- Pursuant to the authority of FAR 13.106-1(b)(1)(i), the Contracting Officer may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source is reasonably available. The Department of Health and Human Services (HHS), Program Support Center (PSC), Acquisition Management Services (AMS) intends to sole source to: Bloomberg BNA 1801 S. Bell St. Arlington, VA 22202 The U.S. Department of Health and Human Services (HHS) The Office of the General Counsel (OGC) has a requirement for electronic access to the Bloomberg/BNA Health Care Practice Center and the publications, Health Law & Life Science News, and U.S. Law Week to assist the Office of the General Counsel with their legal research and current awareness needs. Bloomberg/BNA is the sole provider of, and original source for the Health Care Practice Center database, Health Law & Life Sciences News, and U.S. Law Week newsletter. The Office of the General Counsel has a need for this database and these publications in order to perform legal research on behalf of the Department. The Health Care Center on Bloomberg Law Provides proprietary data analytics on the largest single database of health care fraud settlement agreements. Bloomberg Law also uses proprietary technology for Federal and State regulatory and legislative tracking tools. In addition, the Health Care Practice Center contains proprietary Portfolios as well as books, manuals and treatises covering essential issues in these areas of law and regulation. Finally, the database uses proprietary citation analysis and data analytics which are applied to judicial rulings and statements of law. The Office of the General Counsel currently has contracts for both Westlaw and Lexis Advance legal research databases. The Bloomberg BNA Health Care Practice Center is the only source for its health care newsletters and U.S. Law Week because neither current awareness publication is available from another vendor. Moreover, the Health Care Practice Center has multiple proprietary tools and sources that are only available on the Bloomberg BNA platform. Switching to an another vendor's similar sources would result in a duplication of cost that is not expected to be recovered through competition and will result an unacceptable delay in fulfilling OGC's legal research requirements. This is not a solicitation for a competitive proposal. No solicitation document is available. All responsible sources that have determined that they can provide the same supplies/services may submit product information and a capabilities statement addressing their specific abilities regarding this requirement. A determination by the Government not to compete this proposed order based upon responses to this notice is solely within the discretion of the government.
