- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), Clinical Center (CC), Office of Purchasing and Contracts (OPC) on behalf of the Department of Laboratory Medicine (DLM), Clinical Center (CC) at the National Institutes of Health (NIH) intends to negotiate and award a contract without providing for full and open competition (including brand-name) to: ROCHE DIAGNOSTICS CORPORATION 9115 Hague Road Indianapolis, IN 46256-1025 UNITED STATES NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516 with a Size Standard 1,000. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-97, January 24, 2018. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. GENERAL INFORMATION 1. Title: Roche Discovery / BenchMark Ultras Reagent Rental Agreement 2. Background Information: The Department of Laboratory Medicine serves as the clinical laboratory of the NIH Clinical Center. It provides laboratory support for patient care and research protocols and performs research and training in disciplines of Clinical Pathology. In doing so it provides state-of-the-art laboratory testing in support of Clinical Center patient care and serves as a center of excellence in research and training in laboratory medicine, particularly in areas which utilize the unique strengths of the National Institutes of Health. As a result it is necessary for our medical technologists to focus on experiments and testing at hand. The Department of Laboratory Medicine's Hematology Service (Histology) is in need of fully automated, open and flexible IHC/ISH staining system for bone marrow analysis. •Flexibility to choose our own antibodies, probes, pretreatments, fluorescence, linkers and blockers Improve the run to-run reliability •Free up valuable tech time •Produce high quality- reproducible results •Decrease turn-around time The current system in use is the Roche BenchMark Ultra (4) which is acceptable for the current workload but is not designed for the development of new applications utilizing multi-color detection. The new analyzer must be compatible with the current system and reagents must be interchangeable. 3. Purpose or Objective: The DLM requires the delivery and installation of the instrument. The equipment shall support the processing of all CC bone marrow biopsy samples obtained for clinical diagnosis. The new analyzer must be compatible with the current system and reagents must be interchangeable. 4. Period of Performance: One year with an approximately start date on or around 7/13/18 CONTRACTOR REQUIREMENTS (SCOPE OF WORK) The Department of Laboratory Medicine's Hematology Service is in need of the following: • Reagent rental agreement (Base yr) covering the following: 1. Maintenance/service for (3) Roche BenchMark Ultras Ser # 311065, 311332, 311346 for 1 year. 2. (1) Roche Discovery with trade-in of (1) BenchMark Ultra Ser #311348. 3. (1) mRNA Software (ULTRA) 1-year service General Requirements: •Hands-free processing •Barcode driven protocols: reagents and slides are barcoded •Automated fluidics - ensuring precise delivery of aqueous solutions •Liquid cover slipping •Advanced staining performance - multi color platforms •Individualized temperature controls •Air vortex mixing •Full aqueous coverage of slides •Dual rinse for complete reagent removal between steps Specific Requirements: •IHC and multiplex IHC •Gene & protein IHC/ISH •mRNA ISH •miRNA ISH •DNA ISH •Automated 5-plex fluorescent assay •Anti-mouse, anti-goat, anti-rabbit, anti-rat secondary antibodies Agreement Details and Terms: The term of the agreement shall be one (1) year - (BASE) •Reagent Rental agreement - is provided at "No Additional Charge" in exchange for compliance with the volume commitment. •Committed volumes: 18,000 IHC Slides/year •At the end of the seventy-two (12) month term, title will transfer upon successful completion of committed volumes. •Standard service is included for the equipment for the term of the agreement. oReagent rental agreement pricing must include the cost of service on our remaining (3) Roche BenchMark Ultras for the life of the agreement. •Standing order will be established for the term of the agreement •This instrument will NOT be interfaced with LIS Soft. •Option of upgrading the system to new available technology during term of contract. •Training provided off-site for (2) histotechnologists along with on-site training. •Replacement of one (1) BenchMark Ultra IHC system (serial number 311348) with one (1) Roche Discovery. Period of Performance: One year with an approximate start date on or around July 13, 2018. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION This system is on site and has been validated for use on CC patients. It would be detrimental to the government to attempt to change systems and quite impossible as these instruments are proprietary and only distributed by Roche. With the continuation of using the same system will also help reduces the risk of a disruption in patient care. The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a technical proposal, a cost-price proposal, the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by July 10, 2018, 12:00 PM Eastern time and must reference solicitation number 18-010808.
