Description
This is not a request for quotations or an announcement of a forthcoming solicitation, but merely notification of the Social Security Administration's (SSA) intent to issue, on a sole-source basis, a firm fixed-price delivery order to RELX, Inc., DBA LexisNexis, against their Library of Congress FEDLINK contract for access to their online Lexis.com, Courtlink and Accurint databases. The period of performance will be for twelve (12) months, beginning September 29, 2018 through September 28, 2019. Under the authority of Federal Acquisition Regulations (FAR) 16.505(b)(2)(ii)(B), when supplies or services required by the agency are available from only one responsible source and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided. The Lexis.com, Courtlink and Accurint databases are only available from its producer and manufacturer and not through dealers or distributors. Agency personnel in the Office of Operations (DCO) and the Office of the Inspector General (OIG), as well as security personnel, require access to public records information to perform mission critical work to prevent waste, fraud, and abuse in the administration of Social Security programs. They perform regular public records searches to verify information on claimants' assets (including real property), to locate missing individuals, and to investigate prior criminal convictions to determine if an individual is authorized to serve as a representative payee, among other functions. The agency uses the Accurint database public records information extensively to combat fraud and abuse in the administration of agency programs. Legal components, including the Office of the General Counsel (OGC) and the Office of Hearings Operations (OHO), use Lexis.com and Courtlink databases extensively for the successful completion of critical agency work involving Social Security claims appealed to the administrative or federal courts. The Lexis.com database includes federal and state codes, cases, regulations, and specialized treatises, while the Courtlink database includes court dockets and documents. Agency staff in OGC, OHO, the Office of Civil Rights and Equal Opportunity (OCREO), the Office of Legislation and Congressional Affairs (OLCA), and other legal components rely on the information provided in Lexis.com, Courtlink, and Accurint databases to efficiently perform their mission critical work representing the agency in retirement and disability appeals, labor and employment complaints, contractual negotiations and disputes, and a variety of other legal areas. The content in the Lexis.com, Courtlink, and Accurint databases that make it uniquely valuable to the work of agency legal staff includes: • the world's largest collection of public and proprietary records, with more than 45 billion records covering more than 648 million unique individuals and with more than seven million documents are added to the database weekly; • a combination of tri-bureau identity data with its patented linking technology to reach beyond the limited information included in the credit header; • the only major commercial real property data with archived tax assessor records; • LexisNexis patented linking technology which cross-links every new record, regardless of whether or not the data is structured or unstructured; it has the ability to connect data behind the scenes resulting in 99.9% accuracy; • a full Comprehensive Report generated from the Advanced Person Search within Accurint® for Government that will be delivered in less than five seconds; • Customizable report options that allow SSA investigators to view, save and print information in a way that makes the most sense for their workflow; • LexisNexis' Dynamic Report feature that allows generatation of unlimited additional searches from data found in the report; • The Advanced Person Search which provides icons for criminal records, sexual offenses, concealed weapons permits, vehicle registrations, and other important information all from the search results page; • Accurint services via XML-based APIs; • exclusive access to U.S. Supreme Court Cases, Lawyers' Edition, which contains the full-text opinions of all cases from 1790; • access to the United States Code Service, which contains original annotations from Lexis' editors, and Lexis consistently leads in the timely updating of the U.S. Code; • LexisNexis Headnotes that take language directly from the case, while other services give their own interpretation of what the court is saying; • LexisNexis Case Summaries which include an organized presentation of the procedural posture, overview, and outcome of the decision - making them more comprehensive than those provided by the nearest competitor; • Shepard's® Citations Service that covers the complete spectrum of editorial analysis, making it easier to identify possible splits in authority; Shepard's uniquely covers the complete spectrum of editorial analysis, from very negative (overruled) through mild negative (distinguished) to true positive (followed); for more than 140 years, it has been the industry standard in case history and citation validation; • LexisNexis® CourtLink® which delivers online access to a collection of more than 178 million court dockets and documents from federal, state and local courts; up to 25 years of full federal docket coverage; and a unique Single-Search feature, which allows researchers to search across dockets and documents. A determination by the Government to not compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered for the purposes of determining whether to conduct a competitive procurement. The Government does not intend to pay for information provided in response to this notice. Written responses to this notice shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. All responses shall be submitted via email to Jeremiah.Quijote@ssa.gov by 11:00AM EST on June 13, 2018 and use the Reference no. 0919-18-1047. If the Agency does not receive an acceptable response to this announcement by the specified date, negotiations will be conducted with LexisNexis as the only source and a delivery order will be issued without any additional notices being posted.
