Description
Statement of Work (SOW) I. SCOPE OF WORK: The Contractor shall provide all updates, upgrades, and repairs (via shipment to Sun Nuclear); software license renewal; and phone and web-based technical support on the Government owned Sun Nuclear ArcCHECK detector array which quantifies beam quality of the Radiation Oncology linear accelerator beams. The Contractor shall also provide updates, software license renewal, and phone and web-based technical support for the 3DVH software package. This equipment is in Radiation Oncology at the Ann Arbor VA Medical Center, 2215 Fuller Road, Ann Arbor, MI 48105. Note: Device is not user serviceable. Emergency repairs will need to take place at Sun Nuclear (Original Equipment Manufacturer), in Melbourne, FL. Contractor will provide complimentary ArcCHECK service loaner if the Government owned ArcCHECK is shipped to Sun Nuclear for repair. II. CONFORMANCE STANDARDS: All services provided under this contract must be performed in conformance with the National Fire Protection Agency (NFPA), Occupational Safety and Health Administration (OSHA), and Original Equipment Manufacturer standards and specifications. III. HOURS OF WORK: A. Hours of Work for preventive maintenance and emergency repairs are defined as Monday through Friday from 7 a.m. to 5 p.m., excluding federal holidays, or as otherwise arranged with the Contracting Officer Technical Representative. B. The ten holidays observed by the Federal Government are New Year's Day, Martin Luther King Day, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day. Also, any other day declared by the President of the United States to be a national holiday. IV. PREVENTIVE MAINTENANCE: On Site Preventative Maintenance is not needed for equipment and not offered by SNC (OEM). V. EMERGENCY REPAIR SERVICE: A. Service shall consist of maintaining the equipment in accordance with the Conformance Standards Section (Section II). Repair service shall consist of replacing parts, calibration, cleaning, oiling, adjusting and maintaining the equipment. B. The Contracting Officer and COR have the authority to approve/request a service call from the Contractor. Note: On-Site Service is not needed or offered by SNC (OEM). VI. SAFETY REQUIREMENTS: In the performance of this contract, the Contractor shall take such safety precautions as the COR may determine to be reasonably necessary to protect the lives and health of occupants of the building. The COR shall notify the Contractor of any safety issues and the action necessary to correct these issues. Such notice, when served on the Contractor or his representative at the work site shall be deemed sufficient for the corrective actions to be taken. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work, and hold the Contractor in default. A.1 52.219-14 LIMITATIONS ON SUBCONTRACTING (NOV 2011) (a) This clause does not apply to the unrestricted portion of a partial set-aside. (b) Applicability. This clause applies only to (1) Contracts that have been set aside or reserved for small business concerns or 8(a) concerns; (2) Part or parts of a multiple-award contract that have been set aside for small business concerns or 8(a) concerns; and (3) Orders set aside for small business or 8(a) concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F). (c) By submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for (1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern. (2) Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials. (3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees. (4) Construction by special trade contractors. The concern will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees. (End of Clause) 52.242-5 PAYMENTS TO SMALL BUSINESS SUBCONTRACTORS (JAN 2017) (a) Definitions. As used in this clause Reduced payment means a payment that is for less than the amount agreed upon in a subcontract in accordance with its terms and conditions, for supplies and services for which the Government has paid the prime contractor. Untimely payment means a payment that is more than 90 days past due under the terms and conditions of a subcontract, for supplies and services for which the Government has paid the prime contractor. (b) Notice. The Contractor shall notify the Contracting Officer, in writing, not later than 14 days after-- (1) A small business subcontractor was entitled to payment under the terms and conditions of the subcontract; and (2) The Contractor (i) Made a reduced or untimely payment to the small business subcontractor; or (ii) Failed to make a payment, which is now untimely. (c) Content of notice. The Contractor shall include the reason(s) for making the reduced or untimely payment in any notice required under paragraph (b) of this clause.
