Description
Modification 2 Modification of the Solicitation for a Both a Temporary Contract One Year for the 2018 operating season and a Ten Year Concession Business Opportunity for Marina Slip Rentals, Food and Beverage Services, Retail Sales and Camping Services within Fire Island National Seashore. This modification announces the following: • The NPS will conduct a site visit of the concession operations sites on March 13, 2018. • The NPS will accept questions until March 16, 2018 by 4:00 PM Eastern Time and will respond to these questions in writing. • The NPS extends the deadline for proposals until April 16, 2018 by 4:00 PM Eastern Time. • The NPS anticipates offering a Temporary Contract will solicit expressions of interest for operating the concession for one season beginning in May 2018. • Several questions were received, and the NPS is providing answers through this Modification. Site Visit The NPS cancelled the originally scheduled site visit due to inclement weather. The new site visit date is March 13, 2018. If you are interested in participating in the rescheduled site visit, please email Kathleen_Karhnak-Glasby@nps.gov with the number in your party. The site visit will depart from the ferry terminal in Patchogue, NY the morning of March 13. You will receive further logistical information after you request to participate. Questions accepted The NPS will accept questions in writing until March 16, 2018 by 4:00 PM Eastern Time. This will allow for site visit participants to submit questions from the site visit. The NPS will post answers in writing to the questions received by that deadline. Deadline for proposals The NPS will accept proposals for the CC-FIIS007-19 prospectus that are received no later than April 16, 2018 at 4:00 PM Eastern Time. This extends the deadline by approximately one month. Temporary Contract As mentioned in the Business Opportunity, the NPS intends to authorize these visitor services for 2018 through a Temporary Contract. If you want to be considered for the Temporary Contract, please submit an expression of interest no later than April 16, 2018 at 4:00 PM Eastern Time. Guidance for submitting expressions of interest are attached to this Modification. Responses to Questions received to date: The NPS received the following questions and is providing these responses. 1. Regarding the Temporary Contract for the 2018 season that is mentioned in the prospectus, does the NPS know at this time who the Concessioner will be for the TC? If so, what operator? If not, how will the NPS find an operator for the TC who is willing to sign on for just one season? Also if not, by what date does the NPS plan to determine who will be the Concessioner for the 2018 TC? The NPS does not know at this time who the Concessioner will be for the temporary contract. The NPS is accepting expressions of interest for the temporary contract. We do not have a firm date by which a decision will be made in regards to the temporary contract operator. 2. Will the delay in the site visit date have any effect on the due date for questions and/or the due date for proposals for this solicitation? If so, please explain. The NPS has decided to extend the deadline for submitting proposals, with proposals now due April 16, 2018 by 4:00 PM Eastern Time. 3. Would you have a sample FMMS report or specifications of report that a Concessioner would have to submit? The NPS does not have a sample FMMS report. The Concessioner's CMMS system should be responsive to the information required in the Draft Contract. The relevant sections of the Draft Contract include, but are not limited to, Exhibit H, Part A (4) and Exhibit H, Part D. 4. Any possibility of expanding the maximum page counts that were shortened as compared with the previously released prospectus? The NPS is adjusting the page limits for the following Selection Factors: • Responses for PSF 1 must not exceed 12 pages. • Responses for PSF 2(a) must not exceed 12 pages. 5. How does the payment from the Concessioner to the Government work? Is it monthly, quarterly or at the end of the season? Draft Contract, Section 11 (b) states: (1) The franchise fee shall be due on a monthly basis at the end of each month and shall be paid by the Concessioner in such a manner that the Director shall receive payment within fifteen (15) days after the last day of each month that the Concessioner operates. This monthly payment shall include the franchise fee equal to the specified percentage of gross receipts for the preceding month. (2) The Concessioner shall pay any additional fee amounts due at the end of the operating year as a result of adjustments at the time of submission of the Concessioner's Annual Financial Report. Overpayments shall be offset against the following year's fees. In the event of termination or expiration of this Contract, overpayments will first be offset against any amounts due and owing the Government and the remainder will be paid to the Concessioner. (3) All franchise fee payments shall be deposited electronically by the Concessioner in accordance with Applicable Laws. 6. Is it okay to use ReserveAmerica as the reservation system? The Operator can use any reservation system that meets the requirements of the Draft Contract. The requirements for campground reservations include: • Availability - Reservation services are available via telephone, mail, and fax during business hours; and internet 24/7. • Knowledge of Campground Staff - Staff provide accurate information about rates, cancellation policies, departure and arrival times, amenities and services, local attractions, access, etc. Matching information is available on the Concessioner's website. • Confirmation - Reservations calls include a confirmation number. E-mail is sent to confirm the reservation and provide park information. • Length of Stay - Maximum length of stay limits are enforced. Length of stay regulations are disclosed at the time of reservation. Length of stay exceptions are approved by the park. • Payment Methods - Credit cards are honored and include MasterCard, Visa, American Express, and Discover. Debit cards and other payment methods (travelers' checks, personal checks, and gift cards) are accepted at the Concessioner's discretion or at the direction of the Service. • Deposits - Deposit policies are approved by the park, and deposit information is disclosed at the time of the reservation. • Rate Changes - Advance rates are honored, and campers are refunded the difference if the rate is lower than the anticipated rate. • Cancellations - The cancellation and refund policy is clearly stated in the reservation, and is approved by the park. The requirements for marina reservations include: • Availability - Reservation services are available via telephone, mail, and fax during business hours; and internet 24/7. • Knowledge of Slip Rental Staff - Reservation agents provide accurate information about rates, slip rental policies and marina services, local attractions, access, etc. Matching information is available on the Concessioner's website. • Property Management Information Systems - The slip reservation system is integrated with the Concessioner's property management information system, and provides comprehensive reporting capabilities. • Payment Methods - Credit cards are honored and include MasterCard, Visa, American Express, and Discover. Debit cards and other payment methods (travelers' checks, personal checks, and gift cards) are accepted at the Concessioner's discretion or at the direction of the Service. • Deposits - Rental deposits are no more than one month's dockage. For transient slips, the rental deposit of one night's stay is applied to the last night of the rental. • Cancellations - The slip rental cancellation and refund policy is clearly stated in the slip rental agreement, and is approved by the park. 7. Is the Concessioner allowed to subcontract/lease the store and restaurant space? The Draft Contract, Section 19(c) states that: Subconcession or other third party agreements, including management agreements, for the provision of visitor services required and/or authorized under this Contract are not permitted. 8. Are the living quarters on Fire Island an additional rental amount or is it included in the contract percentage? Should the Concessioner choose to use this housing, it will enter into a housing agreement that requires the Concessioner to pay the Park for the housing. Because the housing is not included in Concession Facilities assigned by the Service, the Concessioner has no maintenance responsibilities for the facilities other than maintaining them in a clean and habitable condition.
