Description
The VA Network Contracting Office (NCO) 22 submits a notice of intent to award a single-source, firm-fixed-price contract to Ninepoint Medical Inc. for preventive maintenance and intervening service coverage on NVision-VLE Optical Imaging Console. The Department of Veterans Affairs (VA), VA Loma Linda Healthcare System (VAGLAHS) requires a contractor to provide full maintenance services of the Ninepoint Medical Inc. s NVision-VLE Optical Imaging Console for a base year and up to two one-year options at the discretion of the Government that begins September 15, 2018. Scope of Work: The Contractor shall provide the following, but not limited to: The Contractor shall provide all necessary labor, materials, supplies, parts, software (needed for the general operation of the equipment), tools, equipment, travel, transportation expenses and other related costs to provide Preventive Maintenance Inspection (PMI) and Intervening Services on selected Government Own Ninepoint Medical s NVision-VLE Optical Imaging console at the participating facilities listed herein of the Veterans Integrated Service Network (VISN) 22. Equipment: NinePoint Medical Inc. NVision VLE (volumetric laser endomicroscopy) Item#:941301, EE#:67092; S/N#: 101220150058. Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government and would not be cost or time prohibitive. (a) Gray market items are Original Equipment Manufacturer s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers.   No remanufactures or gray market items will be acceptable.  (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM.   All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.   Accordingly, the  VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to  replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.   The determination not to compete this proposed contact action is solely within the discretion of the Government. Information received will be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs associated with responding to this notice. This is NOT a request for quotes or proposals, and this is NOT a solicitation. See attached document for further details. Information received as a result of this notice will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Such information received must be clear and convincing evidence that a single source is not justifiable. This notice does not represent a commitment by the Government to pay for costs incurred in the preparation and submission of information or any other costs incurred as a response to this announcement.
