Control # Gordon-2017-18 -1- FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items Justification and Approval - Sole Source 1. Contracting Activity: Mission and Installation Contracting Command (MICC) - Fort Gordon, GA. 2. Description of Action: Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B). Name of Proposed Contractor: Dani Instruments, Inc. Street Address: 257 Simarano Drive City, State: Marlborough, MA 01752 Phone: (508)-281 - 6232 3. Description of Services or Supplies: The Defense Forensic Science Center (DFSC) requests the sole source purchase of a Dani DiscovIR-GC gas chromatograph - solid phase infrared spectrometer system. Total Dollar Value: $152,876.00 4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5: Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization Other: Sole Source 5. Reasons for Authority Cited: a. The Defense Forensic Science Center (DFSC) located at the Gillem Enclave in Georgia, provides forensic laboratory services to the Department of Defense investigative agencies and other Federal law enforcement agencies. The U.S. Army Criminal Investigation Laboratory (USACIL) Chemistry and Firearms - Drug Chemistry Section (CFA-DC) require the sole source purchase of an DANI gas chromatograph - solid phase Control # Gordon-2017-18 -2- direct deposit fourier transform infrared spectrometer system (DiscovIR-GC) for forensic casework to assist in providing investigative seized drug identification evidence to law enforcement agencies DoD and nationwide. The replacement of the current 6 year old model is required as part of our lifecycle replacement program in support of the laboratory's mission and to ensure continuity of operations. b. Dani Instruments, Inc. has the sole rights to the solid phase FTIR direct deposition chromatography onto cryogenic ZnSe disk technology upon which the DiscovIR-GC system is based. This piece of equipment cannot be purchased from another company. The vendor provided a proprietary letter c. Dani DiscovIR-GC gas chromatograph - solid phase infrared spectrometer system is utilized in the USACIL CFA Branch. Purchase of this system will negate any training needed on software or hardware as all users are familiar with the existing interfaces used on this system. Additionally, this brand will fall under the umbrella of the already existing service contract set up with manufacturer for preventative maintenance and service. The current model has demonstrated reliability and consistency for the types of analyses performed in this center. d. Internal validation of the current DiscovIR-GC for forensic casework applications was completed by USACIL CFA-DC Branch. Validation is the process in which a procedure and associated instrumentation is evaluated to determine efficacy and reliability for forensic casework analysis. Internal validation is the accumulation of analytical test data within a laboratory to demonstrate that the procedure is performing as expected. The accuracy, reproducibility, and sensitivity of these instruments was established, and retained on file at the laboratory, as required by the laboratory's accrediting body. Large portions of this initial validation study will be directly applicable to the proposed system negating the need to perform a complete validation study of a competing technology, thus saving the government time, manpower, and money. e. An extensive spectral library of controlled substances has been acquired using solid phase FTIR direct deposition chromatography onto cryogenic ZnSe disk technology via the current system at USACIL CFA-DC. This library is specific to this spectral acquisition technology and therefore will be directly transferable to the new proposed system negating the need to build a new compound library. This will save the government time, manpower, and money. 6. Efforts to Obtain Competition: To promote competition the MICC-Fort Gordon will continue to synopsize and conduct market research to ensure there are no other vendors that can provide the requirement. 7. Actions to Increase Competition: DFSC research scientists are continually researching sources of information and services to enable forensic examiners to conduct effective and reliable examinations. Market research consists of internet research, literature reviews, discussions with vendors and other professional resources, attending forensic science and technical conferences and industry events. If DFSC identifies a similar requirement, every effort will be made to compete it to the maximum extent possible. Control # Gordon-2017-18 -3- To increase competition the MICC-Fort Gordon will continue to synopsize and conduct market research to ensure there are no other vendors that can provide the requirement. The Government issued a sole source synopsis. No responses were received. 8. Market Research: Research was conducted on the internet and General Services Administration (GSA) GSA Advantage website during July 2017 by DFSC staff. Continual review of new products and technologies is conducted by examiners within the Chemistry and Firearms Branch in order to determine the best commercially available product reliable for the task. No other supplier of an instrument based on solid phase FTIR direct deposition chromatography onto cryogenic ZnSe disk technology was found. A quote from Dani Instruments, Inc. for the purchase of a DiscovIR-GC system was obtained along with a statement that this technology is proprietary. The unique salient characteristics for DiscovIR-GC system include: Direct deposition of chromatogram onto cryogenic ZnSe sample disk Built in FTIR detector 4000 - 600 cm-1 IR range 4 cm-1 IR resolution Sample in solid phase during detection Transmittance through ZnSe disc and sample IR acquisition < 0.8 miliabsorbacne units peak to peak noise 9. Other Facts: Previous sole source awards for DiscovIR-GC system - W91249-11-P- 0230 10.
