Description
SSI ENGAGEMENT DAYS TSA will be hosting 3PK9-Cargo SSI Engagement Days on April 17 and 18, 2018 to present the framework and requirements of the 3PK9 Teams and Certifiers. These requirements will specifically be Sensitive Security Information (SSI) and therefore governed under Title 49 Code of Federal Regulations (CFR) 1520. Please find event details below: TSA is hereby soliciting canine industry interest, in serving as a 3PK9 Certifier or 3PK9 Team Provider, and invites interested canine stakeholders to attend. As with previous 3PK9 Engagement Days, available meeting space is limited and TSA will only be able to accommodate a single attendee from each canine stakeholder. Additionally, TSA is limiting participation to stakeholders who intend to operate in either capacity: 3PK9 Certifier or 3PK9 Team Provider. Advanced registration is mandatory. Please review the requirements below carefully; these will be discussed during the 3PK9-C SSI Engagement Days. Scope: The process for initial 3PK9 Certifier applications occurs during the TSA 3PK9-Cargo SSI Engagement Days. The intent of the meetings is to allow canine-specific stakeholders the ability to determine if they are able to comply with the third-party certified requirements and practices given their own business models, within the constraints of sharing SSI. TSA still does not intend to directly certify any 3PK9-C Teams. Therefore, 3PK9-Certifiers will be required to establish business relationships with 3PK9 Team Providers and Aviation Industry without TSA involvement. At a later date, TSA will begin accepting written 3PK9 Certifier applications. During this timeframe, the stakeholders' application will be reviewed by the TSA selection board, and personnel and company vetting activities will occur. Potential TPCCOs: 3PK9 Certifiers and 3PK9 Team Providers will have an overview of TSA standards and requirements on April 17. On April 18, TSA will have open discussions with potential 3PK9 Certifiers. SSI Engagement Day Submission: By attending these 3PK9 SSI Engagement Days, canine stakeholders will be participating in preliminary application processes for 3PK9 Certifiers. These discussions will allow potential 3PK9 Certifiers to determine if SSI requirements (not previously shared) effect their ability to apply and participate to become a 3PK9 Certifier. All non-TSA Stakeholders need to submit a preliminary security threat assessment application and TSA has to deem the company & its attendees are eligible for access to SSI prior to acceptance to attend. Please complete the information below for each attendee and submit to 3PKCert@tsa.dhs.gov no later than 1000 hours Eastern time on April 2th, 2018, the information listed, below. The STA application and NDA must be completed and returned to 3PK9Cert@tsa.dhs.gov no later than 1000 hours Eastern time on April 5th, 2018.: 1. The following company information: a. Company Name b. CAGE code c. DUNS number d. Address e. Point of Contact Name f. Phone Number g. Email Address h. Business Model intent either 3PK9 Certifier or 3PK9 Team Provider (Any format) 2. The following information for the company employee who will be attending the event: a. Employee Full Name b. Title / Position c. Employee Gender (i.e., Male or Female) d. Employee Birth Date e. Employee Citizenship f. Social Security Number g. Indication of whether the nominated employee has: i. Previously received a TSA suitability determination; ii. Undergone a federal background investigation; or iii. Possess an individual security clearance Failure to furnish the requested information may delay or prevent the completion of the security threat assessment, without which access to the SSI may not be granted. Once TSA has deemed the attendee eligible for access to SSI, the attendee will receive the location, an Security Threat Assessment (STA) Application, a DHS Form 11000-6 Non-Disclosure Agreement (NDA), and the SSI Engagement Days schedule from the 3PK9Cert@tsa.dhs.gov. Security Vetting: Concurrently with the application process, the potential 3PK9 Certifiers and 3PK9 Team Providers, and their respective attending employee will also be subject to Preliminary STA required to receive and handle SSI during the 3PK9-C SSI Engagement Days Event, to ensure that the corporate entity would not otherwise be precluded from receiving SSI. Interested stakeholder attendees must obtain specific authorization in order to view SSI. SSI will not be available or otherwise provided or disclosed to any person not specifically authorized. If it is determined that an employee is not eligible to receive access to particular SSI based on the threat assessment, TSA will notify the company point of contact that the individual does not qualify to receive SSI. Appeal of the determination will not be permitted due to the time sensitive nature of the event. Non-Disclosure Agreements: Once the SSI access STA applicant/attendee (assumed to be senior corporate official) is deemed eligible, TSA will require DHS Form 11000-6 Non-Disclosure Agreement. This Form must be returned prior to attendance of the 3PK9-C SSI Engagement Days Event. The stakeholder should understand that employees granted access to SSI and signing a non-disclosure agreement are bound by the terms of that agreement indefinitely, notwithstanding their employment status or any other background checks or clearances granted by any Government agency. Return of SSI: Any SSI provided to the attendees must be returned to the Government and verified by the Government, prior to leaving the event. Any attendee not returning SSI provided directly to them will be subject to penalties as prescribed by law and otherwise rendered ineligible for further consideration in the evaluation. Clarification on Funding: To clarify, TSA will not fund the 3PK9 Certifiers nor will TSA fund 3PK9 Team Providers operations. The aviation and canine stakeholders will need to establish the appropriate business models to further canine screening of air cargo that complies with TSA regulatory requirements.
