- Sources Sought Note: This notice is published in accordance with Federal Acquisition Part (FAR) Part 10, Market Research and FAR Part 15, Exchanges with Industry before Receipt of Proposal. This notice serves as a Sources Sought in support of market research and/or planning purposes only and does not constitute a solicitation. This notice is not a confirmation that the Government will contract for the items or services contained in the sources sought, nor is any commitment on the part of the Government to award a contract implied. This notice does NOT constitute an Invitation to Bid, a Request for Proposal, or a Request for Quote. The Government shall not pay and/or reimburse respondents and/or associates for any costs incurred to submit the requested information. All information received in response to this sources sought that is marked Proprietary will be handled accordingly. In accordance with FAR 15.201(c), response to this sources sought is not offers and cannot be accepted by the Government to form a binding contract. The purpose of this is to seek capable and responsible sources interested in performing this service. Responses will assist the Government with developing its acquisition strategy to include socio-economic set-asides. If you believe there are ambiguities in the draft SOW, please identify them. Note that the Government will not answer questions about this requirement at this time. STATEMENT OF WORK Hemodialysis Water Testing Purpose: Procure testing services for dialysis water to comply with VA and AAMI standards. Statement of Work: The Contractor shall be a certified laboratory capable of providing bacterial assays of dialysis water in accordance with ANSI/AAMI 13959, 2014 using one of the following methods: 7 days incubation: tryptone glucose extract agar (TGEA) or Reasoner s 2A supplemented with 4 % sodium bicarbonate, ore equivalent. Blood or chocolate agar shall not be used. Incubation temperatures of 17 °C to 23 °C, and an incubation time of 168 h (7 d); OR 48 hours incubation: Trypticase soy agar (TSA, a soybean casein digest agar) or standards method agar and plate count agar (also known as TGYE), incubated at 35 °C for 48 hours. The Contractor shall ship and adequate number of appropriate sample containers to the Medical Center on a monthly basis and include a preprinted and prepaid return label for overnight shipping. Medical Center staff will then collect the samples from the required locations and return them to the testing lab via overnight shipping for analysis. The testing lab will perform the required tests and provide a written and certified electronic copy of the results to the Contracting Officer s Representative (COR) via email within 1-week of obtaining test results. If, however, any test results are found to be above the allowable limits per ANSI/AAMI standards, the Laboratory shall contact the COR immediately via phone or email so that mitigation measures can be enacted in a timely manner. Association for the Advancement of Medical Instrumentation (AAMI) testing of Dialysis Water quarterly is required. Schedule of Tests: The contractor shall provide testing service as described above in the following quantities: Bacterial Culture Testing of Dialysis Water (138 each). Endotoxin testing of dialysis water (138 each). Quarterly AAMI testing of dialysis water (4-each). Month 1: Eleven (11) Bacteria and Endotoxin Tests Month 2: Twelve (12) Bacteria and Endotoxin Tests Month 3: Eleven (11) Bacteria and Endotoxin Tests, One (1) AAMI Test Month 4: Twelve (12) Bacteria and Endotoxin Tests Month 5: Eleven (11) Bacteria and Endotoxin Tests Month 6: Twelve (12) Bacteria and Endotoxin Tests, One (1) AAMI Test Month 7: Eleven (11) Bacteria and Endotoxin Tests Month 8: Twelve (12) Bacteria and Endotoxin Tests Month 9: Eleven (11) Bacteria and Endotoxin Tests, One (1) AAMI Test Month 10: Twelve (12) Bacteria and Endotoxin Tests Month 11: Eleven (11) Bacteria and Endotoxin Tests Month 12: Twelve (12) Bacteria and Endotoxin Tests, One (1) AAMI Test Contract Period: The Contract shall be in effect for the base year (12-months) and include the option to award four (4) additional years. NARA Records Management Language for Contracts: The following standard items relate to records generated in executing the contract and should be included in a typical Electronic Information Systems (EIS) procurement contract: Citations to pertinent laws, codes and regulations such as 44 U.S.C chapters 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract. The Government Agency owns the rights to all data/records produced as part of this contract. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.]. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.
