- The proposed contract action is for services for which the Government intends to solicit with only one source under the authority of FAR 6.302-1. The North American Industry Classification System is 485111 Mixed Mode Transit System. The Department of Veterans Affairs (VA) Strategic Acquisition Center Frederick (SAC-F) intends to award a Firm-Fixed Price (FFP) sole source award to: Washington Metropolitan Area Transit Authority (WMATA), 600 5th Street, NW, Washington, DC 20001. The contract is for VA to participate in the SmartBenefits ® program to provide VA employees with transit benefits services. On April 21, 2000, President Clinton signed Executive Order (E.O.) 13150 titled Federal Workforce Transportation. Section 2 of the E.O. required Federal agencies in the National Capital Region (NCR) to establish a transit pass fringe benefit program for personnel using mass transportation or qualified vanpools by October 1, 2000. Additionally, the Federal Employees Clean Air Incentives Act, 5 U.S.C. 7905, P.L. 103-172, December 2, 1993 (Incentives Act), was enacted as part of a national effort to improve air quality and reduce traffic congestion. The Incentives Act provides for the establishment of programs to encourage Federal employees to commute by means other than single-occupancy motor vehicles. The WMATA shall enroll the VA for participation in the SmartBenefits ® program, which is a Web-based program that will allow VA to assign the dollar values of participants monthly benefits for commuting to and from work directly to the participants SmarTrip ® cards. Commuting benefits may include transit for Metrorail, Metrobus, regional commuter bus and rail systems as applicable, and van pools. VA will access the SmartBenefits ® program via the internet and will enter the amount of transit benefit approved for each participant no later than the fifteenth calendar day of each month. (i.e., VA enters the transit benefit approved on Nov. 15th for the benefits that will be effective for Dec.). The Contractor shall make certified amounts of transit benefits available for each participant to download on his or her SmarTrip ® card by the first calendar day of the month that the benefits are effective. VA will pay the Contractor on a monthly basis for the actual amounts of transit benefits it allocates for its participants for the given month. There is no cost to VA for participation in the SmartBenefits ® program. VA will manage its transit subsidy program, to include determining which of its employees are eligible for commuting benefits and ensuring that WMATA is administering the program in accordance with Internal Revenue Service (IRS) regulations (Qualified Transportation Fringe Benefits Law, Title 26, USC Section 132(f)). VA will provide the following information to the Contractor through the Web-based SmartBenefits ® program so that transit fare will be added to participants SmarTrip ® cards: Full name of each participant Each participant s SmarTrip ® card number Amount of transit benefit approved for each participant (benefit category type) Start date for each participant s benefits User-defined key (In the VA, this will be each participant s organizational code.) VA agrees that value added to SmarTrip ® cards through SmartBenefits ® may only be used by qualified employees who receive the benefit from their employer or a WMATA agent. There shall be no minimum purchase imposed on VA for participation in the SmartBenefits ® program. The Contractor shall provide training on the SmartBenefits ® system onsite at VA offices in Washington, DC for up to ten (10) VA Board employees per session, as requested by VA. These will be on an ad-hoc basis and will not exceed two trainings per fiscal year. The SmartBenefits ® system shall include a reporting function to allow VA to access and generate its own report(s) on an as-needed basis to verify transit benefit balances. The Contractor shall set up the VA Board s account for participation in the Web-based SmartBenefits ® program within seven (7) calendar days of award. The Contractor shall assign a customer account number, user identification, and password to the VA Board s COR immediately upon setting up the account. The Contractor shall provide VA access to their SmartBenefits Anytime features on their SmartBenefits online system. Currently, there is only one responsible source and no other to supply the required services that will satisfy the agency requirement. This is a sole source notice published for informational purposes only and not a request for proposals. Therefore, no solicitation documents exist for this requirement and telephone requests will not be accepted. However, interested parties may identify their interest and capability to respond to this requirement no later than February 2, 2018, 11:00am EST. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
