Description
PERFORMANCE WORK STATEMENT FOR LAW ENFORCEMENT SERVICES GENERAL INFORMATION: Clinton Lake is a flood control reservoir located on the Wakarusa River in northeast Kansas. The Lake spans two county boundaries: Douglas and Shawnee. Clinton Lake is located 1mile west of Lawrence, Kansas, 45 miles west of Kansas City, and 20 miles east of Topeka:, Kansas. A map of Clinton Lake can be found on the internet at: http ://www.nwk.usace.army.mil/cl/. Five parks around the lake are managed and maintained by the Corps of Engineers. These parks include roads, utility systems, campsites, beaches, boat ramps, picnic grounds, and playground areas. In addition to Corps-managed areas, the Corps also maintains active lease agreements with the Kansas Department of Wildlife and Parks, the City of Lawrence, and private entities. The lessees provide a full range of marina services, recreational opportunities, and camping to the public. Additional services contracted to the private sector include mowing, refuse collection, facility cleaning, and park attendant. The Corps manages the contracts and conducts inspections to insure that the services are provided for visitors to the lake. Any award(s) made from this solicitation will be Firm-Fixed-Price, performance -based service contract(s). 1 DESCRIPTIONOFSERVICES The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other items and services necessary to perform law enforcement services at Clinton Lake, Kansas. The contractor shall adhere to all local, state, and federal regulations. 1.1 PATROLSCHEDULES 1..1.1 Routes/Schedules Submittals: All hours requested shall be patrolled. All schedules shall meet the requirements of Appendix A. 1.1.2 Itis understood that due to some incidents that officers may be occupied for a number of hours, which may not allow for patrols to be completed. If an officer is called off a lake project, the time away from the lake project will be recorded and the Government will not be charged for this time. 1.2 QUALIFICATIONS/STANDARDS 1.2.1 Law Enforcement service shall be conducted by competent, trained, professional law enforcement officers employed by the Douglas County, Kansas Sheriff's Department who meet minimal law enforcement training required by state and local laws and regulations. The Commander of Service for the Sheriff' s Department shall provide documentation for each law enforcement officer stating the experience, qualifications, and training of those personnel expected to be patrol duties. This documentation shall be submitted to the COR within 48hrs of request. 1.2.2 Equipment, patrol vehicles, equipment worn and/or carried by the individual officer, and any other equipment associated with law enforcement activities shall meet standards equal to or better than the equipment used in all other non-project areas. 1.3 REPORTS AND RECORDS 1.3.I The sheriff on duty shall complete the Dally Law Enforcement Log which shall be provided by the project office. These records shall be completed in a clear and concise manner, and provided to the project office on a bi-weekly basis. · 1.3.2 The contractor agrees to verbally report any incident involving serious injury or fatality occurring on project grounds to the Operation's Manager within 8 hours of occurrence. This shall be followed with a written report submitted within three (3) working days. 1.4. QUALITY CONTROL The contractor shall develop, submit for Contracting Officer or COR approval, and maintain a quality program to ensure law enforcement services are performed in accordance with this PWS in addition to best commercial practices. The contractor shall develop and implement procedures to identify, prevent, and ensure non­ recurrence of defective services. At a minimum, the contractor shall develop quality control procedures addressing the areas identified in Section 2 -SERVICES SUMMARY. 1.4.1 QUALITYA.SSURANCE The COR will periodically evaluate the contractor's performance using a Quality Assurance Surveillance Plan (QASP). The QASP will be developed between the COR and the contractor after contract award but prior to performance of the contract. 1.4.1.1. The COR shall inform the contractor when discrepancies occur and shall request corrective action. The COR shall make a notation of the discrepancy with the date time and discrepancy that was noted, and request the authorized contractor representative to initial the entry and provide the appropriate corrective action. 1.4. 1.2. Government Remedies : The Contracting Officer or the COR shall follow FAR 52.212.4, Contract Terms and Conditions-Commercial Items (Mar 2009), for contractor's failure to perform satisfactory services or failure to correct non-conforming services. 1.4.2. QUALITY CONTROLPLAN The contractor shall establish and maintain a complete Quality Control Plan to ensure the requirements of this contract are provided as specified. The Contracting Officer or the COR will notify the contractor of acceptance or required modifications to the plan before the contract start.date. The contractor shall make appropriate modifications at no additional cost to the Government and obtain acceptance of the plan by the Contracting Officer or the COR before the start 6fthe first operational performance period. At any time during contract performance, the Government has the right to require revisions of the Quality Control Plan at no cost to the Government should the incorporated plan fail to control the quality of service provided. The plan shall include, but is not limited to, the following: (a) A description of the inspection system, addressing all services listed in Service Summary (SS). (b) Frequency of inspections. (c) Title of the individual(s) who shall perfo1m the inspections and their organizational placement. (d) A description of methods for identifying, correcting and preventing defects in the quality of service performed before the level becomes unacceptable. (e) On-site records of all inspections conducted by contractor. The inspection records format shall include: ----- - - i. Date, time and location of inspection. ii. Signature block for the person who performed the inspection. iii. Rating of acceptable le or unacceptable. iv. Area designated for deficiencies noted and corrective action taken. v. Total number of inspections 2. SERVICESSUMMARY The. services summary provides performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. PWS Para. : Performance ·..c Threshold ' Method of Assessment SS-1 Patrol Schedules Timely notification of schedule changes or deviations 1.1. No more than two (2) errors for the month. Monthly Reduction in price for the month the deviation occurs. SS-2 Qualifications/Standards Submitted qualifications of deputies/sub-standard equipment 1.2 No more than two (2) errors for the month. Monthly Provide documentation /Replace sub-standard equipment within24hrs SS-3 Reports/Records Timely delivery/conciseness of all reports 1.3 No more than two (2) errors for the month. Monthly Re-performance shall take place within 24 hours. SS-4 Quality Control Plan Timely notification of changes to Quality Control Plan 1.4.2 No more than zero (0) errors for the month. Monthly Re-performance shall take place within 24 hours. 3. GOVERNMENT FURNISHED PROPERTY (GFP) 3.1. The government shall provide all logs/registration sheets. 4. LIST OF APPENDICIES A. Sample Quality Control Plan OP SEC Antiterrorism/Operations Security Requirements All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes. clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. The Contractor must pre-screen Candidates using the E-verify Program (http://www.dhs,gov/E-Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award. Alf contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.
