- Attachment No. 04 - Invoice and Payment Provision Attachment No. 03 - FAR clause 52.212-5 Attachment No. 02 - FAR clause 52.212-3 Attachment No. 01 - Purchase Description (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is NIHDA201800276 and the solicitation is issued as a request for quotation (RFQ). This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures; FAR Subpart 13.5-Simplified Procedures for Certain Commercial Items; and FAR Part 12-Acquisition of Commercial Items, and is not expected to exceed the simplified acquisition threshold. (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-99, dated June 15, 2018. (iv) The associated NAICS code 325120 and the small business size standard is 1,000 employees. This requirement is a total small business set-aside. (v) The Government contemplates a firm fixed price type contract for this requirement with a one-year base period of weekly deliveries. The contract will include two (2) one-year option periods. The total duration of this contract, including the exercise of all option period, shall not exceed three (3) years. The contract will also include an option quantity for additional items in each contract year. A brief description of the requirement, name of items, quantities, units of measure, option periods, and option quantities are described in the attachment(s) to this Solicitation. (vi) The purchase description and salient characteristics are described in the attachment(s) to this Solicitation. (vii) Deliveries shall be weekly on Thursdays. NCATS will order on Mondays and the Contractor shall acknowledge receipt of order. All tanks shall be delivered to NCATS, 9800 Medical Center Drive, Rockville, MD 20850, on Thursdays of the same week as the order between the hours of 8:30am and 4:30pm Eastern Time. (viii) The provision at FAR clause 52.212-1, Instructions to Offerors -- Commercial Items (Jan 2017), applies to this acquisition and is incorporated in the solicitation by reference. (ix) The provision at FAR clause 52.212-2, Evaluation -- Commercial Items (Oct 2014), applies to this acquisition. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: technical capability of the item offered to meet the Government requirement; price/cost; and past performance (see FAR 13.106-2). Technical and past performance, when combined, are significantly more important than cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) The provision at FAR clause 52.212-3, Offeror Representations and Certifications -- Commercial Items (Nov 2017), applies to this acquisition and is attached to the solicitation for offerors to complete. The Offerors are to include a completed copy of the provision with its offer. (xi) FAR clause 52.212-4, Contract Terms and Conditions -- Commercial Items (Jan 2017), applies to this acquisition. (xii) FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition and is attached to the solicitation. (xiii) FAR clause 52.217-7, Option for Increased Quantity - Separately Priced Line Item (Mar 1989), applies to this acquisition. The option quantities are described in the attachment(s) to the solicitation. The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within thirty (30) days. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree. (End of Clause) FAR clause 52.217-9, Option to Extend the Term of the Contract (Mar 2000), applies to this acquisition. (a) The Government may extend the term of this contract by written notice to the Contractor prior to contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least thirty (30) days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed three (3) years. (End of Clause) (xiv) The Defense Priorities and Allocations System (DPAS) are not applicable to this requirement. (xv) Responses to this solicitation must include sufficient information to establish the interested parties' bona-fide capabilities of providing the product or service. The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s); product description; and any other information or factors that may be considered in the award decision. Such factors may include: past performance; special features required for effective program performance; trade-in considerations; probable life of the item selected as compared with that of a comparable item; warranty considerations; maintenance availability; and environmental and energy efficiency considerations. In addition the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." All responses must be received by 5:00 PM, Eastern Time, Wednesday, June 27, 2018, and reference number NIHDA201800276.
