Description
Justification and approval. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPEITION (J&A) Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.302-1, the justification for the use of statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.302-1(b) (3) as follows: 1. Agency and Contracting Activity: Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), Joint Field Office (JFO), 6021 Rio Grande Road, Orlando, FL 32809 proposes to enter into a contract on a basis other than full and open competition. 2. Nature and/or Description of the Action being approved: FEMA has a requirement for one each stretch-octagon shelter to replace the damage one on-hand for Thomasville MERS in response to hurricane Irma in Florida. Compatibility with the other tent on-hand is critical to the mission success of MERS. The shelter must be able to successfully attach to other tents on-hand when applicable. 3. Description of Supplies/Services: The Government requires a stretched-octagon shelter – rigid frame that is 19 feet x 35 feet x 6 feet, 570 square feet usable floor space. It includes shelter frame, roof, etc. The shelter comes with a self-contained and portable HVAC. It provides 42,000 Btu/hr. of cooling and 40,000 Btu/hr. of heating. 4. Identification of Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority permitting only one responsible source and no other supplies or services will satisfy agency requirements is 41 U.S.C. 253 (c)(1), as implemented by FAR 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” 5. Demonstration That the Nature of the Acquisition Required Use of the Authority Cited: MER located in Thomasville provides support throughout FEMA. They are in possession of several sectional style tents with the capability to connect them together. The manufacturer and retailer Western Shelter retails and sells direct to consumer. Market research indicated that the retailer’s prices would far exceed the price if purchased directly from the manufacturer. Pricing will be given under GSA Federal Supply Contract No GS-03F-084CA. FEMA possesses other shelters and compatibility is necessary in order to satisfy the agency requirement to support disasters. There is not a reasonable expectation of receiving more than one quoted from another source. The shelter needed by FEMA is available from only one responsible source and no other type of property will satisfy the needs of the organization. This is within scope and guidance pf 41 U.S.C. 253 (c) (1). 6. Description of Efforts Made To Ensure That Offers Are Solicited From As Many Potential Sources As Is Practicable: The J&A document will be advertised through FedBizOpps to allow industry to know what the agency is requesting and potentially provide fair marketplace alternatives. 7. Determination by Contracting Officer that the Anticipated Cost To the Government Will Be Fair And Reasonable: Prices are located in GSA. GSA already have negotiated pricing and are available to all government agencies. According to GS-03F-0084CA, the prices reflect a 9.5% discount off commercial prices. Price is determined to be fair and reasonable based on GSA pre-negotiated pricing rates. 8. Description of Market Research: No Market research has been performed due to the shelters being manufactured and retailed by one source. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None 10. A Listing of Sources, if Any, That Express, in Writing, an Interest in the Acquisition: N/A 11. Planned Actions to Remove Barriers to Competition for Similar, Subsequent Requirement: Due to the shelters being manufactured and retailed by one company, it would require other manufactures to build to specification that are currently proprietary. 12. Contracting Officer’s Certification: I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
