Description
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity - The West Virginia Air National Guard, 130 th Airlift Wing, ATTN: MSG/MSC, Charleston, WV, 25311, is responsible for this action. 2. Description of Action - The 130 th Airlift Wing proposes to contract with Suddenlink Commnications for cable television and internet services at the 130 th Airlift Wing. A new firm fixed price contract with option years using O&M funds will be issued. 3. Description of Supplies/Services - The contractor shall furnish all parts and software for cable television services and internet services availability and signal at the 130 th Airlift Wing, 1679 Coonskin Drive, Charleston, WV 25311. Total Acquisition estimate is $40,000.00. 4. Authority Cited - This action is authorized under the provisions of 10 USC 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, as only one responsible source and no other supplies or services will satisfy agency requirements. 5. Reason for Authority Cited - The contractor, Suddenlink, is the only provider in the Charleston, WV area who has a hard-wired service is able to provide cable services and internet services (bundled) not via satellite. The currently 3 service providers in the area Direct TV, Dish Network, and Suddenlink communications. The current service from Direct TV and Dish Network is spotty and inconsistent with the high winds near flightline, and terrain in West Virginia. The satellite service providers require an initial expenditure of $25,000 -$30,000 for hardware that must be maintained and replaced at wing expense. Suddenlink provides better hard-wired service with better reliability, and no initial hardware costs, and all equipment is maintained by Suddenlink. The Wing Commander has mandated that we provide a better quality more reliable service, and the only provider that meets these requirements is Suddenlink. DirecTV and Dish Network do not provided direct commercial internet service without using a third-party subcontractor. 6. Efforts to Obtain Competition - Internet researched, contacted public service commission, and reviewed pricing online for Dish Network, discussed need for purchase of equipment with current provider (Direct TV). Spoke with Suddenlink representatives to determine cost of moving to Suddenlink cable (previously held at the 130 AW). All market research and information gathered for this requirement shows that anything other than Suddenlink would not be in the best interests of the government, as pricing for Suddenlink is not only much more consistent, but service from any other provider would most likely be problematic for 130 th Communications Squadron personnel in having to call a satellite provider on a regular basis to adjust the satellite due to the high winds near the flightline and the terrain of the base. 7. Action to Increase Competition - It is not feasible to provide for full and open competition in the current acquisition because no other company can provide the bundled television and internet services needed for this project. 9. Interested Sources - To date, no other sources have expressed a written interest in this acquisition. 10. Other Factors - None 11. Fair and Reasonable Cost Determination - I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable in accordance with FAR 8.405-6. The quoted price is based on the vendor's routine service contractual pricing and reflects a discount provided to the federal government of an increase of approximately 5% per year as opposed to the standard 10% increase per year. Contacted multiple vendors but realized the upfront and life time replacement cost was going to unsustainable with the satellite providers. Because there are only a few options for television stations within the Charleston, WV area, prices are found to be consistent with business services in the region. 14. Contracting Officer Certification - I certify that this J&A is accurate and complete to the best of my knowledge and belief. 15. Approval - Based on the foregoing justification, I hereby approve the procurement of the supplies and services in support of the cable television and internet services for $40,000.00 on a basis in which only one responsible source and no other supplies or services will satisfy agency requirement pursuant to the authority of Title 10 United States Code Section 2304(c)(1), subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
