Description
A number of Answers to Questions regarding the Draft SIR will be provided in due course, and all Questions will be reviewed and integrated into the Final SIR as much as possible. In the interim, to assist vendors in a potential bid/no-bid decision, the following two Answers are provided now: Q: Do offerors have to possess a Secret facility clearance at time of contract award? A: No. Q: With regard to paragraph 3 that states "All members of the successful Offeror ™s Solution-Delivery Team will have an unmitigatable conflict of interest on all FAA contracts awarded or performed during the FBSS period of performance." If the meaning of "member" is companies, can you address if such a conflict of interest is considered to exist if an Offeror already has been awarded other contracts that are pre-existing to the FBSS award and which have additional option years available? Can you also clarify this with regards to an Offeror that may wish to re-bid on the existing contracts they are currently performing? A: śMember ť refers to company not contractor resources. Vendors currently performing work on an FAA contract/task order as a prime contractor or subcontractor may continue the current period of performance; however, the Contracting Officer has the discretion to determine if such work creates an organizational conflict of interest and to determine whether any mitigation plan for such a conflict is required. Such vendors will be required to submit a Mitigation Plan with their proposals. Previously awarded Options may or may not be exercised at the sole discretion of the FAA. Vendors may not be awarded any *new* work at the FAA after award of the FBSS contract as a prime contractor or subcontractor until the expiration of the FBSS contract.
