Description
Notice of Intent to Extend International Rule of Law Contracts Without Full and Open Competition The United States Agency for International Development (USAID) intends to extend the ordering period and the performance period of the International Rule of Law Indefinite Quantity Contract (IQC) by one (1) year without full and open competition. This extension will not increase the IQC ceiling of $500,000,000. The authority for this extension is AIDAR 706.302-70(b)(5), which authorizes a waiver to the full and open competition requirement for an award for the continued provision of highly specialized services when award to another resource would result in substantial additional costs to the Government or would result in unacceptable delays. The statutory authority is 40 U.S.C. 113. The ordering period for the Rule of Law IQC is set to expire on February 7, 2018. The extension of the ordering period by one (1) year to February 7, 2019 and the extension of the performance period by one (1) year to February 7, 2022 will allow USAID Missions to procure specialized Rule of Law technical services, such as development assistance programs and assessments that focus on justice sector reform, access to justice, legal services, legal and legislative reform, government accountability for corruption through prosecutions for criminal activity, and other country-specific interventions. Of the $500 million IQC ceiling, there is approximately $50 million still available for use. USAID intends to extend the following Rule of Law IQCs to allow for the issuance of new task orders or modification to existing task orders, as appropriate and in accordance with fair opportunity procedures: AID-OAA-I-13-00024 - AMEX International Incorporated AID-OAA-I-13-00029 - Millennium DPI Partners, LLC AID-OAA-I-13-00030 - Democracy International, Inc. AID-OAA-I-13-00032 - Chemonics International, Inc. AID-OAA-I-13-00033 - Development Alternatives, Inc. AID-OAA-I-13-00034 - Checchi and Company Consulting, Inc. AID-OAA-I-13-00035 - East West Management Institute AID-OAA-I-13-00036 - Tetra Tech DPK Casals & Associates, Inc. (AID-OAA-I-13-00039), a contract holder of the IQC, will not be included in this extension. USAID conducted a full and open competition for the Rule of Law IQC prior to contract award in 2013. IQC holders routinely include comprehensive consortia on task order proposals, especially when very specialized experience or expertise is required for the project. The IQC holders, and their consortia partners, have demonstrated their unique qualifications and ability to respond to USAID's Rule of Law programming and assessment needs. Missions that had planned to use the IQC mechanism for programs will face delays in programming and potential funding implications if they use a full and open contracting competition, which would impair vital U.S. Foreign Aid programs in countries currently recovering from conflict, and also facing instability, which will be addressed through these programs. In addition, having an open IQC will allow for missions to request Rule of Law assessment services for urgent priorities, or in response to requests by Embassy leadership to provide technical leadership in the Justice sector, such as an assessment. Using the IQC mechanism will save time and money for Mission staff as it will reduce procurement time and the administrative burden on all staff involved. The extension will not raise the IQC ceiling, rather, it will allow Missions to solicit Rule of Law programs under the IQCs through a fair opportunity process in a timely manner, consistent with their out year planning. USAID plans to conduct a full and open competition for a new mechanism containing a Rule of Law component in 2018. The scope and duration of this mechanism is currently under discussion. To meet the immediate needs of several Missions worldwide to address the Rule of Law assessment and program services for urgent priorities or in response to requests by field Embassy leadership to provide technical leadership in the Justice sector, the extension of the ordering period and the performance period under the existing Rule of Law IQC is critical to meet the Agency objectives aimed at addressing the Rule of Law and Justice issues worldwide. All responsible sources may submit a written expression of interest which shall be considered by USAID. The Government will consider responses received by the established due date and time set forth in this notice. Only written inquiries or expressions of interest will be accepted via e-mail to Ms. Leigh Carlson, Contract Specialist, at lcarlson@usaid.gov. No telephone requests will be honored. A determination by the Government to extend the existing Rule of Law contracts without full and open competition based upon responses to this notice is solely within the discretion of the Government.
