- Description
- The United States Department of Commerce (DOC), National Institute of Standards and Technology (NIST), Acquisition Management Division (AMD) intends to negotiate a firm fixed price purchase order, on a sole source basis, with EDAX, Inc. for the purchase of a base plus four option year service maintenance contract for the Center for Nanoscale Technology Science and Technology (CNST). The statutory authority for this sole source acquisition is FAR 13.106-1(b) by the authority of FAR Part 13 Simplified Acquisition Procedures. A service maintenance contract is required for the EDAX TEAM Pegasus EDS/EBSD System, manufactured by EDAX, Inc., which is mounted on the CNST's Zeiss CrossBeam 540 FIBSEM. The service maintenance contract shall include one preventative maintenance and calibration service per year, phone support, up to two emergency repair visits per year, installation and replacement of failed components, software and hardware upgrades and detector replacement if the detector fails. EDAX, Inc is the original equipment manufacturer (OEM) and can provide the required service, calibration, upgrades on both the hardware and software, and failed detector replacement. Only EDAX, Inc. has the experienced, factory authorized trained technicians required for performing the necessary services. EDAX, Inc. does not subcontract with any other sources to provide the necessary services required. The software code, detector and analyzer hardware are proprietary to EDAX, Inc. Therefore, the services required are only available from EDAX, Inc. as they are uniquely qualified to perform the work with their factory trained technicians and they are the only source with access to the proprietary software codes and equipment. Delivery shall be FOB DESTINATION and shall be in accordance with the Contractors established contract lead times. The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is 20.5M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, all responsible sources interested may identify their interest and capability to respond to this requirement. The Government will consider responses received by established due date/time set forth in this notice. Inquiries will only be accepted via email to joni.laster@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement in the future.
