- Revised PWS reflects the first meal to be served 12 May 2018. COMBINED SYNOPSIS/SOLICITATION This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, Acquisition of Commercial Items, and using Simplified Acquisition Procedures found at FAR 13. This instant requirement will be solicited as a 100% small business set-aside. The Government intends to award a Firm Fixed Price contract in support of this effort per Attachment I, Performance Work Statement, Attachment II Breakfast menu, Attachment III Lunch menu and Attachment IV Dinner menu. This announcement constitutes the only solicitation on FedBizOpps; quotes are being requested and a written solicitation will not be issued. The requirement is for catering services at Stennis Space Center in Stennis, MS from 11 May 2018 through 25 May 2018. First Meal (DINNER to be served 12 May 2018) Solicitation H92240-18-Q-2027 is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-97, effective 24 January 2018 and DFARS Change Notice 20180323, effective 23 March 2018. NAICS code 722330 Small business size standard $11.0 Mil CLIN Structure: CLIN 0001 Total Cost Catering Services $ ADDENDUM TO 52.212-1 INSTRUCTIONS TO OFFERORS COMMERCIAL ITEMS Quote Preparation and Submission Instructions. (1) Quotes shall be directed to the Contracting Office by email, citing at a minimum "H92240-18-Q-2027" in the subject line at the following address: NSWK2@SOCOM.MIL. (2) Quotes shall be submitted in accordance with the instructions herein, and non-conformance with the specified required content may be cause for rejection of the quote. The quote shall be valid for no less than 90 days from the date of RFQ closing, a statement affirming this fact shall be included in the Introduction. The quote shall provide comprehensive responses to the areas provided for in this section. The quote shall be a complete response to the requirements of this RFQ, taking into consideration required quantities and delivery schedules specified in this solicitation. (3) Quoters must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale in their quote. Quote Format And Content. The quotation shall consist of 3 parts: (I) Introduction, (II) Technical, and (III) Price information. Electronic quotes shall contain separate files for each volume. Individual emails shall not exceed 10 MB. The quote page format will be 8 1/2" x 11" except for fold-outs used for charts, tables, or diagrams, which may not exceed 11" x 17". A page is defined as one face of a sheet of paper containing information. Type shall not be less than 12 pitch. Elaborate formats or color presentations are not desired or required. (1) INTRODUCTION: Complete business address of the Quoter, the corporate name to be used on any resultant contract, and the remittance address if different from that above. If this name does not identify a "parent company" or sponsoring "corporation" name, also provide such identity, as appropriate. The Quoter's Commercial and Government Entity (CAGE) Code and Dun & Bradstreet (DUNs) Number. Name, telephone numbers and e-mail address of person(s) to be contacted for clarification or questions to the quote. Fill-In Clauses: Provide all fill-ins or certifications required by the solicitation for inclusion in any resulting contract. Vendors must be registered in the System for Award Management (SAM) to be eligible for award; Quotes received without the completed copy of the provision at FAR 52.212-3 ALT I or completed SAM representation may be considered non-compliant. Quoters must also provide all fill-ins for: 5652.204-9000 INDIVIDUAL AUTHORIZED TO SIGN Terms and Conditions: The Quoter must include a statement that it either (a) agrees to the terms and conditions of this solicitation (which consists of the entire RFQ, including all documents, exhibits, and other attachments that are incorporated therein by reference and made a part thereof) and any solicitation amendments; or (b) takes exceptions to any terms or conditions of the solicitation, and clearly identifies those exceptions. Exceptions to any of the terms and conditions of this RFQ may be considered by the Government to be unacceptable. Specific quote validity period. (2) Factor 1 - Each quoter shall demonstrate their ability to meet the minimum requirements identified in section 4.2 of the Performance Work Statement (PWS). Specifically, the quoter must provide a detailed meal schedule that meets paragraphs 4.2.1 through 4.2.7 includes the command approved meal items included in Attachments II through IV (breakfast, lunch, and dinner). (3) Factor 2 - Price. The Quoter shall provide firm-fixed prices including all labor, materials, travel (if required), and overall cost to meet the requirements. The Government may require additional "other than cost and pricing data" prior to award. Restriction on disclosure and use of data. Quoters that include in their quotes data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall - (1) Mark the title page with the following legend: This quote includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed -- in whole or in part -- for any purpose other than to evaluate this quote. If, however, a contract is awarded to this quoter as a result of -- or in connection with -- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and (2) Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this quote. (p) To be considered timely. E-mail quote must be received in its entirety in the above designated E-mail inbox by the due date and time for final quote submission. An E-mail quote that resides on a Government server, but has not appeared in the designated E-mail inbox by the due date and time for quote submission will be considered late. Therefore, it is incumbent upon the Quoter to ensure that its entire quote is received by the Agency by the designated due date. (End of provision) 52.212-2 Evaluation -- Commercial Items (OCT 2014): (a) The Government will award a purchase order resulting from this competitive RFQ to the offeror who is deemed responsible in accordance with FAR Part 9, whose quote conforms to the solicitation's requirements, and is the lowest evaluated price with an "Acceptable" rating in the technical factor. If an offeror fails to meet all solicitation requirements, the Government may not make an award to that offeror. The successful quote shall be rated as Acceptable in Technical and be the lowest price. The following factors shall be used to evaluate offers. Technical are equal to Price and when combined, Technical are equal to Price. Factor I: Technical (Acceptable/Unacceptable) Factor II: Price For efficiency purposes, the Government will evaluate a minimum of the three (3) lowest priced offerors for technical acceptability. If the three lowest priced technically acceptable offerors are evaluated with an Acceptable rating, and are determined to be responsible in accordance with FAR 9.104, the evaluation process will stop at this point. If one of the three (3) lowest priced offerors is determined to be Unacceptable in technical or is determined to be non-responsible in accordance with FAR 9.104, the next lowest priced offeror will be evaluated for technical acceptability and the process will continue (in order of price ranking) until three offerors are evaluated as having Acceptable technical and are determined responsible. Factor I - Technical: Each quoter shall demonstrate their ability to meet the minimum requirements identified in section 4.2 of the Performance Work Statement (PWS). Specifically, the quoter must provide a detailed meal schedule that meets paragraphs 4.2.1 through 4.2.7 includes the command approved meal items included in Attachments II through IV (breakfast, lunch, and dinner). The technical quotes will be rated acceptable or unacceptable using the ratings and descriptions outlined in the table below. In order to be considered Acceptable, quoters must receive an acceptable rating for the technical factor in its entirety. Quotes that fail to meet the requirements in Attachment 1 will be considered Unacceptable. Rating Description Acceptable The quote meets the minimum requirements identified in section 4.2 of the PWS and Attachments II - IV. Unacceptable The quote does not meet the minimum requirements identified in paragraph 4.2 of the PWS and attachments II - IV. Factor II - Price Evaluation Criteria: Price quotes will be evaluated on the basis of price reasonableness in accordance with FAR 13. Quoters responding to this solicitation are advised that, prior to award, the government may request quoters to submit additional information/data to support price reasonableness such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price list with effective date and/or copies of catalog pages along with any applicable discounts. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. As used in this provision-- "Administrative merits determination" means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. "DOL Guidance" means the Department of Labor (DOL) Guidance entitled: "Guidance for Executive Order 13673, ‘Fair Pay and Safe Workplaces' ". The DOL Guidance, dated August 25, 2016, can be obtained from www.dol.gov/fairpayandsafeworkplaces. "Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program. "Enforcement agency" means any agency granted authority to enforce the Federal labor laws. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Predecessor" means an entity that is replaced by a successor and includes any predecessors of the predecessor. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Sensitive technology- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and (2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)). "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran. (3)(i) If the box at paragraph (s)(2)(ii) of this provision is checked and the Contracting Officer has initiated a responsibility determination and has requested additional information, the Offeror shall provide-- (A) The following information for each disclosed labor law decision in the System for Award Management (SAM) at www.sam.gov, unless the information is already current, accurate, and complete in SAM. This information will be publicly available in the Federal Awardee Performance and Integrity Information System (FAPIIS): (1) The labor law violated. (2) The case number, inspection number, charge number, docket number, or other unique identification number. (3) The date rendered. (ii)(A) The Contracting Officer will consider all information provided under (s)(3)(i) of this provision as part of making a responsibility determination. (B) A representation that any labor law decision(s) were rendered against the Offeror will not necessarily result in withholding of an award under this solicitation.
