- The Federal Bureau of Investigation (FBI) intends to award a sole source contract to Hubstream, Inc. of Bellevue, WA for the upgrade and maintenance of the Hubstream Intelligence Server Software, formerly known as Child Exploitation Tracking System (CETS). This FBI currently owns the software licenses. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-89, the North American Industry Classification (NAICS) is 511210 with a business size standard of 6.5 million dollars. A quote is being requested under solicitation no. DJF-18-0600-PR-000986 using the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in and attached to this notice. This will be a fixed price contract for a base and three option years. The period of performance is 7/7/2018 - 7/6/2019 with three 12 month option years. Based on FBI market research, it has been determined that Hubstream, Inc. is the only source to meet the FBI requirement and no other supplies or services will satisfy the agency requirements. Hubstream, Inc. is the sole provider of Hubstream Intelligence Server, a proprietary software solution formerly known as Child Exploitation Tracking System (CETS). Hubstream, Inc. does not currently employ resellers of the product, therefore no other organization can currently offer licenses of their software. The proposed contract action is used to identify, enhance and develop innovative technological approaches to combat child exploitation materials online while providing other Agencies with advanced tools and technologies in an effort to combat child online sexual exploitation with only one source under the authority of TLE 41, USC (c)(1). This notice is not a request for competitive proposals. Interested parties my identify their interest and capability to respond by submitting a proposal to include technical qualifications and experience/pricing and any other information to Andrea K. Walker, Contracting Officer, and address listed above. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1, Instructions to Offeror-Commercial Items (JAN 2017); FAR clause 52.212-2, Evaluation Commercial Items (OCT 2014), FAR clause 52.212-4 Contract Terms and Conditions- Commercial Items (JAN 2017); FAR 52.212-5 clause, Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Items (JAN 2017). Each offeror shall include a complete copy of the clause FAR 52.212-3 Offeror Representations and Certifications - Commercial Items (JAN 2017). A determination by the Government not to compete this proposed requirement is based upon responses to this notice and is solely within the discretion of the Government.
