Description
Justification for an Exception to Fair Opportunity - Sustainment of FCMT, FBSR, and VTA 2 of 2 Control Number TAC-18-50019 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm-fixed price (FFP) Task Order (TO) for a 90-day period of performance in order to continue providing operations and maintenance (O&M) services for the Federal Case Management Tool (FCMT), Veterans Tracking Application (VTA), and Fiduciary Beneficiary System Replacement (FBSR) applications. The proposed effort will be awarded under Transformation Twenty-One Total Technology Next Generation (T4NG) Indefinite-Delivery Indefinite-Quantity (ID/IQ) contract VA118-16-D-1007 to Booz Allen Hamilton, Inc. (BAH). 3. Description of the Supplies or Services: The proposed action is to provide the following operations and maintenance services for all three of the above applications: Configuration Management, Application Maintenance, Trouble Ticket Evaluation, Software Repair, Software Testing, Software Release, Interface Maintenance, Information Security Analysis, Security Management, and Application Training. This TO will provide a bridge between the current Sustainment of FCMT, FBSR, and VTA TO (VA118-11-D-1008 / VA118-1008-0071), which currently expires on March 25, 2018, and three new competitively awarded TOs for sustainment. The new TOs are anticipated to be awarded no later than May 25, 2018. The period of performance of the proposed TO will be March 26, 2018 through June 25, 2018. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(3) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: The proposed source for this action is BAH. The expiring TO was awarded competitively to BAH on March 26, 2015. BAH has been providing O&M services on the three applications (FCMT, VTA, and FBSR) for the past three years. There is a Phase-Out Knowledge Transfer Option on the current TO that was originally planned to be exercised simultaneous with the award of the three new competitive TOs. The current procurement schedule for the award of the new TOs does not project that this plan will be possible, as there have been unanticipated delays in awarding the competitive TOs. Specifically, the interface between the Department of Defense (DoD) and the VA has recently changed and the VA needed to capture those interface requirements as part of the new PWS. The PWS was recently updated to reflect those new requirements. Only BAH can meet all of the current VTA, FCMT, and FBSR requirements in the timeframe required. Any other source would require significant time for onboarding and ramp-up to meet VA s requirements. VA anticipates that any other source would require a minimum of three months to conduct the aforementioned onboarding and ramp-up. BAH has worked closely with the technical and functional resources in VA since the TO s inception and has gained significant knowledge of the VTA, FCMT, and FBSR systems that is critical to providing successful O&M support. BAH has worked with the external DoD contacts and have established a working relationship that is critical to completing the interface change between DoD and the VA. Any other source would need to conduct a new and comprehensive evaluation of the current environments, re-create processes already being performed by BAH, re-create reporting mechanisms, and ensure all personnel have property security clearances. An extension of support under the current TO (by way of a new sole source TO since the original T4 ID/IQ can no longer accommodate new work) would allow BAH to continue to provide critical O&M services as well as transition support to the new contractor(s) for the new competitively awarded TOs as originally planned. To bring in a different contractor at this critical phase would directly impact VA s ability to support the Veteran for the reasons described above. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional potential sources that could meet the Government s requirements for seamless support while the competitive procurement is solicited and awarded. Due to the critical need for continuity of support, there is no competition anticipated for this acquisition. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will be synopsized and the justification will be made publically available within 14 days of award on the Federal Business Opportunities Page. 7. Actions to Increase Competition: Barriers to future competition are not anticipated. Competitive TOs for VTA, FCMT, and FBSR support are anticipated to be awarded no later than May 25, 2018, and future acquisitions will be awarded on a competitive basis. 8. Market Research: Market research was conducted in January and February 2018 to ascertain if any other source could provide the aforementioned services in the timeframe required. While other sources provide similar services, such as those that responded to Requests for Information on the three competitive procurements or potentially any other T4NG vendor, no other source can provide the required services as outlined in section 5 of this justification. Only BAH can ensure immediate and seamless support for the VTA, FCMT, and FBSR applications while the competitive procurements are awarded, which is critical to meeting VA s mission objectives. 9.
