Description
Justification for Other Than Full and Open Competition •1. CONTRACTING ACTIVITY The General Services Administration, Federal Acquisition Service proposes to enter into a contract with Neutral Posture, Inc. on a basis of other than full and open competition. •2. DESCRIPTION OF THE ACTION BEING APPROVED GSA has identified demand for ergonomic, height adjustable, stand bias workstations for the National Stock Number (NSN) program in support of GSA Global Supply. These NSNs shall be provided by Neutral Posture, Inc., an Economically Disadvantaged Women-Owned Small Business (EDWOSB) Concern for one base year with four one-year option periods. •3. DESCRIPTION OF SUPPLIES/SERVICES The supplies to be provided by the EDWOSB are stand bias workstations, which encourage standing as opposed to sitting at ones desk. These products will be available to both military and civilian agencies through GSA Global Supply. There will be a total of twenty-four NSNs offering different finish combinations and two different chair types, and two different desks. One adjustable height desk and one fixed, bar height desk. •4. Statutory authority permitting other than full and open competition The statutory authority permitting other than full and open competition is per FAR 19.1506 (Women-Owned Small Business Program sole source awards), authorized or required by statute. •5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY Leveraging a qualified contractor through the WOSB program will ensure maximum small business engagement and streamlining acquisition lead times. Per FAR 19.1506 (Women-Owned Small Business Program sole source awards), the contracting officer shall consider a contract award to an EDWOSB concern on a sole source basis before considering small business set-asides if the acquisition is assigned a WOSB underrepresented NAICS Code, there is no reasonable expectation to receive two or more offers from EDWOSB concerns, the procurement does not exceed $6.5M, the EDWOSB concern has been determined a responsible contractor and the award can be made at a fair and reasonable price. All aforementioned conditions exist. Specifically, the NAICS Code for the acquisition is 337214, which is listed as an underrepresented EDWOSB NAICS. Additionally, there is not a reasonable expectation to receive two or more offers from EDWOSB concerns as the foot platform attached to the stool and the fixed bar height desk was not found to be offered by other EDWOSBs via market research. Furthermore, the procurement have an estimated contract value of $6.25M based on the vendor commercial and government sales of these items. This does not exceed the $6.5M threshold. Finally, the EDWOSB has been determined a responsible contract via PPIRS and SAM reviews, along with previously contract experience, and the awarded pricing has been determined fair and reasonable and discounts were provided which were lower than the discounts the vendor offers on their GSA Schedule Contract. •6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICABLE Market research was conducted to seek sources for these items. The marke t research was performed by a GSA Technical Representative to research possible sources for competition on GSA Schedules. This market research included surveying the product catalogs for small, domestic manufacturers and large manufacturers to see if their products were technically similar to the stand bias workstations being offered by Neutral Posture. Based on the market research, GSA Technical determined similar items were not available through the GSA Schedule Program. As a result of the market research, the decision was made to procure this product via a sole source EDWOSB pursuant to the SBA's WOSB Program, as a firm fixed price type contract. Only Neutral Posture, Inc. was found to manufacturer a counter height fixed worksurface desk, and ergonomic stool with attached foot platform for standing. An EDWOSB Sole Source award was determined to be the most effective acquisition alternative for this requirement. •7. DETERMINATION OF FAIR AND REASONBLE COST Neutral Posture, Inc. offered discounts to GSA for these stand bias workstations which were greater discounts than awarded on their GSA Multiple Award Schedule Contract. Neutral Posture, Inc. offered an additional 5% discount off of their standard GSA schedule pricing. Therefore, because GSA Schedule pricing has already been determined fair and reasonable, the additional 5% discount offered for these products equates to additional savings for GSA Global Supply's military and civilian customers. •8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION GSA is fully committed to supporting the small business community and socioeconomic programs. The small business community will be considered on future opportunities as appropriate and in accordance with all Federal Acquisition Regulations. •9. Contracting Officer Certification I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief. •10. Technical/Requirements Personnel Certification I certify this requirement meets the Government's minimum need and that the supporting data, which form a basis for this justification, are complete and accurate.
