- Sole Source Posting ***NOAA's Acquisition & Grants Office, Western Acquisition Division-Boulder, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Xera GIS of Bishop, California for assisting the National Marine Fisheries Service by providing software support to the Aerial Surveys of Arctic Marine Mammals (ASAMM) project. This software support includes maintaining and debugging proprietary ASAMM software (comprising ASAMM survey and ASAMM Post-Flight Utilities programs) used for data collection, data storage, data processing, real-time mapping, and daily post-flight report production. ***The sole source determination is based on the National Oceanic & Atmospheric Administration's (NOAA) Northwest Regional National Marine Fisheries Service (NMFS) requirement for software support to the Aerial Surveys of Arctic Marine Mammals (ASAMM) project. This software support includes maintaining and debugging proprietary ASAMM software (comprising ASAMM survey and ASAMM Post-Flight Utilities programs) used for data collection, data storage, data processing, real-time mapping, and daily post-flight report production. Xera GIS is the only entity that can possibly do this work, because ASAMM Survey and ASAMM Post-Flight Utilities are proprietary software programs that were developed and are currently being maintained and upgraded by XeraGIS. They were developed specifically to meet the needs of the ASAMM project. XeraGIS has not given any other entity permission to provide maintenance to this software, and even if another entity was now given permission, it would take considerable time and effort for the new entity to reach a level of knowledge about the ASAMM's project needs and proficiency with the ASAMM Software programs that are necessary to meet the government requirement for this procurement. The base year period of performance is from December 1, 2017 through November 30, 2018. There are two option years with the same days as periods of performance (December 1, 2018-November 30, 2019 and December 1, 2019 through November 30, 2020). These option periods may or may not be exercised at the discretion of the government. ***This notice of intent is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can fully meet the Government's requirements may submit substantiating documentation in writing to the identified point of contact within 15 days after publication of this synopsis. Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice.
