- Notice Type: Pre-Solicitation Response Date: 07/01/2018 10:00 am Eastern Archiving Policy: Automatic, 15 days after response due date Base Notice: Notice of NIST's Intent to Negotiate on Sole Source Basis for Preventative Maintenance Service Contract Agreement for JEOL JMS-T100LP and DART-OS System- NB643040-18-02067 The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with JEOL USA Inc., located at 11 Dearborn Road, Peabody, MA 01960 USA to purchase a preventative maintenance service contract agreement for JEOL JMS-T100LP and DART-OS System NIST's Surface and Materials Measurement Science Division (MMSD) develop measurement and standards to supports forensic characterization of explosives and narcotics using a variety of analytical methods. Our ongoing work in homeland security requires sensitive instrumentation which can accurately separate and measure explosive and narcotics. Continuation of a preventative maintenance service contract agreement is needed for a JEOL JMS-T100LP mass spectrometer and corresponding DART-OS ionization source (Serial # MS1066001000100). This instrument is routinely used to detect, identify and measure ambient pressure organic and inorganic ions using methods developed here at NIST to support work completed for the Department of Homeland Security (DHS) and Department of Defense (DOD), focusing on the development of techniques for trace explosives and narcotics detection. Continuing the preventative maintenance service contract will allow us to maintain the high level of sensitivity and repeatability needed for these types of measurements. The purpose of this requirement is to ensure the aforementioned mass spectrometer and ionization source instruments can operate effectively and provide the Materials Measurement Science Division with advanced analytical methods and measurement capabilities for trace explosives and narcotics detection to support our forensic and homeland security programs. The sole source justification is based on the following: the specification sheets and instrument diagrams needed to perform the preventative maintenance of the instrument is proprietary information and only technicians employed by JEOL USA have access to such documentation. Software updates, user manuals, and service manuals are not open access and are provided solely to instrument owners and JEOL technicians. Because of this, only JEOL USA is capable of ensuring an instrument in meeting specification. Market research, found that no third-party vendors authorized to perform maintenance on the equipment. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 811310 with a size standard of 7.5 million dollars. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 10:00 AM ET on July 01, 2018, will be considered by the Government. SPECIFIC TASKS of MAINTENNACE AGREEMENT The Contractor shall provide repair and preventative maintenance services to the JEOL JMS-T100LP mass spectrometer (Serial # MS1066001000100) and DART-OS ionization source. The service contract should include the following: 1. Up to 1 routine and preventative maintenance visit per year to ensure long-term performance and reliability of the instrument. 2. Dispatch of a technician for emergency service when the instrument becomes inoperable or fails to perform to specifications due to a failure in the instrument. 3. Replacement of defective parts with JEOL certified replacement parts. The service contract shall cover a period of 1 year from date of award. First routine service may be scheduled within 90 days from the date of award. Scheduling of the visits shall be consistent with the maintenance requirements of the instrument in accordance with the most recent service practice and maintenance protocols. Preventive maintenance visits shall occur during regular business hours. The visits shall be scheduled at least 30 days in advance with the Contracting Officer's Representative (COR). The scheduled maintenance visits may be made at the same time as an unscheduled visit for corrective action if such a visit occurs within one month before a scheduled preventive maintenance visit. The COR will contact the Contractor to schedule a mutually acceptable date and time for the preventive maintenance visits. • SYSTEM ENHANCEMENTS The Contractor shall be responsible for contacting and notifying the COR of all software updates released not later than 60 days after any such update is released. If Contractor installation is necessary to ensure proper performance, prior to completion of the installation, the Contractor shall test the equipment, review each instrument's performance, and take whatever steps necessary to ensure each instrument is function in accordance with the manufacturer's specifications. • SERVICE CALLS The Contractor shall respond to an unlimited number of requests for service calls in the event of instrument failure, which require immediate repair. The Contractor shall provide travel, labor, and any factory-certified parts that require replacement. The Contractor shall respond to service calls during regular business hours only. A service technician shall provide on-site service at NIST Gaithersburg within a maximum 72-hour response time after the call is placed. No weekend service visits shall be required. In the event that the Contractor is unable to resolve the problem during the service call, the Contractor shall provide telephone and on-site support, as needed, to expedite a solution for NIST The Contractor shall be responsible for obtaining all parts required for all repairs and maintenance. The Contractor shall make a reasonable effort to secure parts within 24 hours after identifying the need for a replacement part for the covered equipment. All repairs must result in the instruments meeting the performance specifications as set forth by the manufacturer. Any parts or components removed for replacement shall become the property of the Contractor unless otherwise agreed to by the parties. The Contractor shall remove the parts from the NIST campus at the time of the service call, or provide shipping instructions and return shipping information that NIST may return the parts to the Contractor within 3 days after the service visit is completed. The Contractor shall assume all charges and liability for all shipments. • SERVICE CONDITIONS The Contractor shall provide original equipment manufacturer certified engineers and/or technicians during the performance period for each service agreement. Contractor personnel must be U.S. citizens to access the NIST, Gaithersburg campus. To the maximum extent practicable, service shall be rendered on-site at the NIST Gaithersburg, MD campus for the instruments. In the event that a part needs to be repaired off-site, the Contractor shall be responsible for all packaging, shipping, and transportation costs. The Contractor shall assume all charges and liability for shipments to and from NIST Gaithersburg. The Contractor shall be responsible for providing NIST Gaithersburg with packaging instructions, a shipping account number, and a Return Authorization Number authorizing return of the shipment to their facility prior to the shipment. • TELEPHONE SUPPORT The Contractor shall provide telephone support for the covered equipment during regular business hours. Telephone support must include response to questions about operating practices, application use, and service issues that can be diagnosed and resolved over the telephone. Responses must be received within 2 business day(s) of each request. • WARRANTY All labor, replacement parts, and components (excluding consumables) provided by the Contractor are guaranteed for a period of ninety (90) days from the service visit completion date. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
