6 pictures Drawing P-6 Drawing P-2 SOW This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. All vendors shall be registered at www.sam.gov. Any amendments issued to this solicitation will ONLY be available on the www.fbo.gov. (ii) The solicitation 693JF718R000023 is issued as a request for proposal (RFP). (iii) A statement that the solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-98 May 31, 2018. (iv) This solicitation is set-aside for Total Small Business and the associated NAICS code is 541330 with a small business size standard of $15 mil. (v) Line Item 0001: Engineering analysis of Mallory pier settlement (vi) Description of Requirement: The objective of this requirement in accordance with (IAW) the attached Statement of Work (SOW) and pictures, the licensed, qualified, and insured contractor shall furnish services, labor, equipment, supplies, tools, transportation to investigate why the Mallory Pier (located at the US Merchant Marine Academy Kings Point, NY) asphalt pavement is being eroded and the road surface above the circulation inlet appears to be sinking. Service Contract Act Wage Determination No.: 2015-4157 Revision No.: 5 Date of Rev: 01/10/2018. The Contractor is responsible to refer to the above wage decision. The latest version will be included in the contract. (vii) Date(s) and place(s) of delivery and acceptance and FOB point: Period of Performance: Work is to be completed within thirty (30) days after issuance of Notice-to-Proceed. Place of Performance: United States Merchant Marine Academy (USMMA) 300 Steamboat Road, Kings Point, NY 11024. 52.211-11-Liquidated Damages -Supplies, Services, or Research and Development (Sep 2000). (a) If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the Government liquidated damages of 3.33333% of the FFP per calendar day of delay. (b) If the Government terminates this contract in whole or in part under the Default -- Fixed-Price Supply and Service clause, the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause. (c) The Contractor will not be charged with liquidated damages when the delay in delivery or performance is beyond the control and without the fault or negligence of the Contractor as defined in the Default -- Fixed-Price Supply and Service clause in this contract. (End of Clause) (viii) 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition, Jan 2017. Addendum: The Firm-Fixed-Price Contract will be made on the basis of the lowest evaluated price of the proposal(s) meeting or exceeding the acceptability standards for non-priced factors in accordance with (IAW) FAR 13.106(a)(2), Best Value and FAR 15.101-2(b) Lowest Price Technically Acceptable. In addition to submitting your signed/dated proposal, acknowledgment of all amendments, and the completed Representations and Certifications IAW FAR 52.212-3, you are required to submit the following information with your offer: 1. Technical Approach: Contractor must provide its approach on how he intends to do the work. 2. Qualifications: Contractor shall produce proof of required certifications and licenses for the Civil Engineer and the Divers performing the work. 3. Experience: Offerors are required to submit prior experience of recent and relevant contracts/projects. Contracts/Projects can be performed with Federal, State, local or private companies. Contracts/Projects that are relevant are defined as those that are similar to the requirements of the Statement of Work (SOW). Contracts/Projects that are recent are defined as those that have been completed within the last five (5) years. 4. References: A minimum of two (2) contracts/Projects shall be provided to include: Contract number, Title of Project, Period of Performance and or completion date, Name of the Company, and a Point of Contact. Note: Previous Federal Government contract work will be verified in the Contractor Performance Assessment Reporting System(CPARS). 5. Firm-Fixed-Price (ix) 52.212-2, Evaluation -- Commercial Items, is not applicable to this acquisition. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award shall be made to the lowest priced technically acceptable offers. Factors of Evaluation: Factor 1 - Technical Approach: a. The offeror must clearly describe how he intends to deliver or meet the requirements in the solicitation. b. The text should be 12 Pitch Time Roman and be no more than 15 8-1/2 x 11 inch pages in length. Factor 2 - Qualifications: Must show credentials such as licenses, certifications for Divers and Civil Engineer. Factor 3 - Experience: Experience must be recent and relevant. Contracts/Projects that are recent are defined as those that have been completed within the last five (5) years. Factor 4 - References: Contracts/Projects that are recent are defined as those that have been completed within the last five (5) years. Factor 5 - Price Reasonableness: Award will be made to the lowest priced offeror from those offerors determined to be acceptable. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) Offeror shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer. (xi) 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and a statement regarding any addenda to the clause. 52.212-5 are attached. (xii) 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition and the following clauses under subparagraph (b) apply: 52.203-6; 52.204-10; 52.209-6; 52.219-6; 52.219-8; 52.219-28; 52.222-3; 52.222-19; 52.222-21; 52.222-26; 52.222-35; 52.222-36; 52.222-37; 52.222-40; 52.222-50; 52.223-18; 52.225-3; 52.225-13; 52.232-33; 52.222-41; 52.222-42; 52.222-4; 52.222-55. (xiii) The following FAR provisions apply to this acquisition: 52.203-18 Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements (FEB 2015); 52.204-22 Alternative Line Item Proposal (JAN 2017).
