Annex 2 Combined Synopsis/Solicitation J&A Limits of foundation excavation Safe Haven Structural R0 Safe Haven Mechanical Safe Haven Mechanical Safe Haven Electrical Safe Haven Architectural R0 Safe Haven Architectural R0 Foundations Structural Foundations Structural Foundations Structural Foundations Structural The United States Government, represented by the U.S. Agency for International Development (USAID/Lebanon), intends to enter into a contract with Safe Haven Enterprises (SHE) using other than full & open competition in accordance with FAR 6.302-1, for the procurement of a new USAID office trailer identical to the existing trailer that meets Department of State (DOS) FE/BR (Forced Entry / Ballistic Resistance) standards as established by the Department of Sate / Office of Diplomatic Security (DOS/DS). The only qualified entity to supply an FE/BR office space that is identical to the FE/BR certified SHE office, is the company itself- Safe Haven Enterprises (SHE). USAID/Lebanon will solicit a proposal from SHE in accordance with FAR 12.603. Because the synopsis and solicitation are contained in a single document, it is not necessary to publicize a separate synopsis 15 days before the issuance of the solicitation as per FAR 12.603(c)(3)(i) This notice of intent is not a request for competitive proposals. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 Streamlined solicitation for commercial items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is 72026818R00002 and is issued as a Request for Proposal (RFP). This solicitation incorporates Federal Acquisition Regulation provisions and clauses in effect through Federal Acquisition Circular FAC 2005-96. This procurement is in accordance with FAR Part 12 and FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements for procurement of a new USAID office trailer which meets Department of State (DOS) FE/BR (Forced Entry / Ballistic Resistance) standards as established by the Department of Sate / Office of Diplomatic Security (DOS/DS). The North American Industrial Classification System (NAICS) code is 236220, Commercial and Institutional Building Construction, with a small business size standard of $36.5 million in annual receipts for the company and its affiliates (See FAR Part 19 definitions). The proposal must include a quotation of the cost of the required office in the form of a Bill of Quantities (BOQ). Details of the requirements for the new office trailer can be found in Annexes 1 & 2 to the RFP. ALSO THE FOLLOWING CLAUSES APPLY: AIDAR 752.204-71, and Alternate I VETTING REQUIREMENTS OF SUBAWARDEES Prior to the provision of funding by the contractor to its sub-grantees ("sub-awardees "), the contractor shall conduct all screening procedures and due diligence on sub-awardees and key individuals of the sub-awardees, including a check of sub-awardees and such key individuals not screened at the time of award by the Contracting Officer to ensure compliance with Executive Order 13224 and U.S. law prohibiting transactions with, and the provision of resources and support to individuals and organizations associated with terrorism. The contractor will screen names of its sub-awardees and the key individuals of such subawardees against the Specially Designated Nationals List ("SDN" list) administered by the Department of the Treasury's Office of Foreign Assets Control ("OFAC") http://www.ustreas.gov/offices/enforcement/ofac/sdn/; UN's 1267 Committee List on Al-Qaida and the Taliban and Associated Individuals and Entities: http://www.un.org/sc/committees/1267/consolist.shtml ; and State Department's Terrorist Exclusion List: http://www.state.gov/s/ct/list/ (see ADS 303.3.8.a.4 and ADS 303.3.9). "Key individual" means (i)principal officers of the organization's governing body (e.g., chairman, vice chairman, treasurer and secretary of the board of directors or board of trustees); (ii)the principal officer and deputy principal officer of the organization (e.g., executive director, deputy director, president, vice president); (iii)the program manager or chief of party for the USG-financed program; and (iv)any other person with significant responsibilities for administration of the USG-financed activities or resources." NONDISCRIMINATION (JUN 2012) FAR Part 27 and the clauses prescribed in that part prohibit contractors performing in or recruiting from the U.S. from engaging in certain discriminatory practices. USAID is committed to achieving and maintaining a diverse and representative workforce and a workplace free of discrimination. Based on law, Executive Order, and Agency policy, USAID prohibits discrimination in its own workplace on the basis of race, color, religion, sex (including pregnancy and gender identity), national origin, disability, age, veteran's status, sexual orientation, genetic information, marital status, parental status, political affiliation, and any other conduct that does not adversely affect the performance of the employee. USAID does not tolerate any type of harassment, either sexual or nonsexual, of any employee or applicant for employment. Contractors are required to comply with the nondiscrimination requirements of the FAR. In addition, the Agency strongly encourages all its contractors (at all tiers) to develop and enforce comprehensive nondiscrimination policies for their workplaces that include protection on these expanded bases, subject to applicable law. 52.203-99 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS (APR 2015) (a) The Contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect. (c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (d)(1) In accordance with section 743 of Division E, Title VI I, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause. (2) The Government may seek any available remedies in the event the contractor fails to comply with the provisions of this clause. (End of clause) The Contractor is reminded that U.S. Executive Orders and U.S. law prohibits transactions with, and the provision of resources and support to, individuals and organizations associated with terrorism. It is the legal responsibility of the contractor/recipient to ensure compliance with these Executive Orders and laws. This provision must be included in all subcontracts/sub-awards issued under this contract/agreement. Contract Type: The contract resulting from this combined synopsis/solicitation for commercial items will be a Firm Fixed price contract. Contract Term: This contract may commence January 2018, and shall be effective thereafter for the time required to assess conditions, fabricate, ship, assemble, and commission the requirement as described in Section II of this Solicitation. Due to the potential for change in the award date, all proposals are required to remain valid for 180 days after the requested due date. Period of Performance: The period of performance for this contract is the time required to assess conditions, fabricate, ship, assemble, and commission the requirement as described in Section II of this Solicitation. The contract is expected to commence February of 2018. The contract may be terminated by the government with a 30 day written notice to the contractor. The government contact person for all contract notifications, regarding this paragraph, is the USAID contracting officer. (FAR 52.212-4).
