- This NOTICE OF INTENT TO AWARD A NON COMPETITVE CONTRACT is conducted in accordance with Federal Acquisition Regulation (FAR) Part 12, Commercial Items and FAR Part 13, Simplified Acquisition Procedures. The authority for this award is FAR 13.106-1(b), soliciting from a single source; utilizing the procedures in FAR subpart 13.5 in accordance with 41 U.S.C. 1901. The Office of Personnel Management's (OPM), Federal Executive Institute (FEI) part of the Center for Leadership Development (CLD) under Human Resources Solutions (HRS), The Federal Executive Institute (FEI) to provide on-site catering services during FEI's use of USPTO's Madison Auditorium and USPTO's accompanying conference services for FEI's delivery of the November 28-29, 2017 government-wide Senior Executive Service (hereafter SES) Orientation Briefing. Specifically, The approximately 250 Senior Executive participants attending the November 28-29, 2017 government-wide OPM Orientation Briefing for new SES and SES equivalents are required to stay in one large auditorium room (the Madison Auditorium, USPTO) for the full duration of the program (Day 1: 9am to 4:30 pm exclusive of registration; and Day 2: 9am to 3pm). That is: continuous attendance by participants is necessary and required to achieve the learning objectives of this education and training; attendees are not free to take meals or refreshments elsewhere other than in the one large auditorium where the program is delivered. The on-site catering supplies and services include two working lunches (box-lunch meals, one each day), and occasional coffee/tea/break services each of which are built into the curriculum and all of which are provided inside the meeting room. The caterer must also provide linen service, wait service and general cleaning for the Auditorium holding the 30+ roundtables at which participants are seated (as well as stage, A/V, etc), and must refresh and clear supplies as aligned to the agenda. It is essential that the caterer can provide advance healthy food choices and can respond both advance and on the spot to special dietary needs. The food that is served is very basic while appropriate to the program and its audience, and it must be provided and removed very quickly within the specified curriculum time parameters. Breakfast is not included as the program begins at 9am. Coffee, tea and soft drink beverages are provided throughout the day, with occasional nuts, cookies in the afternoon - all with the intention of ensuring continuity of learning and minimizing disruption of the program delivery. The current on site caterer is Sodexo and Affiliates, 9801 Washingtonian Blvd, Gaithersburg, MD 2087. The North American Industry Classification System (NAICS) Code for this requirement is 722320 Catering. THE PURPOSE OF THIS NOTICE IS TO SATISFY THE REQUIRMENTS OF FAR SUBPART 5.2. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, all responsible parties who identify their interest and capability to satisfy this requirement will be considered. No solicitation will be issued, therefore, all requests for the solicitation will be considered non-responsive. A determination not to compete this action based upon responses received is in the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via e-mail to OPM Team C Mailbox, OPOTeamCMailbox@opm.gov, within two days of the published date of this notice. Verification of receipt of electronic transmission is the sole responsibility of the contractor. All OPM contractors are required to register in the System for Award Management (SAM) database prior to execution of award. If no competitive responses are received, an award will be made to Sodexo and Affiliates.
