- sole source justification This NOTICE OF INTENT TO AWARD A NON-COMPETITIVE CONTRACT is in accordance with Federal Acquisition Regulation (FAR) Part 41, Acquisition of Utility Services and FAR Part 13, Simplified Acquisition Procedures. The authority for this award is FAR 13.106(b)(1)(i), Contracting Officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. The Public Utilities Division of the City of Charlottesville, Charlottesville VA is responsible for providing water, collecting wastewater & stormwater, and distributing natural gas to the City of Charlottesville community, including the Federal Executive Institute (FEI) at 1301 Emmet St N, Charlottesville, VA 22903. There are no other authorized vendors in the area certified to provide these services to the City of Charlottesville community. The estimated annual cost of these services is $75,000.00. OPM has coordinated with the GSA Public Building Service Energy Management Contracting Officer to proceed with annual awards to the City of Charlottesville, a state government agency. These services are ongoing and are provided year round. FEI will have a continual need for these services on a yearly basis. Thus the requirement for these services will be coordinated annually with GSA for award of annual contracts for continuation of these services. The Period of Performance shall be for a period of one (1) year commencing on or about January 22, 2018, with subsequent annual follow-on awards. THE PURPOSE OF THIS NOTICE IS TO SATISFY THE REQUIREMENTS OF FAR SUBPART 5.2. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, all responsible parties interested in this procurement must submit a capability statement demonstrating they can provide the required utility services in their entirety not later than 10am EST, Monday, January 22, 2018. Detailed capabilities statements must be submitted, in writing, via email to Debra Overstreet at debra.overstreet@opm.gov. Submissions after that date will not be considered. No solicitation will be issued, therefore, any requests for the solicitation will be considered non-responsive. Interested parties wishing to submit their questions, interest, and capabilities must do so in writing via email. Oral and facsimile requests for information will be considered non-responsive. Verification of receipt of electronic transmission is the sole responsibility of the contractor. A determination not to compete this action based upon responses received is at the sole discretion of the Government. Registration in the System for Award Management (SAM) is required prior to execution of award. If no other viable competitive responses are received, it is Government's intention to issue an award to the City of Charlottesville.
