Description
United States Special Operations Command (USSOCOM) Directorate of Procurement intends to solicit and negotiate a 5-year indefinite delivery/indefinite quantity (IDIQ) contract solely with Sierra Nevada Corporation (SNC), 444 Salomon Circle, Sparks, NV 89434-9651 for the sustainment of Tactical Radio Application eXtension (TRAX) and Android TRAX (ATRAX) products. SNC's TRAX and ATRAX products constitute USSOCOM's current solution for an integrated Air/Ground tool that implements coded waveforms to Bi-Direction Translation of Link 16, Situational Awareness Data Link (SADL), and IP Cursor on Target (CoT) that have been tailored for Special Operations Forces (SOF) use on the battlefield objective. These products are currently validated as fully interoperable with the Hand Held Link 16 radio and the Digitally Aided Close Air Support Gateway-SOF (DACASG-S) as displayed through multiple joint exercises and OCONUS operations. TRAX also supports specific message translations required by SOF, and is currently certified by the Joint Interoperability Test Center (JITC) and approved for use for irregular warfare. A determination not to compete this proposed contract was made pursuant to the Federal Acquisition Regulation (FAR) 6.302-1, only one source is capable of satisfying the agency's requirements. This determination is based on the fact that SNC is the original equipment manufacturer (OEM) and sole developer of TRAX and ATRAX software. SNC is the only company that can provide the appropriate software upgrades and level of services/support required for the product such as software patching, upgrade, support installation, integration, training, exercise support, as well as planning, engineering, integration, and software support. Entertaining procurement of a like support capability is untenable for two reasons. First, as the sole developer of TRAX software and owner of full rights to its intellectual property, only SNC can provide the services and support required for the product, such as, software patching, upgrade, support installation, integration, training, exercise support, as well as planning, engineering, integration, and software support during deployment of TRAX in a combat theater. Second, a follow-on support contract from another source would require the wholesale duplication of a solution other than TRAX, which would require unnecessary extensive and expensive new software integration efforts, plus developmental and operational testing. Acquiring a second solution would also increase training costs to make warfighters even minimally proficient on two systems, and the economies of scale inherent in a single solution would also be lost and costs increased. Deployment of a parallel solution would also disrupt combat operations and introduce risks of mission failure. In summary, as the sole developer of TRAX software, only SNC can provide the appropriate software upgrades and level of services and support required for the product such as software patching, upgrade, support installation, integration, training, exercise support, as well as planning, engineering, integration, and software support without mission degradation and significant duplication of costs. This notice is not a formal solicitation or request for competitive proposals. The intent of this notice is for informational purposes only. No solicitation document is available and telephone requests will not be accepted. No award will be made on the basis of quotations or offers received in response to this notice.
