotte, North Carolina on November 1st. Exact time and location details will be included in the solicitation. GSA also anticipates holding a Small Business Outreach event in Charlotte the afternoon of November 1st, exact time and location to be confirmed in the solicitation. The Small Business Outreach event will be held to assist interested offerors in locating qualified small business firms to include as part of their team in order to meet and exceed the small business subcontracting goals that will be included in the solicitation. The North American Industry Classification System (NAICS) Code for this procurement is 236220. The size standard is $36.5M per year. The scope of CMc services under this proposed contract includes Design Phase and Construction Phase Services. The solicitation, when issued, will be an unrestricted procurement open to all small and large business concerns. All offerors (if not a small business concern), will be required to submit a Subcontracting Plan, pursuant to FAR Part 19.7, and the Contracting Officer will negotiate a subcontracting plan with the successful offeror, which will be included as a material element of the contract. GSA's subcontracting goals are as follows, however it should be noted that the following goals represent the minimum, GSA anticipates negotiating a subcontracting plan for this procurement that significantly exceeds these goals: Small Business (36.50%), Small Disadvantaged Business (5%), Service Disabled Veteran Owned Small Business (3%), Woman-Owned Small Business (5%) and HUBZone Small Business (3%). General Project Information The project is a new United States Courthouse Annex and Alteration of the Charles R. Jonas United States Courthouse, located in Charlotte NC. The Charles R. Jonas Federal Building, originally constructed in 1915 with a 1934 addition which tripled the size of the courthouse, is significant to the history of Charlotte, and one of the few historic structures remaining in the Central Business District. It is an excellent example of the Neo-classical Revival style of architecture exhibiting many fine exterior and interior details. The building was listed on the National Register of Historic Places in 1978. The proposed Annex will be constructed on an existing surface parking lot immediately west of the Jonas United States Courthouse. The Annex and alteration project will allow the federal government to continue its long-term use of this historic facility in Charlotte. Together, the new Annex and Alteration of the Jonas Courthouse will improve security, create discrete circulation patterns, provide for future growth, consolidate the court family, and positively impact downtown Charlotte. Due to the age of the existing Jonas Courthouse, major upgrades and/or replacement of major building systems including building envelope, plumbing, HVAC, electrical and life safety systems are needed to ensure continued operation for the Courts and to address energy efficiency. The addition of the Annex will meet the long term space needs of the Courts, while also addressing security and circulation deficiencies that currently exist in the Jonas Courthouse. The project site is bounded by West Trade Street, Mint Street, West 4th Street and multi-family residential structures. It is near public parking structures, legal professional offices, multi-family residential structures and BB&T Ballpark. This project will be an anchor for revitalization and future development in the Central Business District, and its design should reflect the dignity, enterprise, vigor and stability of the Federal Government. The new Annex building will be approximately 213,692 GSF for New Annex, 134,428 GSF for Charles R. Jonas Courthouse. The new Annex and the altered Jonas United States Courthouse combined will total 348,120 gross square feet and will provide a total of ten (10) courtrooms - three (3) District, two (2) Senior District, one (1) District Special Proceedings, two (2) Magistrate and two (2) Bankruptcy courtrooms. The Project will provide space for the United States Circuit, District and Magistrate Courts, United States Marshals Service, United States Probation Office, Federal Public Defender, United States Attorney's Office, and GSA's Public Buildings Service. The Estimated Construction Cost range is approximately $119 to $129 million. GSA may contract separately during the design phase for Construction Manager as Agent (CMa) services. The CMa and CMc will be involved in the design process to provide administrative functions, construction expertise, estimating services, building information modeling coordination, and both drawing-based and model-based functionality / constructability reviews. There will be a formal partnering process throughout the design and construction phases to promote successful project development and execution through integrated delivery of the project to accomplish established agreed-upon project objectives by all involved parties to their mutual benefit. Scope Summary The CMc scope of work includes all labor and materials required to provide design phase and construction phase services for the modernization of the existing Charles R Jonas US Courthouse and the construction of a new annex. The services requested of the CMc shall cover a wide range of design and construction activities, as defined below. GSA will first construct the new annex and once complete, the Jonas Courthouse will be partially vacated during the renovation. The new annex will be constructed directly adjacent and will connect to the Jonas Courthouse. Alteration work within the Jonas Courthouse includes upgrades to heating, ventilating, and air conditioning, electrical systems, lighting, plumbing, life safety systems (including fire alarm replacement); elevator replacement; accessibility upgrades; tenant improvements; facade repairs; and hazardous material abatement. Project Description & Approach GSA intends to award a single contract to include design phase and construction phase services pursuant to Federal Acquisition Regulation (FAR) Best Value Selection Procedures (FAR Subpart 15.3). The base contract for design phase services will be awarded at a firm-fixed price. The construction phase services option will be awarded as a Guaranteed Maximum Price (GMP). The project will still be in the design phase when the CMc contract is awarded. The GMP will be tracked through open book accounting that will be reviewed and monitored by GSA and/or GSA's agents. GSA envisions a highly collaborative delivery approach for this project where the CMc contractor works closely with all stakeholders to deliver a project that meets the expectations and needs of both the team members and GSA's requirements to deliver an economical and operationally efficient high performing green building. As required by law, the facility must meet federal energy goals. The project is also to include conformance to the FY16 P-100 (Facility Standards for Public Buildings) and all other applicable building codes and standards. The repair and alterations of the historic courthouse must meet the Secretary of the Interior's Standards for the Treatment of Historic Properties to avoid, minimize or mitigate adverse effects on the building. During the development period from initial concept to final design the CMc will work in close consultation with GSA, the stakeholders and the CMa to ensure that all of the goals are addressed and that best value practices are utilized. The CMc will assist GSA and the AE to provide design phase services, including scheduling, estimating and cost information, and functionality and constructability reviews. There will be an informal partnering process throughout the design and construction phases to promote successful project development and execution including an enhanced project kick-off meeting. A Commissioning Agent (CxA) will be contracted to provide services. All installed systems will be fully commissioned and functionally tested to ensure compliance with contract documents prior to being accepted by GSA. Construction Phase Services shall include all labor and materials required to provide design phase and construction phase services for the modernization of the existing Jonas US Courthouse and the construction of a new annex. The services requested of the CMc shall cover a wide range of design and construction activities, such as: constructability reviews, cost estimating, work phasing reviews, scheduling and general construction services. The CMc is at risk and is responsible for involvement in the project development and administration of the construction. The CMc has complete responsibility for all construction related to the project scope. Project Delivery Schedule GSA anticipates award of this CMc contract in January 2018 with construction estimated to start around July of 2018 and take approximately 48-50 months to complete. This includes approx 24 months construction for the new Annex and 24 months for the renovation of the Jonas building. Unique Situations/Risks In addition to the historical requirements outlined above, the budget and schedule have been identified as significant risks. Also due to the early stages of design, coupled with the need for continuous operation during construction, present unique challenges for the CMc teams on the project. The Jonas US Courthouse will remain fully occupied and operational during the construction of the annex. No adverse impact on tenant mission will be acceptable. Phased and Occupied Facility Construction The construction of the Charlotte facility includes a phased construction approach. The Annex will be constructed first while the Jonas remains occupied. The renovation of the Jonas will follow the construction of the Annex. Shared and new mechanical systems at the Charlotte USCH must facilitate a fully functional facility where occupied throughout all phases of construction. These functions include typical office work, but also include services for the general public and a courthouse. This presents several challenges that will have to be addressed by the AE and CMc team. • All work in functional (i.e. occupied) public spaces will need to be completed during unoccupied periods. Setup, construction, and clean-up will need to occur on a daily basis. • Work must be performed in such a way that space conditioning and utilities in the Jonas USCH are maintained while the building is occupied, including throughout construction of the annex. Temporary/contingency HVAC/R, electrical and water systems may be required. Any shutdown of a building system will need to be completed after business hours or on the weekends and put back into service and put back into prior to the next business day. This will be the responsibility of the CMc. •Phasing: Emergency power generator in Jonas must remain operational while the facility is occupied. •Egress and access to the Jonas CH must be maintained for the employees and visitors during the course of building the new annex. Solicitation For this RFP, non-price factors, when combined, will be significantly more important than the total evaluated price. Evaluations will be based on technical factors as well as price. The Government reserves the right to evaluate proposals and make an award without conducting discussions (clarifications may be made as described in FAR 15.306(a)). The Government may negotiate the CMc's fee for Design Phase Services and/or estimated cost of the work for Construction Phase Services including profit, general conditions and overhead costs as well as any other aspect of the offer as deemed necessary. In accordance FAR Subpart 15.305, the Contracting Officer will determine which proposals are within the competitive range based on the evaluated price and the non price evaluation factors included in the RFP. The Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. Evaluation factors and price proposal information will be included in the solicitation. Bond Requirements A bid guarantee will be required 90 days prior to the exercise of the Construction Option. The option award will require performance and payment bonds as specified in the Agreement.
